Key Benefits:
Publics concerned: insured under old-age insurance schemes for employees of non-employed workers in artisanal, industrial or commercial occupations, liberal professionals, lawyers and non-working workers in agricultural professions.
Purpose: Methods for calculating pension contributions for certain graduate or activity periods.
Entry into force: the text comes into force on the day after its publication.
Notice: periods of higher education as well as periods of activity that did not result in the acquisition of four quarters per year may be subject to a validation for the calculation of old-age insurance fees for the payment of contributions, in actuarially neutral conditions for pension plans.
The purpose of this Order is to draw the consequences, for the determination of the calculation parameters of this contribution payment, of the recovery of the insurance period required to benefit from a full-rate pension, implemented by the Act of 20 January 2014 guaranteeing the future and justice of the pension system. It also provides for the use of approved mortality tables for life annuity contracts for this calculation.

Vu le Decree No. 73-937 of 2 October 1973 carrying application of theArticle L. 634-3 of the Social Security Code and relating to the benefits of old-age insurance schemes of artisanal, industrial and commercial occupations relating to periods of insurance or non-employed activity prior to January 1, 1973;
Having regard to the advice of the Board of Directors of the National Insurance Fund for the Professionals of the Professionals of 14 January 2015;
Considering the opinion of the Central Board of Directors of the Agricultural Social Mutuality of 14 January 2015;
Considering the advice of the Board of Directors of the National Old Age Insurance Fund dated January 21, 2015,
Decrete:
I.-at 1° and at 2° of Article D. 351-8 of the Social Security Codeat 1° and 2° of article D. 723-6 of the same code as at 1° and at 2° of Article D. 732-46 of the Rural Code and Maritime Fishing, the report: "166/167" is replaced by the report: "171/172".
II.-Article 3 ter of Decree No. 73-937 of 2 October 1973 referred to above is amended as follows:
1° In the b of 1°, the words: "40 and a year three-quarters" are replaced by the words: "40-three years";
2° At 2° and 3°, the number: "66" is replaced by the number: "171";
3° At 3°, the number: "6767" is replaced by the number: "172.
Article D. 351-9 of the Social Security Code is amended as follows:
1° At 3°, the words: "generation tables for life annuities 1887 to 1993 annexed to the Decree of 28 July 1993 on the approval of mortality tables for life annuities" are replaced by the words: " Mortality tables applicable to pension institutions for life annuity contracts and approved by decree of the Minister for Social Security";
2° In the third paragraph of c of 4°, the number: " 167" is replaced by the number: " 172".
For the year 2015 and by derogation from last sentence of the penultimate paragraph of Article D. 351-8 of the Social Security Code, the scale established by the order made pursuant to the same article, in its version resulting from this decree, is applicable to applications filed after the day after the publication of this order.
The Minister of Finance and Public Accounts, the Minister of Social Affairs, Health and Women's Rights, the Minister of Agriculture, Agri-Food and Forestry, spokesperson for the Government, and the Secretary of State responsible for the budget are responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.
