Decree No. 2015-78 of 29 January 2015 establishing a General Secretariat for the Preparation and Organization of the Twenty-First Session of the Conference of the Parties to the United Nations Framework Convention on Climate Change

Public concerned: bodies involved in the preparation of the twenty-first session of the conference of the parties to the United Nations Framework Convention on Climate Change (COP 21) to be held in Paris in December 2015.
Subject: Establishment of a General Secretariat for the Preparation and Organization of the Twenty-first Session of the Conference of the Parties to the United Nations Framework Convention on Climate Change.
Entry into force: the provisions of this decree come into force the day after its publication in the Official Gazette.
Notice: This Decree establishes a general secretariat for the preparation and organization of the twenty-first session of the Conference of the Parties to the United Nations Framework Convention on Climate Change. It provides for the designation by decree of a Secretary General who reports to the Minister for Foreign Affairs and International Development, to the Minister of Ecology, Sustainable Development and Energy and to the Secretary of State to the Minister for Foreign Affairs and International Development, responsible for development and the Francophonie. It defines the contents of the Secretary-General ' s mission and the means available to him to carry out it.

On the report of the Prime Minister, the Minister for Foreign Affairs and International Development and the Minister of Ecology, Sustainable Development and Energy,
Having regard to the Constitution, including article 37;
Having regard to Decree No. 2012-1246 of 7 November 2012 on budgetary and accounting management, including articles 66 and 70;
Considering the decision of the Conference of the Parties to the Framework Convention on Climate Change, taken at its nineteenth session, on the twenty-first session of the Conference of the Parties and eleventh session of the Conference of the Parties serving as the meeting of the Parties to the Kyoto Protocol (FCCP/CP/2013/L.2);

It is established, with the Minister for Foreign Affairs and International Development and the Minister of Ecology, Sustainable Development and Energy, a general secretariat for the preparation and organization of the twenty-first session of the Conference of the Parties to the United Nations Framework Convention on Climate Change and the eleventh session of the Conference of the Parties serving as the Meeting of the Parties to the Kyoto Protocol and the sessions of the subsidiary bodies (COP 21) in December 2015.

The Secretary General is appointed by decree. He reports to the Minister of Foreign Affairs and International Development, to the Minister of Ecology, Sustainable Development and Energy and to the Secretary of State to the Minister of Foreign Affairs and International Development, responsible for development and the Francophonie.
It has staff made available by the Ministry of Foreign Affairs and International Development, the Ministry of Ecology, Sustainable Development and Energy and, where applicable, by other departments. It may appeal, as appropriate, to the departments of the departments concerned.
It is attached to the Minister of Foreign Affairs and International Development (General Directorate of Administration and Modernization) for his administrative management.
Without prejudice to the competences vested in the Program Officer and the Departmental Financial Officer, and in accordance with the provisions of Decree No. 2012-1246 of 7 November 2012 on budgetary and public accounting management, the Secretary General, together with the programming of the credits granted in the Finance Act for the reception by France of COP 21/CMP 11, coordinates their management and reports on the implementation.

The Secretary-General is responsible for the negotiation and implementation of the arrangements between the French Republic and the secretariat of the United Nations Framework Convention on Climate Change (UNFCCC) regarding France's hosting of COP 21/CMP 11.

The Secretary-General coordinates the development, with the relevant ministries, of the list of events, meetings and events within his competence under the hosting by France of COP 21/CMP 11. It coordinates their organization and is responsible for assessing its costs with the relevant administrations.

For all events, meetings and events held as part of the hosting by France of COP 21/CMP 11, the Secretary-General is responsible for:


- to propose a communication strategy and to coordinate its implementation;
- to propose the modalities of association of civil society to events and activities related to the reception by France of COP 21/CMP 11;
- to seek partnerships with businesses and local authorities.


It conducts, with the relevant departments, the evaluation of COP 21/CMP 11 and its final cost.

The Prime Minister, the Minister for Foreign Affairs and International Development, the Minister of Ecology, Sustainable Development and Energy and the Secretary of State for Development and Francophonie are responsible, each with regard to it, for the implementation of this decree, which will be published in the Official Journal of the French Republic.
