Decision No. 2014-1544 of 16 December 2014 allocating an authorization to use radio frequencies to Inmarsat Global Limited for a network open to the public of the mobile satellite service

The Autorité de régulation des communications électronique et des postes,
Considering the amended Directive 2002/20/EC of 7 March 2002 on the authorization of electronic communications networks and services;
In light of amended Directive 2002/21/EC of 7 March 2002 on a common regulatory framework for electronic communications networks and services;
Considering the post and electronic communications code, including articles L. 33-1, L. 36-7, L. 42-1, D. 406-14 to D. 406-17 and D. 98-3 to D. 98-12;
In view of Decree No. 2002-775 of 3 May 2002 adopted pursuant to the 12th of Article L. 32 of the Post and Telecommunications Code and relating to the limits of public exposure to electromagnetic fields emitted by equipment used in telecommunications networks or by radio installations;
In view of the amended Decree No. 2007-1532 of 24 October 2007 on the royalties of the use of radio frequencies due by the licensees of the use of frequencies issued by the Authority for the regulation of electronic communications and posts;
Considering the decision of 1 September 2014 amending the national frequency band distribution table;
Having regard to decision ECC/DEC/(04)/09 of the Conference of European Post and Telecommunications Administrations on the designation of frequency bands 1,518-1 525 MHz and 1,670-1 675 MHz for mobile satellite systems;
Given ARCEP Decision No. 2005-1050 of 29 November 2005, as amended, allocating an authorization to use radio frequencies to Inmarsat Global Limited for a radio network of open-ended mobile satellite service to the public;
Having regard to the application of Inmarsat Global Limited, dated October 21, 2014;
After deliberating on 16 December 2014,
For the following reasons:
Inmarsat Global Limited submitted a request for permission to use frequencies for a mobile satellite service network by mail dated 21 October 2014.
This application concerns satellite systems from Inmarsat whose assignment was previously recorded and coordinated with the International Telecommunication Union. It is intended for frequencies for which ARCEP is affective for mobile satellite service under the national frequency band distribution table.
First, Inmarsat wishes to renew the authorization on the French territory that ARCEP issued to it by Decision No. 2005-1050 dated 29 November 2005 amended from an initial period of ten years. This renewal concerns the following frequencies of the "L" band:
1 626.5-1 645.50 MHz and 1,646.50-1 660.50 MHz for Earth-to-space connections;
1,525-1 544 MHz and 1,545-1 559 MHz for space connections to Earth.
Secondly, Inmarsat seeks permission to use new frequencies for satellite reception links, i.e. the frequency band 1,518-1 525 MHz in Region 1 within the meaning of ITU (metropole, Reunion and Mayotte).
With respect to new frequencies requested at 1,518-1 525 MHz, a provision of this decision is intended to allow for a review of their terms of use (technical parameters, guard bands, etc.) based on the outcome of the 2015 World Radiocommunication Conference. In particular, adjacent frequencies 1 492-1 518 MHz could be reassigned and demand conditions for coexistence with satellite systems at 1,518-1 525 MHz.
This decision is intended to authorize the use of the required frequencies for a period of ten years.
Decides:

Article 1


Inmarsat Global Limited is authorized to use the following frequencies to establish and operate a radio network open to the public of mobile satellite service in France:
1 626.5-1 645.50 MHz and 1,646.50-1 660.50 MHz for Earth-to-space connections;
1,525-1 544 MHz and 1,545-1 559 MHz for space connections to Earth.
Inmarsat Global Limited is authorized to use the following frequencies to establish and operate a radio network open to the public of mobile satellite service in Metropolitan France, Réunion and Mayotte:
1,518-1 525 MHz for space connections to Earth.

Article 2


The use of radio frequencies subject to this authorization shall be subject to the conditions set out in the appendix to this decision.
The conditions for the band 1,518-1 525 MHz may be reviewed at a later date (technical parameters, guard bands, etc.) in the wake of the 2015 World Radiocommunication Conference and the objective of coexistence with other radiocommunication services.

Article 3


This authorization for the use of radio frequencies shall be issued for a period of ten years and shall take effect from the date of this decision.

Article 4


The renewal of the authorization to use radio frequencies cannot be subject to a tacit renewal. Inmarsat Global Limited will notify the Electronic Communications and Post Regulatory Authority of its wish to renew it under the conditions to be notified to it at least one year before the due date of this decision.

Article 5


Inmarsat Global Limited is subject to the payment of royalties for the provision of radio and management frequencies, in accordance with the terms set out in Decree No. 2007-1532 of 24 October 2007 as amended above.

Article 6


Decision No. 2005-1050 as amended above is repealed.

Article 7


The Director General of the Electronic Communications and Post Regulatory Authority is responsible for the execution of this decision, which will be notified to Inmarsat Global Limited and published on the website of the authority and the Official Journal of the French Republic.

    Annex


    1. Satellite network authorized to use frequencies in national territory


    As part of this decision, Inmarsat Global Limited is authorized to establish connections between the Earth stations of the mobile satellite service deployed on the national territory and the Inmarsat I4F3 geostationary satellites positioned at 98° West, Alphasat, positioned at 25° East, and Inmarsat I4F1, positioned at 143.5° East.


    2. Frequency allowed alloties in French territory


    Inmarsat Global Limited is authorized to use the following frequencies in the national territory:
    1 626.5-1 645.50 MHz and 1,646.50-1 660.50 MHz for Earth-to-space connections;
    1,525-1 544 MHz and 1,545-1 559 MHz for space connections to Earth.
    Inmarsat Global Limited is authorized to use the following frequencies in metropolis, La Réunion and Mayotte:
    1,518-1 525 MHz for space connections to Earth.


    3. Conditions of use of frequencies by Earth stations of mobile satellite service


    The frequency conditions of Inmarsat Global Limited are consistent with those defined in the reporting and coordination procedures for the referenced satellite networks INMARSAT-4 98W, INMARSAT-4A 25E and INMARSAT-4 143.5E conducted with the International Telecommunication Union.
