Publics concerned: members of the body of information and communication systems engineers (ISIC).
Subject: new special status applicable to the ISIC body.
Entry into force: the text comes into force on June 1, 2015.
Notice: This decree sets out the new statutory provisions applicable to the body of ISIC. By participating in the objective of modernization of the State, it aims, on the one hand, to create a body of interdepartmental officials under the Minister of the Interior and, on the other hand, to revalue the career of engineers who will be integrated into this body. The body revalorization measures result in the creation of a new sommital grade, accessible to major engineers who have previously validated a higher training cycle or have a functional job in the field of information and communication systems. This new grade will allow interested persons, who are currently ranked with a body culminating in the Gross Index 966, to reach the Gross Index 1015 and then access a special contingent-owned scale with the letter A scale. In addition, recruitment in the body is carried to the level of bac + 5.

    The engineers of the information and communication systems constitute an interdepartmental body under the Minister of the Interior classified as Class A under section 29 of the Act of January 11, 1984 referred to above.

    The body of information and communication systems engineers includes three grades:
    1° The grade of information and communication systems engineer, which has twelve levels;
    2° The rank of chief engineer of information and communication systems, which has ten levels;
    3° The rank of senior engineer in information and communication systems, which has seven levels and one special step.
    The rank of senior engineer is intended to perform functions that correspond to a particularly high level of responsibility in the field of information and communication systems.

    Information and communication systems engineers perform design, implementation, expertise, advice or control functions in information and communication systems. As such, they may exercise supervisory functions.
    They may also be in charge of the management of the relevant information and communication systems.

    The engineers of the information and communication systems perform their functions in the services of the State, its public institutions or administrative authorities with moral personality.

    Information and communication systems engineers are recruited and appointed by the Minister of the Interior.

    The Minister of the Interior assigns engineers information and communication systems to the services, public institutions and administrative authorities referred to in section 4. In respect of these personnel, the Office exercises the authority for the termination of functions, detachment and non-managerial position and also makes all decisions requiring the prior notice of the parity administrative board. Other management decisions are made by the Minister or the authority to which the officer is assigned.

    Information and communication systems engineers are required to follow training to enable them to continuously adapt to the evolution of information and communication technologies and related missions.
    They must, in particular, perform this training obligation within three years of their appointment in the body, then at least every three years and, as necessary, on the occasion of a change of functions.
    The content and format of the trainings referred to in this section are defined by a joint order of the Minister of the Interior and the Minister for the Public Service.

    Information and communication systems engineers are recruited:
    1° Through an external competition on titles and completed works of open-ended trials to candidates holding a title or diploma, classified at level I, in the field of information and communication systems or a qualification recognized as equivalent to any of these titles or diplomas under the conditions fixed by the decree of 13 February 2007 referred to above ;
    2° Through an internal competition on trials open to government officials and officials, local authorities and public institutions that depend on them, including those targeted to the governmentArticle 2 of Act No. 86-33 of 9 January 1986 bringing statutory provisions relating to the hospital public service, as well as to the military and magistrates. This competition is also open to candidates serving in an intergovernmental international organization.
    Applicants referred to in the previous paragraph must justify the competition for at least four years of public service as of January 1 of the year.
    This competition is also open to candidates justifying four years of service to an administration, agency or institution referred to in the third paragraph of the second paragraph of Article 19 of the Law of 11 January 1984 referred to above, under the conditions laid down in that paragraph;
    3° By means of an open examination contest, under the 3rd of Article 19 of the above-mentioned Act of 11 January 1984, to candidates who, as of 1 January of the year in which the contest is organized, justify the exercise, for at least five years in total, of one or more of the mandates or of one or more of the activities defined in the 3rd of this Article.
    The professional activities taken into account under this competition must have been carried out in the field of information and communication systems.
    The periods in which the exercise of several activities and mandates has been concurrent are taken into account only in one capacity;
    4° Choose:
    (a) After registration on a suitability list established after notice of the parity administrative commission. Can be registered on this suitability list the exceptional class technicians governed by the decree of 27 December 2011 referred to above warranting, as of January 1 of the year in which appointments are made, at least nine years of public service, including at least five years of service in the body of information and communication systems technicians. Can also be listed on the suitability list for employees who are seconded in the staff of information and communication systems technicians who justify the same grade and service duration conditions;
    (b) Through a professional examination open to technicians of information and communication systems governed by the decree of 27 December 2011 referred to above as well as public servants detached from this body. Interested persons must justify, as of January 1 of the year in which the professional examination is organized, six years of public service, including at least three years in the body of information and communication systems technicians.

