President of the Republic,
On the report of the Prime Minister and the Minister for Foreign Affairs and International Development,
Considering the Constitution, in particular articles 52 to 55;
Vu le Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments undertaken by France;
Vu le Decree No. 55-321 of 18 March 1955 issuing publication: 1° of the annexed convention and protocol, signed in Paris on 31 December 1953 between France and Switzerland, with a view to avoiding double taxation on income and property taxes (2); 2° of the annexed convention and protocol, also signed in Paris on 31 December 1953 between France and Switzerland, with a view to avoiding double taxation on estate taxes,
Decrete:

Article 1


The French note verbale denouncing the agreement of 31 December 1953 between the French Republic and the Swiss Confederation with a view to avoiding double taxation on inheritance taxes, signed in Bern on 17 June 2014, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign Affairs and International Development are responsible, each with respect to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.

    PORTANT DENONCIATION OF THE CONVENTION OF 31 DECEMBER 1953 BETWEEN THE FRENCH REPUBLIC AND SWITZERLAND CONFERENCE ON SUCCESSIONS, SIGNED TO BERN ON 17 JUNE 2014

    The Embassy of France presents its compliments to the Federal Department of Foreign Affairs and, referring to the agreement signed between the French Republic and the Swiss Confederation with a view to avoiding double taxation on estate taxes on 31 December 1953, has the honour to share with it the following.
    Under Article 6 of the above-mentioned Convention, "this Convention shall remain in force as long as it has not been denounced by one of the two States. Each of them may denounce it for the end of a calendar year, subject to a six-month notice." This Embassy has the honour to inform the Federal Department of Foreign Affairs of the decision of the French Government to denounce the Convention, effective 31 December 2014. This note is the denunciation provided for in Article 6 of the above-mentioned Convention.
    This Embassy requests the Federal Department for Foreign Affairs to find attached a letter from the Minister of Finance and Public Accounts, Mr. Michel Sapin, addressed to Ms. Eveline Widmer-Schlumpf, Head of the Federal Department of Finance, in which he informs him of this denunciation. The Embassy would be grateful to the Federal Department for Foreign Affairs to forward this letter to its High Recipient.

    The Embassy takes this opportunity to renew to the Federal Department of Foreign Affairs the assurances of its high consideration.

(2) Repeated by the agreement between the French Republic and the Swiss Confederation with a view to avoiding double taxation on income and property taxes (and its supplementary protocol), signed on 9 September 1966, as amended by the amendments of 3 December 1969, 2 July 1997 and 27 August 2009.
