Is approved the convention annexed to this Order and concluded, pursuant toarticle 7 of the above-mentioned order of 24 January 1996Between the Autonomous Board of Parisian Transport, the National Family Allowance Fund and the Central Agency of Social Security Agencies.
The Director of Social Security is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.

CONVENTION

The Autonomous Régie des transports parisiens (RATP), represented by Mr Pierre MONGIN, President and CEO;
The National Family Allowance Fund (CNAF), represented by its Director, Daniel LENOIR;
The Central Agency for Social Security Organizations (ACOSS), represented by its Director, Jean-Louis REY,
it agreed as follows.
Article 1
This Agreement is entered into within the framework ofArticle 7 of Order No. 96-51 of 24 January 1996, which provides, for an organization or service providing family benefits to its employees, the transfer of the management of its nationals to the family branch of the general regime within the framework of a tripartite agreement between the agency concerned, CNAF and ACOSS.
Article 2
The scope of this Agreement includes all active or retired statutory agents who, in any event, receive from the Autonomous Régie des transports parisiens (RATP) one of the family benefits referred to in this Agreement.Article L. 511-1 of the Social Security Codewhatever their place of residence.
This Agreement sets out the conditions under which, as of January 1, 2015, family allowance funds will manage the family benefits of the above-mentioned employees.
Article 3
As of January 1, 2015, the payment of family benefits due to agents defined in the first paragraph of section 2 is entirely provided by family allowances.
Claims for a period prior to January 1, 2015, not prescribed and non-contentious, as well as outstanding claims as at December 31, 2014, will be recovered by the FCA.
Claims for benefits made on or after January 1, 2015 and having an earlier date of effect will be reviewed and benefits paid, if the fee is opened, by the family allowance fund for allotment.
In the event of a dual payment of family benefits, both by the RATP and by a family allowance fund, detected during the transfer, the recovery of the undue and the sanction of the allotted party is the responsibility of the family allowance fund.
In the event of appeals filed by the allocatories, the friendly family allowances board is competent to:
- for the review of rights for the period prior to January 1, 2015. Payments of benefits due and recovery of indus will be provided by the family allowance fund;
- for the review of all rights effective January 1, 2015.
Article 4
The rate of the family allowance contribution due by the ATPP is, as of January 1, 2015, the rate determined under theArticle L. 242-12 of the Social Security Code for employers of employees mentioned in 1° of Article L. 241-6 of the same code.
As of that same date, the collection of this contribution is provided by the USSRAF.
Article 5
RATP and CNAF are committed to organizing the collaboration of their family benefits management services so that the transfer of allocataires to family allowances is carried out under the best conditions for both management structures and allocataires.
Article 6
During the first six months of 2015, the CNAF is committed to the designation of a preferred interlocutor in each family allowance fund concerned by this transfer transaction.
At the same time, the RATP will also designate privileged interlocutors, to the attention of family allowance funds.
With respect to the collection of contributions, the attached USSR will also designate one or more preferred interlocutors to the RATP.
Article 7
The signatory parties undertake a frank and complete collaboration for the successful implementation of this Convention. They mutually agree to transfer, as appropriate, any information that would facilitate the implementation of this Convention.