    The number of places offered to the external contest cannot be less than 60% of the total number of places offered to the contests provided for in 1° and 2° of Article 8.
    When, for the same year, a third competition is also held, the number of places offered to this contest cannot exceed 25% of the total number of places offered to all these contests.
    Positions open for one of the three competitions that are not filled by the nomination of candidates for this competition may be awarded to candidates from other open competitions.

    I. - The number of appointments that may be made by way of internal promotion pursuant to the 4th of Article 8 cannot exceed 25% of the total number of appointments made under 1°, 2° and 3° of Article 8 and long-term detachments, direct integrations and detachments underArticle L. 4139-2 of the Defence Code.
    When this method of calculation allows for a higher number of appointments than that resulting from the application of the preceding paragraph, a maximum proportion of a fifth may be applied to 5% of the number of employees in the position of activity and detachment in the body of engineers of the information and communication systems considered as of December 31 of the year preceding that in respect of which the appointments are pronounced.
    II. - When, for the same year, the two internal promotion channels provided for in section 8, paragraph 4, are opened, the proportion of appointments that may be made through the professional examination may not be less than 70% of the total number of appointments to the election that may be made under the internal promotion.
    When the number of candidates admitted to the professional examination is less than the number of positions offered in this capacity, the number of appointments made by the aptitude list is increased to the competition.

    A joint order of the Minister of the Interior and the Minister responsible for the Public Service sets out the rules of general organization, the nature and program of the examinations and examinations mentioned in section 8.
    The Minister of the Interior determines the organization of each competition, the professional examination and appoints the members of the jury.

    I. - Candidates received at the contests mentioned in 1°, 2° and 3° of Article 8 shall be appointed as engineer of the information and communication systems trainee and graded at the 1st step of the engineering grade, subject to the application of the provisions of Article 13.
    II. - The duration of the internship is one year.
    The course includes a training period with the content and terms defined by a joint order of the Minister of Interior and the Minister responsible for the Public Service.
    Engineers of interns information and communication systems who already have the quality of an employee are placed, in their original body or employment framework, in a position of detachment during the course duration.
    At the end of the course, the engineers of the interns information and communication systems whose services have given satisfaction are held in the rank of information and communication systems engineer.
    Engineers of interns information and communication systems who have not been registered after the internship may be allowed to complete a complementary internship for up to one year.
    Engineers of interns information and communication systems who have not been allowed to perform a complementary internship or whose complementary training has not given satisfaction are either terminated if they do not have the quality of an employee in another body or employment framework, or reintegrated into their original body or employment framework.
    The duration of the internship is taken into account for the advancement within one year.
    III. - The engineers of the information and communication systems recruited under the 4th of Article 8 shall be registered upon appointment and classified under the conditions defined in Chapter III. They attend a training period whose content and terms are defined by a joint order of the Minister of Interior and the Minister of Public Service.

    Can be promoted to the rank of senior information and communication systems engineers who have completed at least three years of actual service in a civil body or a class employment framework A or the same level, having at least one year of seniority in the 5th step of their grade and meeting the training obligations set out in the second paragraph of Article 7.
    To be promoted, candidates must be registered in an annual progress table, prepared after the advice of the parity administrative board in view of the results of a selection organized by way of a professional examination.
    Information and communication systems engineers must meet the level and duration of seniority as well as actual services set out in the first paragraph no later than December 31 of the year under which the progress table is established.
    A joint decision of the Minister of the Interior and the Minister of Public Service sets out the rules relating to the nature and general organization of the professional examination and the composition and operation of the jury. The Minister of Interior organizes the professional examination and designates the jury.

