The Prime Minister,
On the report of the Minister of Social Affairs, Health and Women ' s Rights,
Vu le Social Security Codeincluding articles L. 321-1 and L. 322-5-5;
Considering the opinion of the Central Board of Directors of the Agricultural Social Mutuality of 18 December 2014;
Having regard to the advice of the Board of the National Health Insurance Fund of Employees dated 23 December 2014;
Considering the opinion of the Industrial Accidents and Occupational Diseases Commission of 14 January 2015;
Having regard to the advice of the Council of the National Health Insurance Union dated 22 January 2015;
The State Council (Social Section) heard,
Decrete:
Article R. 322-10-5 of the Social Security Code is amended as follows:
1° At the beginning of the first paragraph, it is inserted an I;
2° It is supplemented by the following paragraph:
"II.-The basic rates for reimbursement of transportation costs to insured persons who use their personal vehicles are fixed by order of the Minister for Social Security. »
Article R. 322-11-1 of the Social Security Code is amended as follows:
1° In the second paragraph:
(a) After the words: "Provisional rate of evolution" are added the words: "or that these expenses exceed an amount fixed by joint decree of ministers responsible for health and social security";
(b) The words: "increase in spending can be contained" are replaced by the words: "in expenditure can be controlled";
2° In the third paragraph, the word "April" is replaced by the word "June".
Article R. 322-11-2 of the Social Security Code is amended as follows:
1° In the first paragraph, the words: "and that the exceedance results from prescribing practices that do not comply with the requirement to use the least expensive mode of transport compatible with the condition of the recipient" are replaced by the words: "or that the annual amount of transportation expenses of the health care facility is greater than the amount of expenditure referred to in the second paragraph of section R. 332-11-1";
2° In the third paragraph, the words: "and taking into account the importance of limitation practices that do not comply with the above-mentioned requirement" are replaced by the words: "or the extent of the difference between the amount of expenditures referred to in the second paragraph of section R. 332-11-1 and the amount of expenses of the establishment".
Article R. 322-11-3 of the Social Security Code is amended as follows:
1° At 1°:
(a) After the words: "its conclusion and up-to-date" are inserted the words: ", if any,"
(b) In the last sentence, the words: "in order to gradually bring about the evolution of the expenditure of the rate referred to in article R. 322-11," are deleted;
2° It is complemented by a 3° as follows:
« 3° Where applicable, a goal to improve the organization of care or examinations delivered at the same health facility to provide the patient with the least expensive mode of transport compatible with his or her health and to help optimise the use of patient transport vehicles. »
In the second paragraph of section R. 322-11-4 of the Social Security Code, before the words: "the Director General of the Regional Health Agency shall address him," the words "and if he considers that the resulting overrun of expenditures justifies a penalty."
The Minister of Finance and Public Accounts, the Minister of Social Affairs, Health and Women's Rights and the Secretary of State responsible for the budget are responsible, each with regard to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.
