Key Benefits:
The purpose of this notice is to specify the terms and conditions for the implementation of the Implementing Regulations (EU) 2015/175 of 5 February 2015 which will come into force on 26 February 2015.
It is for importers:
- lots of guar gums, subject to NC code ex 1302 32 90, TARIC 10 and 19 subdivision, originating in or from India, intended for human consumption;
- foods containing at least 20% guar gum from or from India.
Operators of the food sector or their representatives must notify the competent authority of a designated entry point (EDP), the scheduled date and time of the arrival of the lot. The following EDPs were designated:

For this purpose, they will complete Part I of the Common Entry Document (CED), the model of which and the indications to complete it, are listed in Schedule II of Regulation (EC) No. 669/2009(1) and will forward this document to the competent authority of the EDP at least one working day before the batch arrives. This document will be accompanied by the sanitary documents provided for in sections 4 and 5 of Regulation 2015/175 (analysis results and health certificate).
The regulations require, prior to the practical release of the goods, the conduct of official controls whose purpose is to verify that the batch PCP content is less than 0.01 mg/kg.
These controls, carried out prior to the practical release of the goods, consist of:
- a systematic documentary check to verify the presence and validity of a health certificate and an analytical document validated by the Indian competent authorities;
- identity control and physical control (official pupil and analysis of PCP content) covering 5% of batches notified to the DDP.
