Order of 28 April 2015 amending the Order of 4 May 2009 concerning the reception of motor vehicles, their trailers and systems and equipment for these vehicles pursuant to Directive 2007/46/EC

Publics concerned: construction and development of motor vehicles.
Subject: This Decree sets out the technical requirements for vehicles for their receipt under Directive 2007/46/EC.
Entry into force: the text comes into force on the day after its publication.
Notice: taking into account various regulatory developments and individual receipts under section 24 of amended Directive 2007/46/EC.

Having regard to Regulation No. 39 00 series of amendments annexed to the Geneva Agreement of 20 March 1958 concerning uniform requirements for the approval of a vehicle type with respect to the speed indicator device, including its installation;
Having regard to the Regulation of the European Parliament and Council No. 661/2009 of 13 July 2009 concerning the requirements for the registration of motor vehicles, their trailers and separate technical systems, components and entities intended for them;
In view of Commission Regulation (EU) No. 672/2010 of 27 July 2010 concerning the requirements for the reception of de-icing and de-icing devices for the windshield of certain motor vehicles and implementing Regulation (EC) No. 661/2009 of the European Parliament and of the Council concerning the requirements for the registration of general safety of motor vehicles, their trailers and systems, components and technical entities that are separate;
Separate Commission Regulation (EU) No. 1008/2010 of 9 November 2010 concerning the requirements for the reception of windscreen and windshield devices for the windshield of certain motor vehicles and implementing Regulation (EC) No. 661/2009 of the European Parliament and the Council concerning the requirements for the registration of general safety of motor vehicles, their trailers and systems,
Having regard to Commission Regulation (EU) No. 458/2011 of 12 May 2011 providing requirements for the type-approval of motor vehicles and their trailers with regard to the assembly of their tyres and implementing Regulation (EC) No. 661/2009 of the European Parliament and the Council concerning the requirements for the registration of motor vehicles, their trailers and separate systems, components and technical entities for their vehicles;
Having regard to Commission Regulation (EU) No. 347/2012 of 16 April 2012 implementing Regulation (EC) No. 661/2009 of the European Parliament and the Council with regard to the requirements for the type-approval of certain categories of motor vehicles with respect to advanced emergency braking systems;
In view of Commission Regulation (EU) No. 351/2012 of 23 April 2012 implementing Regulation (EC) No. 661/2009 of the European Parliament and the Council with regard to the requirements for the type-approval of the installation of line-pass warning systems on motor vehicles;
In view of Commission Regulation (EU) No. 1230/2012 of 12 December 2012 concerning the requirements for the type reception for the masses and dimensions of motor vehicles and their trailers;
In view of Commission Regulation (EU) No. 2015/166 of 3 February 2015 supplementing and amending Regulation (EC) No. 661/2009 of the European Parliament and the Council with regard to the inclusion of specific procedures, assessment methods and technical requirements, and amending Directive 2007/46/EC of the European Parliament and the Council, as well as Regulation (EU) No. 1003/2010, (EU) No. 109/2011 and (EU) No.
In view of the amended Directive 2007/46/EC of 5 September 2007 establishing a framework for the reception of motor vehicles, their trailers and systems, components and technical entities for these vehicles;
Vu le road codeincluding articles L. 311-1, R. 311-1, R. 321-1 to R. 321-25;
Having regard to the amended decision of 4 May 2009 on the reception of motor vehicles, trailers and systems, components and technical entities for these vehicles;
Considering the 14 May 2014 decision on the initial compliance control of vehicles of PTAC less than or equal to 3.5 tonnes,

Article 1 of the above-mentioned decision of 4 May 2009 is amended as follows: in the definition of the CE reception by type, the words "and applicable according to the provisions set out in Annex 1 to this Order" are deleted.

Section 3 of the above-mentioned Order dated 4 May 2009 is amended to read:
In the fourth paragraph, the words "regional direction of industry, research and the environment" are replaced by the words "regional and interdepartmental direction of the environment and energy".
The fifteenth preambular paragraph is replaced by:
"is defined as the regional and interdepartmental direction of the environment and energy (DRIEE), the regional environment, development and housing branches (DREAL) and the environmental, development and housing branches (DEAL) as administrative departments responsible for the instruction of the application files submitted by the manufacturers and to:".

Section 12 of the above-mentioned Order dated 4 May 2009 is amended to read:
After the words: "defined by the above-mentioned 18 November 2005 order" are inserted the words: "or those provided in the technical specifications notebook defined by the above-mentioned 14 May 2014 order. »

Section 13 of the above-mentioned Order dated 4 May 2009 is amended to read:
The words: "Annex 4 to this Order" are replaced by the words: "in Appendix XVII of the above-mentioned Directive 2007/46/EC".

