The Prime Minister,
On the report of the Minister of Agriculture, Agri-Food and Forestry, spokesman for the Government,
Vu le Rural Code and Maritime Fishingincluding article L. 810-2;
Considering the advice of the National Council for Higher Education and Agricultural, Agri-Food and Veterinary Research of 3 December 2014;
Considering the opinion of the National Technical Committee for Public Agricultural Education of 27 January 2015;
Considering the opinion of the National Council for Agricultural Education of 10 February 2015,
Decrete:
After article R. 810-1 of the Rural and Maritime Fisheries Code, four articles D. 810-2 to D. 810-5 are inserted as follows:
"Art. D. 810-2.-The mediator of technical and higher agricultural education is appointed for three years by order of the minister responsible for agriculture.
"It receives individual claims regarding the operation of the public service of agricultural education in its relations with users and agents of technical and higher agricultural educational institutions.
"For the review of the claims addressed to him, he may appeal to the Department of Agriculture as necessary.
"He is the human rights defender's correspondent for the issues mentioned in the second paragraph.
"Each year, he submits to the Minister for Agriculture a report in which he formulates the proposals that appear to him to improve the functioning of the public service of agricultural education.
"Art. D. 810-3.-Only claims of users or agents who have been preceded by approaches to the services and facilities concerned are reviewed by the mediator.
"The author of the claim shall attach all relevant documents, including a copy of the decision or mail that he contests or, failing that, a description of the facts at the origin of his claim, as well as the response to the proceedings made with the services and institutions concerned, or proof of their completion.
"The mediator has a period of three months to make his comments from the receipt of the claim. »
"Art. O.C. 810-4.-Where the claim appears to be substantiated, the technical and higher agricultural education mediator shall make recommendations or proposals to the service or institution concerned.
"These are the information of the suites given to them.
"When the claims do not fall within or appear to be unfounded, the technical and higher agricultural education mediator informs the applicant.
"Art. O.C. 810-5.-The Minister for Agriculture may entrust to the Technical and Higher Agricultural Education Ombudsman any mediation, if any, as a preventive measure.
"He reports to him on his mission and offers solutions. »
The Minister of Agriculture, Agri-Food and Forestry, spokesperson for the Government, is responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.
