Under the terms of article L. 5-2 of the postal code and electronic communications (hereinafter " CPCE "), the rates for the benefit of the universal service are the subject of a multiannual framework defined by the ARCEP after consideration of the proposal by La Poste: " The Electronic Communications and Postal Regulatory Authority: [...] 3 ° Decides, after examination of the proposal of La Poste or, failing a proposal, ex officio after it has informed it, of the multiannual framework characteristics of the rates of the universal service, which may, if necessary, distinguish Consignments in number of consignments [...] shall ensure the sustainability of the universal service [...]

This Decision constitutes the fourth framework, after those covering the periods 2006-2008 (Decision No. 2006-0576), 2009-2012 (Decisions Nos. 2008-1286 and 2011-1451) and 2013-2015 (Decision No. 2012-1353). It lays down a new multiannual framework for the period 2015-2018 and repeals the previous arrangements provided for in Decision No 2012-1353.


I. -Context


La Poste is facing a profound change in its economic environment linked to the acceleration of the decline in mail volumes. Between 2008 and 2012, the number of postal items per capita decreased in France by 4.3 % per year and, in 2013, inflows into the universal service field decreased by 5.5 %. Similar developments have occurred in other European countries. They are indicative of a decrease in postal usage, which coincides with the increasing digitisation of exchanges.
The economic model of postal operators is characterised by the presence of economies of scale (plus the volumes of objects transported are The higher the cost to the object is small), by a significant proportion of labour costs, and, where appropriate, by obligations related to public service missions. These factors limit the ability to adapt loads to volumes. This is why the structural reductions of the latter destabilise the economic model of postal operators.
In the face of this situation, operators can seek to restore the balance of their economic models by reducing the Costs remaining in relation to their public service missions, by reducing their charges and by raising their prices. In this respect, many European posts have already implemented significant tariff increases.
In France, La Poste has committed, as of the end of 2013, the preparation of a strategic plan for the period 2014-2020. This plan notes the structural decline in the volumes and attendance at post offices resulting from the increasing reliance on electronic communications, as well as the resulting decrease in margins. La Poste sets itself the objective in its strategic plan the development of its activities, existing as new, and a decrease in its costs.
In this context, La Poste and the ARCEP examined, during the first half of 2014, the execution Forecast of the tariff framework covering the period 2013-2015. This system, fixed by Decision No. 2012-1353, was designed to ensure the economic equilibrium of the universal service by maintaining the margin rate on the perimeter of the tariff framework. It leaves La Poste the possibility of an annual increase equal to the rate of inflation + 1 %, of the average price of the universal service between 2013 and 2015. It is based on the assumption of an average annual change in volumes of 4.1 %, and that of a decrease in charges, in real terms, of [...] %.

The ARCEP and La Poste have therefore agreed to reform the existing system.
On 28 May 2014, the leaders of La Poste were auditioned by the Authority. They presented the strategic orientations of the La Poste Group over the period 2014-2020 as well as the economic issues relating to the universal service on this horizon. The representatives of La Poste presented the group's action plan by 2020, which constitutes the strategic plan, identifying in particular the impacts on activities linked to the universal service. Finally, they provided an analysis of the sensitivity of the group's results and the balance of the universal service to different scenarios of tariff increases.
As a result of these exchanges, the ARCEP and La Poste agreed on the The definition of a new tariff framework for the years 2015 to 2018, for a period of four years. It is thus part of the dynamic of the strategic plan, which provides for a stage in 2018. This period of four years, longer than the previous arrangements, should also allow the first measures of the plan to take full effect during the period of supervision. Finally, a mid-term appointment clause in 2016 is intended, where appropriate, to take into account possible structural changes during the framework period.


II. -On the proposal of the La Poste Group


On 2 July 2014, in accordance with the 3 ° of Article L. 5-2 of the CPCE, La Poste forwarded to the Authority a proposal concerning the multiannual framework for the payment of benefits Universal service. Additional elements have been forwarded to the Authority, at its request, on 11 and 17 July.
This proposal is based on the items noted for the year 2013 in terms of volumes and charges and is part of a review The scope of the 2020 development strategy of the La Poste group, through its strategic plan " Conquering the future ".
La Poste's proposal takes over the four-year principle with a half-year appointment clause. The overall proposed framework constraint corresponds to the consumer price index (CPI) increased by 3.5 %, with La Poste initially considering 4 %, in a context of forecast decline in volumes estimated at-6.3 % per year between 2015 and 2018.
In view of its limited capacity for short-term adjustment, La Poste indicates that it wishes to have the opportunity to consume a significant part of its room for manoeuvre at the beginning of the period of supervision. The cumulative capacity to increase prices in real terms for the years 2015, 2016, 2017 and 2018 would thus not exceed 60 %, 80 %, 90 % and 100 % of the total available over the period.
La Poste also proposes an evolution of Adjustment mechanisms to volumes and inflation compared to those provided for in Decision No. 2012-1353. In particular, it indicates that it wishes to review the proportion of the difference in the volumes it would take in the event of the implementation of the volume adjustment mechanism (30 % in the operative part of Decision No 2012-1353, 10 % in the proposal for La Poste). Finally, it indicates its intention to increase the tariff gap between the Priority Letter and the Green Letter over the period.