    Can also be promoted to the rank of chief engineer of information and communication systems, at the choice, by way of enrollment to an annual progress table, the engineers of information and communication systems who have met the training obligations set out in the second paragraph of section 7 and who justify, no later than December 31 of the year under which the Civil Grade Table is established, of at least seven years of service

    The number of promotions that may be pronounced under section 16 is at least one sixth and not more than one third of the total number of promotions issued under sections 15 and 16.

    Can be promoted to the rank of non-class engineer of information and communication systems, at the choice, by way of enrolling in an annual progress table, the chief engineers of information and communication systems having reached the 6th level of their grade.
    The persons concerned must have met the training obligations set out in the second paragraph of section 7 and meet one of the following conditions:
    1° Either produce a certificate certifying the monitoring of all modules and the success of the higher education cycle's knowledge assessment tests for the advancement of the rank of non-class engineer of information and communication systems, in the three years prior to the date of preparation of the progress table.
    The content and organizational arrangements for the higher education cycle are defined by a joint order of the Minister of Interior and the Minister for Public Service;
    2° Either justify five years of detachment in one or more jobs in information and communication systems culminating at least in the gross index 1015 and leading to pension of the Civil and Military Pension Code during the ten years prior to the date of establishment of the advance table.
    Services performed with international intergovernmental organizations or administrations of the Member States of the European Union or another State Party to the Agreement on the European Economic Area on equivalent jobs are also, subject to the prior approval of the Minister of Interior, taken into account in calculating the five years required.
    The reference periods of three years and ten years before the date of the establishment of the advance table referred to in 1° and 2° are extended from the periods of leave referred to in 5° and 9° of Article 34, section 40 bis and section 54 of the law of 11 January 1984 referred to above, as well as to the availability mentioned in 1° of Article 47 of the decree of 16 September 1985 referred to above of which the officer benefited and during which the person concerned did not follow the higher training cycle mentioned in the 1st or was detached in a functional job mentioned in the 2nd of this article.

    The engineers and engineers of the information and communication systems appointed to the higher grade are classified at the level with an index equal to or, if not, immediately higher than that held in their original grade.
    Within the limit of the seniority required in section 14 for a promotion at the higher level, they retain the seniority acquired in their previous grade when the increase in treatment following their appointment is less than that which would have resulted from a level advancement in their former grade.
    Officials promoted as they have reached the highest level of their previous rank retain their seniority within the same limits when the salary increase following their appointment is less than that resulting from a promotion at the latter level.
    By derogation from the provisions set out in the first paragraph, the chief engineers of the information and communication systems who were detached from one of the jobs mentioned in the second paragraph of section 18 during the two years preceding that under which the grade progress table is established are classified, provided that this classification is more favourable to them, in accordance with the terms set out in the second and third paragraphs of this article, taking into account the level of employment and Agents classified under this paragraph at a level with a index lower than that seen in this job shall retain personal benefit from the previous index without, however, being able to exceed that of the special engineering level of the information and communication systems.

    Derogation from the provisions of decree of 1 September 2005, the number of promotions at the rank of senior engineer of information and communication systems is not calculated based on a rate of advancement applied to the staff of the main engineers of the information and communication systems meeting the conditions of advancement.
    The number of non-class engineers of information and communication systems cannot exceed that resulting from a percentage of engineers' staff of information and communication systems considered as of December 31 of the year prior to the year in which promotions are pronounced. This percentage is determined by joint order of the Minister of Interior, the Minister of Public Service and the Minister responsible for the budget.

