This notice is substituted for the notice to the operators published in JORF No. 0061 of 13 March 2015 (NOR reference: EINC1505709V) concerning the conditions of application, as of 1 April 2015, of the Regulation (EU) No. 284/2011 of the Commission of 22 March 2011 establishing special conditions and detailed procedures for the importation of kitchen utensils from polyamide and melamine originating China.
It is intended for importers of kitchen utensils under the following customs nomenclatures:
- code NC 3924 10 00 11 " polyamide and melamine kitchen utensils from China or Hong Kong" (origin any third country - origin from China or Hong Kong);
- code NC 3924 10 00 19 " kitchen utensils in polyamide and melamine, others".
Since April 1, 2015, the import controls for the subject goods are covered by the Departmental Directorates for Population Protection (DDPP) or, where applicable, the Regional Directorates of Companies, Competition, Consumption, Work and Employment (DIRECCTE in metropolis or overseas DIECCTE) responsible for this type of control at the first designated points of introduction (PPID), the following address:

Information on the practical modalities for the implementation of regulatory controls is also available at this address. These are generally unchanged from the terms and conditions prevailing until March 31, 2015, apart from the requirement for prior notification of the arrival of lots not to the services of the DGDDI (Customs offices of customs clearance sites) but to the DDPP or DIRECCTE/DIECCTE of the import point chosen by the operator from the list of designated HIPCs.
The declaration to be provided by the operators for each batch of polyamide and melamine plastic kitchen utensils originating in or from the People's Republic of China or the Hong Kong Special Administrative Region provided for in Regulation (EU) No. 284/2011 is supplemented by the DDPP/DIRECCTE/DIECCTE services to the PPID as soon as all required controls are carried out. It is then handed over to the importer or its representative for presentation to Customs authorities.
The filing of the customs declaration for the release of a lot is in fact subject to the submission to the customs authorities, by the importer or his representative, of this document duly completed by the competent authority of the PPID.
The importer must bear, in box 44 of the customs declaration, the document code C060 to indicate that the goods are covered by Regulation (EU) No 284/2011, as well as the references of the document referred to by the competent authority of the PPID.
