It is addressed to importers of utensils in the following Customs nomenclatures:-code NC 3924 10 00 11 "kitchen utensils in polyamide and melamine from China or Hong Kong" (origin any third country - origin China or Hong Kong);
-CN code 3924 10 00 19 'kitchen utensils in polyamide and melamine, other";
-code NC 3924 10 00 90 for some articles intended to come into contact with foodstuffs, plastic polyamide or melamine which originated from China or Hong Kong Special administrative region.
Effective April 1, 2015, the controls on imports of the subject goods will be supported by the departmental directorates for the protection of populations (DDPP) or appropriate directions of business, competition, consumption, of labour and employment (DIRECCTE) responsible for this type of control at the first points of introduction designated (PPID) which the list can be consulted at the following address : http://www.economie.gouv.fr/dgccrf/controles-a-limportation-des-ustensiles-cuisine-en-polyamide-et-en-melamine-originaires-ou-en of information on the practical arrangements for implementation of the controls provided for in the regulation are also available at this address. These will be broadly unchanged from the terms prevailing until March 31, 2015, apart from the obligation of prior notification of the arrival of the lots to the services of the DGDDI (customs of the places of customs clearance offices) but the DDPP, or the DIRECCTE of the import point chosen by the operator from the list of PPID designated.
The declaration to be provided by operators for each lot of kitchenware plastic polyamide and melamine originating in or consigned from People's Republic of China or the Hong Kong Special administrative region under the Regulation (EU) no 284/2011 will be complemented by the DDPP/DIRECCTE to the PPID services as soon as all the required checks have been made. It will be then delivered to the importer or his representative for the purposes of presentation to the Customs authorities.
The filing of the customs declaration of release for free circulation of a lot is indeed subject to the presentation to the Customs authorities, by the importer or his representative, of this document completed by the competent authority of the PPID.
The importer shall bear, in box 44 of the customs declaration, the document C060 code to indicate that the goods are covered by the Regulation (EU) no 284/2011 as well as the references of the document referred to by the competent authority of the PPID.
