Order of September 22, 2014 on the establishment of a technical committee and a committee on hygiene, security and working conditions of public establishment placed with the director of the National Institute of Labour, Employment and Vocational Training

Vu la Act No. 83-634 of 13 July 1983 amendments to the rights and obligations of civil servants, together with Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State;
Vu le Decree No. 82-453 of 28 May 1982 amended on occupational health and safety and on medical prevention in the public service;
Vu le Decree No. 2005-1555 of 13 December 2005 relating to INTEFP;
Vu le Decree No. 2011-184 of 15 February 2011 relating to technical committees in government departments and public institutions of the State;
Considering the advice of the Technical Committee of the National Institute of Labour, Employment and Vocational Training of 12 September 2014,

It is established, with the Director of the National Institute of Labour, Employment and Vocational Training, a technical committee of public establishment having competence, within the framework of the provisions of Title III of the above-mentioned Decree of 15 February 2011, to know all matters concerning the institution.

The composition of this technical committee is as follows:
(a) Administration representatives:


- Director of the National Institute of Labour, Employment and Vocational Training;
- the person responsible for human resources management.


(b) Staff representatives: three incumbent members and three alternate members.
Staff representatives in this committee are appointed after a vote on an acronym.

In application of thearticle 27 of the decree of 15 February 2011 referred to above, electors on the technical committee of public establishment placed with the Director General of the National Institute of Labour, Employment and Vocational Training have the choice between balloting in the ballot box and voting by correspondence.
Correspondence voting is carried out under the following conditions: the elector inserts his ballot in a first envelope, known as "Envelope No. 1", which shall not contain any mention or distinguishing sign. The elector slips this envelope in a second envelope, known as "Envelope 2", which must include its name, name, assignment and signature. This fold, obligatoryly hidden, is placed in a third envelope, called "Envelope No.3", that the elector addresses to the polling station of which he depends. Envelope No. 3 must reach the president of the polling station before the poll is closed.

At the end of the poll, the polling station conducts the census of votes by correspondence. The envelopes n° 3 and the envelopes n° 2 are open. As envelopes 2 were opened, the list of electors was started and envelope No. 1 was filed without being opened in the ballot box containing the votes of the agents who voted directly to the ballot box.
Excepted, without being open, and are annexed to the minutes the envelopes No. 3 reached after the closing time of the ballot, envelopes No. 2 on which do not appear the name and signature of the voting, or on which the name is illegible, envelopes No. 2 reached multiple under the signature of the same agent, envelopes No. 1 reached in multiple numbers under the same envelope No. The name of the voters whose envelopes emanate is not on the list of electors.
It is also set aside without opening the envelopes no. 2 from the voters who have already taken part in the ballot. In such a case, the correspondence vote is not taken into account. The polling station shall prepare a record of the census of votes by correspondence. The envelopes that have been set aside without being opened are annexed to this report.
The votes reached after the closing time of the poll are returned to the interested parties with the date and time of receipt.

A health, safety and working conditions committee is established with the Director of the National Institute of Labour, Employment and Training.

The composition of this committee shall be as follows:
(a) Administration representatives:


- Director of the National Institute of Labour, Employment and Vocational Training;
- the official with authority in human resources management;


(b) Staff representatives: six incumbent members and six alternate members;
(c) Prevention physician, assistant or prevention counsellor;
(d) The occupational health and safety inspector.

The decision of February 15, 2006 establishing and constituting a central technical committee with the director of the National Institute of Labour, Employment and Vocational Training and the decision of April 18, 2006 establishing a central hygiene and safety committee to assist the central technical committee established with the director of the National Institute of Labour, Employment and Vocational Training are repealed.

The provisions of this Order come into force from the next general renewal of the staff representative bodies in the public service of the State.

The Director of the National Institute of Labour, Employment and Vocational Training is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