III. -ARCEP analysis
1. On the method


The ARCEP analysis has been:


-on the balance of the universal service, to which the tariff framework contributes: The margin provided for by the universal postal service must be at least sufficient for, on the one hand, full financing of the cost of the universal postal service of La Poste provided for in Articles L. 2 and R. 1-1 of the CECP and, on the other hand, contribute to the general and structural costs of the group; furthermore, at the group level, the scope of the universal service provision is intended to participate, as do the other activities of the group (mail and parcel services outside the universal service, express, bank) to finance the Other public service tasks (3) (which are only partially offset by public aid) and that of normal profitability;
-on the assessment of the sharing of efforts between La Poste and the users of its services Reduced volumes; in an industry which is now marked by deeconomies of ladders and by the weight of public service missions on the sizing of the productive apparatus, this reduction in volumes implies an arbitration between, The efforts made by the operator, necessarily based on Substantial savings and, on the other hand, the efforts required of users in tariff matters.


This analysis was carried out over the period 2015 -2018, corresponding to the new system envisaged.
The ARCEP relied, In addition to the audited 2013 regulatory accounts, on several sets of forward-looking information established by La Poste, in particular those resulting from the preparation of its strategic plan by 2020. The Post thus transmitted preliminary information on its volume, turnover and expenses forecasts to the ARCEP during the months of April and May. It subsequently forwarded the estimates of charges and revenues retained as part of its strategic plan for all the trades in the group. With regard to the perimeter of the parent company, La Poste also communicated the detailed anticipated trajectories of the main load drivers as well as the anticipated volumes of mail and packages.
Over the period 2015 -2018, the ARCEP a On the perimeter of the tariff framework, an average annual growth forecast of-6.3 %, and an average rate of inflation of 1.7 %:


-in terms of volumes, the ARCEP relied on the forecasts provided By La Poste. The latter foresees, over the period 2015 -2018, an average annual development of-5.8 % of the physical volume of all mail and parcel consignments. The consistency of these forecasts was verified by the ARCEP, which assessed, for each of the main categories of mail and from the quarterly series available since 2006, the correlation that could be established between the evolution of the Volumes in this category and that of GDP. The results were generally conclusive with the introduction of a trend, independent of the evolution of GDP, indicative of a drop between the evolution of GDP and the evolution of mail volumes;
-with regard to the ARCEP has selected, for the years 2015 to 2017 those in the Government's stability programme of April 23, 2014 (4) and a value of 1.75 % for the year 2018.


The ARCEP finally assumed the Universal service obligations consistent with the current framework. The Post confirmed that " [La Poste strategic plan] does not incorporate any evolution of the regulatory framework and, in particular, does not entail any changes to the universal service obligations or to sensitive developments in the universal service offer catalogue." In addition, La Poste confirmed its inclusion in the framework of the quality of service objectives prescribed in its contract of business 2013-2017.

2. Over the period 2014-2018 and the level of price cap


On the expected effects of the strategic plan for La Poste:

La Poste intends to pursue its policy of pooling points with other public services, in rural and urban areas, and to promote the development of its advisory activities, in particular financial services; these projects Should result in savings of the order of [...] % per year over the period 2014-2020 ([...] % per year over the period 2015 -2018), including a reduction in the costs of public service missions provided by the network ( [...] million and [...] million fall in the periods 2014-2020 and 2015 -2018) thanks to the development of new partnerships and new office formats; moreover, the development of banking activity should lead to a greater share of the costs of the network absorbed by this activity.


On the other hand, while deploring it, La Poste has built its financial trajectory with a hypothesis of maintaining a deficit on certain public service tasks which are only partially offset, in particular transport and Distribution of the press and land use planning. In the case of other postal service users, they mainly correspond to large emitters as well as to users of postage-paid machines. The former are entitled to a lower tariff increase than the average increase in the scope of the tariff framework, as has been the case in the past. The continuation of the tariff disconnection movement between private and company-use offerings should also limit the impact of tariff increases on the latter. This increase therefore seems to be compatible with the principle of affordability of the universal service offerings.
The level of the tariff ceiling chosen thus appears to be both economically necessary and a fair distribution of the Efforts between La Poste and its users in postal services.