    Access to the special level of non-class engineer of information and communication systems is made, at the option, by way of enrolling in an annual progress table prepared after notice of the parity administrative commission. This table may include non-class engineers of information and communication systems justifying three years of seniority in the 7th step of their grade or who, when they were or had been detached to a functional job, have a ladder with an off-scale group.
    It is taken into account, for the classification in the special level, the chevron and the seniority that the agent has achieved in that employment during the two years preceding the date on which access to the special level was organized.
    The number of special-level engineers cannot exceed a percentage of the number of non-class engineers in information and communication systems. This percentage is determined by joint order of the Minister of Interior, the Minister of Public Service and the Minister responsible for the budget.

  • Chapter V: Miscellaneous provisions Article 22 Learn more about this article...


    I. - Employees who are either detached or directly integrated into the body of information and communication systems engineers may be required to comply with the training obligations set out in the second paragraph of Article 7.
    Detached officials may ask to be integrated at any time into the body of information and communication systems engineers. Beyond a five-year period of detachment, they are offered integration into this body.
    Services performed in the body or framework of original jobs are considered to be services performed in the body of information and communication systems engineers.
    II. - Can be detached into the body of engineers of information and communication systems the military mentioned to theArticle 13 ter of the Act of 13 July 1983 referred to abovein the conditions established by the decree provided for by the same provisions.

  • Chapter VI: Transitional and final provisions Article 23 Learn more about this article...


    I. - On the date of entry into force of this decree, engineers of information and communication systems governed by the Decree No. 84-238 of 29 March 1984 relating to the specific status of the body of the engineers of the information and communication systems of the Ministry of Interior and Decentralization are integrated into the body of the engineers of the information and communication systems governed by this decree and classified to equivalence of grade and level identity, with the conservation of the seniority acquired in these levels.
    II. - Services performed in the body of engineers of information and communication systems governed by the Decree No. 84-238 of 29 March 1984 and in the ranks of this body are assimilated to services performed in the body of the engineers of the information and communication systems governed by this decree as well as in the ranks of this body.
    III. - Interested persons retain the reductions and increases of seniority granted and not used for a level advancement in their former bodies.

    I. - By derogation from the provisions of Article 18 and until December 31, 2016, may be promoted to the rank of non-class engineer of information and communication systems, at the option, by way of enrollment to an annual progress table:
    1° The chief engineers of the information and communication systems who, at the date of entry into force of this decree, are seconded to a position of chief of the services of the information and communication systems governed by the Decree of 17 October 2007 and which justify six years of detachment in one or more Chief Information and Communications Systems Service positions governed by the Decree of 17 October 2007 ;
    2° The chief engineers of the information and communication systems who, at the date of entry into force of this decree, are seconded to a position of chief of the services of the information and communication systems governed by the Decree of 17 October 2007 and which justify three years of detachment in one or more Chief Information and Communications Systems Service positions governed by the Decree of 17 October 2007 and attest to the follow-up and success of the knowledge assessment tests of at least one module of the higher training cycle provided for in 1° of Article 18;
    3° The chief engineers of the information and communication systems who have reached, at the date of entry into force of this decree, at least the 9th step of their rank and who justify four years of carrying out functions as head of departmental interdepartmental services of information and communication systems, high-level expert or project director directly subordinated to the holder of a management job and attest to the monitoring and success of the training module at least 18.
    Years of detachment in a position of head of information and communication systems services governed by the Decree of 17 October 2007 may be taken into account for the deposit mentioned in the 3° above.
    II. - By derogation from thearticle 14 of the decree of 28 July 2010 referred to abovea table of advancement to the rank of non-class engineer of information and communication systems is drawn up, under the year 2015, from the date of entry into force of this decree. The main engineers of the information and communication systems that meet one of the conditions laid down in I can be listed on this table. The percentage provided in the second paragraph of section 20 is calculated on the basis of the number of engineers in the information and communication systems considered on the date of entry into force of this Order.

    Public servants listed on a suitability list for access to the body of engineers of information and communication systems governed by the Decree No. 84-238 of 29 March 1984 relating to the specific status of the body of engineers of information and communication systems of the Ministry of Interior and Decentralization retain the possibility of being appointed in the body of engineers of information and communication systems governed by this decree.

