Order of 18 November 2014 approving Bureau Veritas to perform certain services on behalf of the administration under the European Agreement concerning the International Carriage of Dangerous Goods by Inland Waterways (ADN)

Minister of Ecology, Sustainable Development and Energy,
Having regard to the European Agreement concerning the International Carriage of Dangerous Goods by Inland Waterways, concluded on 26 May 2000 (the so-called ADN agreement), and its annexed Regulations;
Having regard to Directive 2008/68/EC of the European Parliament and the Council of 24 September 2008 on the domestic transport of dangerous goods, as amended;
Vu le Transport codeincluding articles L. 1252-1 and R. 1252-8;
Having regard to the amended decision of 29 May 2009 concerning the carriage of dangerous goods by land (known as "TDG Order");
In light of the amended decision of 30 October 2012 on the number and territorial jurisdiction of the instructor services, as adopted under the Decrees No. 2007-1167 of 2 August 2007 relating to the driving licence and training in the conduct of motor pleasure craft and No. 2007-1168 of 2 August 2007 relating to the navigation titles of vessels and floating establishments navigating or stationing on inland waters;
Considering the report of the Administrative Committee of the European Agreement concerning the International Carriage of Dangerous Goods by Inland Waterways on the work of its first session, dated 27 June 2008, including Bureau Veritas on the list of recommended classification societies for approval;
Considering the opinion of 2 July 2013 on the publication of the terms of reference for accredited classification societies, inspection bodies and organizations designated as "competent authority" for the issuance of type certificates of approval, as part of the European Agreement concerning the International Carriage of Dangerous Goods by Inland Waterways (ADN), published in Official Bulletin No. 2013/13 of the Ministry of Ecology, Sustainable Development and Energy of 25 July 2013;
Considering the request of 12 June 2014 of Bureau Veritas, domiciled office: 67/71, boulevard du Château, 92571 Neuilly-sur-Seine Cedex, marine division, direction of inland navigation (DNI): Mechelsesteenweg 128-136, B-2018 Antwerp (Belgium) ;
In the light of the opinion of the Interdepartmental Commission on the Transport of Dangerous Goods dated 8 October 2014,
Stop it!

Article 1


Under the conditions set out in 1.16.3.1 of the Regulations annexed to the above-mentioned DNA, Bureau Veritas is approved as a "accredited classification society" to conduct the visits under 1.16.8, 1.16.9 and 1.16.10 of the Regulations.
These visits are subject to the terms set out in 4.2 of Appendix A to the above-mentioned Notice of July 2, 2013.

Article 2


Bureau Veritas is approved as a "registered classification society" to carry out the inspections, audits and tests listed in 3 of Schedule A to the above-mentioned Notice of July 2, 2013, and to prepare certificates, lists, reports, and supporting documentation.
These certificates, lists, reports and supporting documents are subject to the terms set out in 4.1 of Appendix A to the above-mentioned Notice of July 2, 2013.

Article 3


Bureau Veritas provides its gracious support to the administration when the conditions of 4.3 of Appendix A are met in the notice of July 2, 2013 referred to above.

Article 4


Pursuant to Article 3 of the above-mentioned ADN Agreement and Chapter 1.2 of its annexed Regulations, Bureau Veritas is designated as "competent authority", in accordance with the terms set out in Appendix C of the above-mentioned Notice of 2 July 2013 for the issuance of type certificates relating to equipment, devices or materials, where such type approvals are required by the Regulations annexed to the DNA.

Article 5


This Order comes into force on 1 January 2015.
It is valid until December 31, 2019.

Article 6


The approvals under sections 1 and 2 and the designation under section 4 of this Order may be restricted, suspended or withdrawn in the event of a serious breach of the obligations set out in the ADN Agreement and its annexed Regulations, the Order "TMD" or the notice of 2 July 2013 referred to above.

Article 7


Effective 1 January 2015, is repealed the Order of 8 June 2009 approving Bureau Veritas as a company on the list of classification societies listed by the Administrative Committee of the European Agreement concerning the International Carriage of Dangerous Goods by Inland Waterways (ADN).

Article 8


The Director General of Risk Prevention is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
