Judgment of October 1, 2014 fixing the composition of the jury and the organization of the competitions on titles allowing access to the bodies of socio-educational assistants, social and family economic advisers, specialized technical educators, young children educators and instructors of the public hospital service

Considering the Public Health Code;
Considering the national service code;
Considering the amended Act of 23 December 1901 punishing fraud in public examinations and examinations;
In light of the amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with Act No. 86-33 of 9 January 1986 on statutory provisions relating to the public hospital service;
In view of Decree No. 2007-196 of 13 February 2007 on the equivalencies of diplomas required to present themselves to the competitions of access to the bodies and employment frameworks of the public service;
In view of the amended Decree No. 2007-839 of 11 May 2007 on the special status of the body of the socio-educational frameworks of the hospital public service;
In view of Decree No. 2013-908 of 10 October 2013 on the modalities for the appointment of members of the jury and the selection committees for the recruitment and promotion of civil servants in the public service of the State, the territorial public service and the public hospital service;
In view of Decree No. 2014-99 of 4 February 2014 on the special status of the body of the hospital public service instructors;
Having regard to Decree No. 2014-100 of 4 February 2014 on the special status of the body of social and family economic advisers, the specialized technical educators and the body of young children ' s educators of the public hospital service;
In light of Decree No. 2014-101 of 4 February 2014 on the special status of the body of socio-educational assistants of the hospital public service,

The contests on title referred to in Articles 4 of the above-mentioned decrees of 4 February 2014 shall be opened in the following manner:
(a) On behalf of several establishments in the same department, by decision of the director of the establishment of the department with the largest number of beds; or
(b) On behalf of a single establishment of the department, by decision of the director of this institution; or
(c) On behalf of several institutions located in different departments, by decision of the director of the establishment with the largest number of beds.
They may also be opened by order of the President of the General Council for establishments under the sole tariff authority.
In all cases, the opening decision must indicate the establishments in which the positions are to be filled and specify the nature and number of positions opened by establishment, by competition, the address to which applications for admission must be filed and the closing date of registration.
For access to the body of socio-educational assistants, the opening decision of the contest also includes the type of employment targeted: the employment of social service assistant or the employment of specialized educator.
The opening decision of each contest must also indicate the necessary documents to take into account the applications.
In all cases, it is up to the authority vested with the appointing authority of the organizing establishment of the contest to ensure the material organization of the contest, the display of the notice of examination in the premises of the premises of the institution(s) concerned, in the premises of the regional health agency whose establishment(s) are under the control of the department in which the establishment(s) are located, as well as the publication by electronic means of the website concerned. The publication may also be made on the website of the institution(s) concerned.

Notices of opening of the contests are published at least two months before the date of the contest. Applications to compete must be received at least one month before the date of the competition to the director of the organizing establishment of the contest.
In support of its application, the applicant must attach the following documents:
1° An application for admission to compete on paper in which the candidate indicates, in the case of an open competition to fill positions in several establishments, the order of his or her preference for his or her possible assignment;
2° A detailed curriculum vitae based on paper, including the training activities followed and, where applicable, accompanied by job certificates;
3° Training titles, certifications and equivalencies, including those required for the contest in articles 4 of the above-mentioned decrees of 4 February 2014, of which he is a holder or a copy conforming to these documents;
4° A photocopy of the family booklet or the national identity card of France or of a national of one of the Member States of the European Union;
5° Where applicable, a reportable statement of military services or a photocopy of this document, or, for candidates who have not completed their national service, a document certifying their situation under the national service code;
6° Where appropriate, a reportable state of public services accompanied by the job description;
7° An application for extract of a criminal record (Bullettin 2).
The organizing authority of the contest shall determine the list of candidates authorized to participate in the contest, after verifying that they meet the conditions set out, according to the body concerned, in articles 4 of the decrees of February 4, 2014 referred to above.

The jury of each contest is appointed either by decision of the director of the organizing establishment of the contest, or by order of the president of the general council according to the criteria defined in article 2 of this order.
The jury of each contest is composed as follows:
1° The authority that opened the contest or its representative;
2° A Director of Social or Public Medical Institution or a Director of Public Health Institution of the Department;
3° A socio-educational framework, if possible exercising its functions in an institution other than that or those where the posts are to be filled;
4° A member who holds the rank of advancement of the body concerned and the employment of a social service assistant or the employment of a specialized educator for socio-educational assistants, exercising his or her functions in an institution other than that or those where the positions are to be filled.
The authority that opened the contest appoints the president of the jury.
The jury is composed in accordance with the provisions of article 1 of the decree of 10 October 2013 referred to above. In addition, the organizing authority of the competition provides for an alternate presidency between men and women in the jury.
In case of equal sharing of votes, the President's voice is preponderant.

The selection of candidates is based on an analysis of the completeness of the file based on:


- the possession of the training title or equivalent certificate required for access to the body concerned and the employment concerned for socio-educational assistants;
- the analysis of the general qualities of the application file by the jury in order to assess the suitability of the job assignments involved in the examination.

On the basis of the selection provided for in the previous article, the list of candidates admitted is established by order of merit on the proposal of the jury, by the organizing authority of the contest, within the limits of the places placed in the contest.
On the proposal of the jury, the organizing authority of the contest may propose one or more lists, by type of contest, by order of merit, the names of the candidates who would appear fit in case of holidays resulting from resignations or defections would come to occur. This supplementary list is valid until the opening date of the following contest and no later than one year after the date of its establishment.
If a competition is held on behalf of several institutions, the organizing authority shall notify the director of each of the establishments where the positions to be filled in the list or admission lists are located and, where appropriate, the list or supplementary lists.
Applicants received choose their assignment in order of classification.

Any fraud, attempted fraud or violation of the contest rules shall result in the exclusion of the contest, without prejudice, if any, of the application of the general provisions provided by the law of 23 December 1901 referred to above. The same measure may be taken against the accomplices of the main perpetrator of fraud or attempted fraud.

The Decree of 27 July 1993 on conditions of access and arrangements for the organization of the title competitions for the recruitment of socio-educational assistants, social and family economic advisers, facilitators, educators of young children and instructors of the public hospital service is repealed.

The competent authorities for the recruitment of socio-educational assistants, social and family economic advisers, specialized technical educators, educators of young children and instructors of the public hospital service are responsible, each with regard to the execution of this decree, which will be published in the Official Journal of the French Republic.