    I. - The reserved competitions and contests for access to the body of engineers of information and communication systems governed by the Decree No. 84-238 of 29 March 1984 relating to the specific status of the body of the engineers of the information and communication systems of the Ministry of Interior and Decentralization whose opening order was issued before the date of entry into force of this decree continues until their end.
    The winners of these contests, whose appointment was not made before that same date, may be appointed as trainees in the body of the engineers of the information and communication systems governed by this decree.
    II. - Complementary lists established by the jury of the contests mentioned in I may be used to fill vacancies within the body of the engineers of the information and communication systems governed by this decree.

    Trainees within the body of engineers of information and communication systems governed by the Decree No. 84-238 of 29 March 1984 concerning the specific status of the body of the engineers of the information and communication systems of the Ministry of Interior and Decentralization continue their training in the body of the engineers of the information and communication systems governed by this decree.

    I. - The progress tables for 2015 for access to the rank of senior engineer of information and communication systems governed by the Decree No. 84-238 of 29 March 1984 relating to the specific status of the body of engineers of the information and communication systems of the Ministry of Interior and Decentralization remain valid until December 31, 2015.
    Agents promulgated pursuant to the preceding paragraph after the date of entry into force of this Order are appointed and ranked in the rank of chief engineer of information and communication systems governed by this Order.
    II. - Professional examination of access to the rank of chief engineer of information and communication systems governed by the Decree No. 84-238 of 29 March 1984 relating to the specific status of the body of the engineers of the information and communication systems of the Ministry of Interior and Decentralization, opened, before the date of entry into force of this decree, for the year 2016, continues until its end.
    The winners of this professional examination may be listed on the 2016 progress table and appointed as the senior engineer of the information and communication systems governed by this Order.

    By derogation from sections 15 and 16 of this decree, it is not required to have met the training obligations set out in the second paragraph of section 7 to obtain a promotion to the rank of senior engineer for the years 2016 and 2017.

    Employees detached from the engineers of information and communication systems governed by the Decree No. 84-238 of 29 March 1984 relating to the specific status of the body of the engineers of the information and communication systems of the Ministry of Interior and Decentralization are placed, at the date of entry into force of this decree, in the position of detachment in the body of the engineers of the information and communication systems governed by this decree for the duration of the remaining detachment to run. They are classified in this body in accordance with the provisions of Article 23.
    The services performed by the concerned in the position of detachment in the body of the engineers of the information and communication systems governed by the decree of March 29, 1984 above are assimilated to services performed in the detachment position in the body of the engineers of the information and communication systems governed by this decree.

    The parity administrative commission of the body of engineers of information and communication systems governed by the Decree No. 84-238 of 29 March 1984 For the body of engineers, the information and communication systems governed by this decree and the mandate of its members maintained shall remain competent.
    Representatives of the rank of engineers of the information and communication systems of the body governed by the decree of March 29, 1984 represent the rank of engineer of the information and communication systems of the body governed by this decree and representatives of the rank of chief engineer of the information and communication systems of the body governed by the decree of March 29, 1984 represent the rank of chief engineer of the information and communication systems of the body governed by this decree.

    The above-mentioned Decree of 16 May 2014 is amended to read:
    1° Article 1 is supplemented by a paragraph to read:
    "III. - However, the rank of engineer of the body of the engineers of the information and communication systems is accessible, under the same conditions, to the contractual agents of all ministries, public institutions under the supervision of the State and administrative authorities performing functions in the field of information and communication systems. » ;
    2° Article 3 of the same decree is repealed;
    3° In Appendix I of the same decree, in the column "A list of bodies and grades open to reserved recruitments" of the table, the words: "Ingénieur des systèmes d'information et de communication du ministère de l'Intérieur" are replaced by the words: "Ingénieur des systèmes d'information et de communication".

    The Minister of Finance and Public Accounts, the Minister of the Interior, the Minister of Decentralization and the Public Service and the Secretary of State responsible for the budget are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
