Decree No. 2014-1074 of 22 September 2014 amending Decree No. 2012-749 of 9 May 2012 on the bonus of functions and results of the functional bodies or jobs of management staff and managers of the hospital public service

Public officials involved: staff who are seconded to the functional jobs of the managers of the hospital public service.
Purpose: extension of the function and performance premium to the functional jobs of the hospital public service managers.
Entry into force: the text comes into force from the implementation of the Decree No. 2014-8 of 7 January 2014.
Notice: This Order extends the premium of functions and results to the functional jobs of care director in certain institutions mentioned in theArticle 2 of Act No. 86-33 of 9 January 1986 with statutory provisions relating to the hospital public service.
It further provides that, to take into account the deletion of the functional level of the second grade of the body of care directors, officials positioned on this functional level and who will not be detached from a functional job governed by the new provisions of the Decree No. 2014-8 of 7 January 2014 will retain, as a personal and as long as they benefit from the reference amounts and the corresponding ceiling at this functional level as long as they retain their functions.

Vu la Act No. 86-33 of 9 January 1986 amended with statutory provisions for the hospital public service;
Vu le Decree No. 2012-749 of 9 May 2012 amended on the award of functions and results of the functional bodies or jobs of management staff and managers of the hospital public service;
Vu le Decree No. 2014-8 of 7 January 2014 relating to the conditions of appointment and advancement in the functional jobs of director of care of certain institutions referred to inArticle 2 of Act No. 86-33 of 9 January 1986 with statutory provisions relating to the hospital public service,

In article 1 of the above-mentioned decree of 9 May 2012, a paragraph is added:
"Also receive the bonus of functions and results, staff appointed in one of the functional jobs of care director under the Decree No. 2014-8 of 7 January 2014 relating to the conditions of appointment and advancement in the functional jobs of director of care of certain institutions referred to inArticle 2 of Act No. 86-33 of 9 January 1986 with statutory provisions relating to the hospital public service. »

After Article 11 of the same decree, an article 11-1 is inserted as follows:


"Art. 11-1.-The reference amounts and the ceiling corresponding to the functional jobs of the body of care directors apply, as a personal and as long as they benefit, to care managers who, at the time of the entry into force of the Decree No. 2014-7 of 7 January 2014 relating to the conditions of appointment and advancement in the functional jobs of director of care of certain institutions referred to inArticle 2 of Act No. 86-33 of 9 January 1986 having statutory provisions relating to the hospital public service, were classified in the functional level referred to in the second paragraph of Article 20 of the Decree of 19 April 2002 referred to in its drafting prior to the entry into force of the decree of 7 January 2014 referred to above, and which were then maintained on one of the functions referred to in that same paragraph of Article 20. These provisions, however, cease to be applicable when the officials concerned depart from their functions as General Care Coordinator, Technical Advisor, Educational Advisor or Director of Training Institute in addition to coordinating several institutes. »

The provisions of this Decree shall enter into force after the implementation of the decree of 7 January 2014 referred to above.

The Minister of Finance and Public Accounts, the Minister of Social Affairs, Health and Women's Rights, the Minister of Decentralization and the Public Service and the Secretary of State responsible for the budget are responsible, each with regard to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