The requirements of Article 21 of the aforementioned Order of 4 May 2009 are replaced as follows:
"The provisions applicable to the individual receipt of new vehicles, other than those referred to in Appendix 2 to Amended Directive 2007/46/EC, are those set out in Appendix 3 bis of this Order and set out in the relevant application orders.
However, the vehicles referred to in paragraph 4 of Article 2 of Directive 2007/46/EC referred to above shall be subject, according to their category, to the requirements set out in Part 1 of Annex IV to this Directive.
The individual receipt form is based on the model in annex 5 to this Order.
In the light of the registration, the minutes of Schedule 3 to the above-mentioned Order of 18 November 2005 or the minutes of Schedule 2 to the above-mentioned Order of 14 May 2014 shall be reported on receipt of Schedule 5 to this Order.
An individual receipt issued in accordance with Appendix 2 of Appendix IV to Directive 2007/46/EC (Harmonized Individual Reception: HR) is the subject of the receipt form in accordance with the D model in Appendix VI to the above-mentioned directive. »

"In alternative to Annexes 6 and 7, models A2, B and C2 of certificate of conformity provided for in Appendix 9 of Directive 2007/46/EC may be used. They refer to the title: “Certificate of Compliance with a Small Series National Receipt under Article 23 of Directive 2007/46/EC”.

"Without prejudice to the application of EU Regulation No. 183/2011 of 22 February 2011, the non-harmonized individual receipt under Article 24 of Directive 2007/46/EC is mandatory as of 1 July 2015. »

"In accordance with Article 44 of the above-mentioned Directive 2007/46/EC, national receptions under theR321-15 road code continue to be granted for:


- vehicles that do not fall within the scope of the above-mentioned Directive 2007/46/EC;
-the vehicles for which the type or individual receipt under the above-mentioned Directive 2007/46/EC is optional. »

The notes to the table in Appendix IV "list of binding UNECE Regulations" of the EU Regulation 2015/166 apply.
(1) Entity or component.
(2) Vehicle or installation.
(3) Level A for complete and incomplete vehicles. Level B for completed vehicles. In this case, any transformation made on this subject on a vehicle originally received by partial receipt under the Geneva Regulation No. 48 will also be validated according to the same Regulation.
(4) Level B except for:
-relevable or unstable axles (annex IV to Regulation 1230/2012/ EU);
- the equivalence between pneumatic and non pneumatic suspensions of vehicle axles (Annex III to Regulation 1230/2012/ EU);
- the assignment of off-road character for vehicles not in accordance with paragraphs 4. 2a or 4. 3a of Part A of Annex II to Amended Directive 2007/46/EC for which a Level A is required (justificative of a laboratory notified by a Member State).

(6) Level B for self-directional trailers if the ratio of axle loads between non-guided axles and self-directed axles is equal to or greater than 1.6 in all loading conditions. Level B for front train trailers with a single steering axle.

(9) Level A for complex electronic vehicle control systems. Level C for mechanical systems.
(10) Installation of emergency braking assistance (AFU) and/or electronic trajectory control (ESC) is not required. If installed, they must comply with the regulations.
(11) By derogation from paragraph 5.2.2.2. of Regulation 13, the inertia braking of pre-train trailers shall be allowed for production of less than 50 vehicles per year.

(17) Fluorinated greenhouse gases whose global warming potential is greater than 150 are permitted until December 31, 2016.
(18) With the exception of the technical limitation of the maximum speed of 60 km/h of point 5.3.2 of Annex II to Regulation 458/2011/ EU.
(19) Application of the provisions of the corresponding line in Tables 1 and 2 of Appendix 1 to Appendix IV to Directive 2007/46/EC.
(20) The presence or functionality of the device is not required for vehicles of categories N2 or N3 equipped at the front of specific devices to ensure a particular function (e.g. snow removal blade).
X: Full compliance with the regulatory act is required; the CE reception sheet is issued; conformity of production is ensured.
A: the reception card and the reception mark are not required. Test reports must be prepared by a technical service notified by France. For items 15,19 and 31, and only in the case of receipt of completed vehicles, test reports may be prepared by a technical service notified in another Member State.
B: the technical requirements of the regulatory act must be met. Tests in the regulatory act must be completed in full; they can be made by the manufacturer himself, who then issues the technical report, subject to the agreement of the service in charge of receptions.
C: The manufacturer must demonstrate to the satisfaction of the receiving service that the basic requirements of the regulatory act are met.
D: A declaration of conformity submitted by the manufacturer is sufficient. No test report is required.
The level "X" covers the levels "A", "B", "C" and "D", the level "A" covers the levels "B", "C" and "D"; the "B" level covers the "C" and "D" levels; the "C" level covers the "D" level.

C: The manufacturer must demonstrate to the satisfaction of the receiving service that the basic requirements of the regulatory act are met.
D: a declaration of conformity submitted by the manufacturer is sufficient. No test report is required.
The level "X" covers the levels "A", "B", "C" and "D", the level "A" covers the levels "B", "C" and "D"; the "B" level covers the "C" and "D" levels; the "C" level covers the "D" level.