3. On other provisions


On the consumer tunnel:

On adjustment mechanisms:
The ARCEP has taken the request of La Poste to have a more responsive mechanism for variations in Volumes. It has, on the other hand, maintained the coefficients relating to the share of the observed discrepancies taken by La Poste, these coefficients reflecting a fair distribution of the efforts between the operator and its users. Thus, in the event of the implementation of the volume adjustment mechanism, La Poste will be responsible for 30 % of the difference between the estimated volumes and the volumes achieved.
Of the tariff disconnections of certain products:
THE ARCEP Ensures that La Poste's rates best reflect the underlying economy of the activities concerned. The device provided for in Decision No. 2012-1353 thus introduced obligations relating to the disconnection of the tariffs of the products used by private individuals and those for use by undertakings, on the one hand, and the products of products Priority Letter And Green Letter, on the other. The tariff increases implemented in 2013 and 2014 by La Poste contributed to the fulfilment of these obligations.
In view of the decrease in volumes and the incentive for the operator to carry out such disconnection movements of measures No longer appear to be necessary. Price monitoring appears to be more appropriate and could lead to a mid-term review of the framework for tariff developments of the products concerned.


IV. -Conclusion


In view of the elements contained in the proposal of La Poste as of 2 July 2014 and the additional elements transmitted on 11 and 17 July 2014, the Authority has defined a new tariff framework Multiannual.
The framework is set for a four-year period, the period from 1 January 2015 to 31 December 2018, and provides for an average annual increase in universal service rates of 3.5 percentage points above inflation (CPI + 3.5 %).
It sets an annual consumption limit for the rate framework, Expressed in real terms, which stands at 50 % in 2015, 70 % in 2016, 90 % in 2017 and 100 % in 2018.
It adapts the adjustment mechanism to volumes to introduce greater flexibility while maintaining the level of risk sharing between La Position and users unchanged from Decision No. 2012-1353.

It will be reviewed in mid-2016.

    V. -Management of the device


    The tariff framework is subject to an appointment clause in mid-2016 after two years of implementation (tariff developments 2015 and 2016). The information available on this date will be in particular the audited results of the regulatory accounts relating to the years 2014 and 2015 and the tariff developments relating to the years 2015 and 2016.
    On this occasion, it will be carried out A review of the realization of the evolution assumptions made by La Poste in the context of the preparation of that decision and of the tariff situation. The ARCEP will examine in particular:
    1. The tariff gap between the Priority Letter and the Green Letter must reflect a satisfactory differentiation of both products. In this regard, the ARCEP hopes that the tariff gap between these two products, measured in relative value on the basis of the same basket, that of the Priority Letter, will increase over the period without narrowing the absolute gap at any time in the Period.
    2. The tariff gap between the product line and the postage stamp range for individuals; the business line must be compensated for the cost savings allowed by the use of a postage meter. In this regard, the CBWRA hopes that the tariff gap between these two ranges, measured in relative terms on the basis of the same basket, that of the gear range undertaken, is at least maintained over the period
    Give rise to adjustments to the tariff framework, in the event of a significant change in the economic environment taken into account for the establishment of the tariff framework (changes in volumes, inflation, labour law, Conditions for the exercise of the public service missions of La Poste,
    The ARCEP will be able to collect the relevant information from The Post Office.

    La Poste will communicate no later than 31 May of the year (n + 1) for the year (n):


    -the detailed annual statistics of the number of objects or products and the rates by weight range corresponding to each Universal service or provision of benefits since 2011 of the universal service scope;
    -the statistics of the number of objects and the turnover corresponding to the following aggregates:


    1. Priority letter, by isolating the terms and conditions of individual and business use, bulk shipments and industrial shipments;
    2. Letter Verte, by isolating the terms and conditions of individual and business use and the number of shipments;
    3. Ecopli, by isolating the terms and conditions of individual and business use, bulk shipments and industrial shipments;
    4. Follow-up letter, by isolating the terms and conditions of individual and business use;
    5. Direct mail, separating the offers from the semi-industrial universal service, the industrial offers and the offers out of the scope of the universal service since 1 October 2011 (Destineo Integral and Destineo Catalogue Integral);
    6. Recommended letter (by isolating terms and conditions for individual and business use) and declared value;
    7. International mail export;
    8. Universal service press;
    9. Universal service lilies;
    10. Range "
    order to allow the monitoring of the scope of the universal service and its contribution to the economic balance of the group, La Poste will also communicate the data corresponding to the following tables:
