Judgment of July 22, 2014 establishing hygiene, safety and working conditions committees in the Ministry of Culture

Vu la Act No. 83-634 of 13 July 1983 amendments to the rights and obligations of civil servants, together with Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State;
Vu le Decree No. 82-453 of 28 May 1982 amended on occupational health and safety and on medical prevention in the public service;
Vu le Decree No. 2011-184 of 15 February 2011 modified on technical committees of parity;
Having regard to the July 22, 2014 Technical Committees Order in the Ministry of Culture and Communication;
Considering the advice of the ministerial technical committee of 27 June 2014,

Health, safety and working conditions committees are established in the Ministry of Culture and Communication in accordance with the provisions of this Order. These committees shall assist, in matters within their competence and subject to the provisions of this Order, the technical committees at the same level.

It is created with the Minister responsible for culture, in accordance with thearticle 31 of the decree of 28 May 1982 referred to above a committee on hygiene, safety and appropriate departmental working conditions to deal with issues of concern to all departments of the department responsible for culture.
Implementation provisions of Article 49 (1°) of the Decree of 28 May 1982 referred to above, and without prejudice to the application of the article of this Order, the committee of hygiene, security and ministerial working conditions shall be competent to consider matters common to the administrative public institutions referred to in Annex 1 to this Order.

It is created with the Secretary General of the Ministry of Culture, in accordance with thearticle 32 of the decree of 28 May 1982 referred to above, a committee of hygiene, security and working conditions of close proximity having jurisdiction to know matters relating to all or part of the central administration services and the national jurisdiction services of the Ministry of Culture.

It is created with each Regional Director of Cultural Affairs and Director of Cultural Affairs, in accordance with thearticle 34 of the decree of 28 May 1982 referred to above, a committee of hygiene, safety and working conditions of competent proximity to know matters of interest to their services.

It is created a committee of hygiene, safety and special working conditions:
1° With the Director of Museums for the following national jurisdiction services:
Service des bibliothèques, des archives et de la documentation générale des Musées de France ;
Museum of the Middle Ages - Baths and hotel in Cluny;
Museum of Malmaison and Bois-Préau Castles (annexes: Bonaparte House, Aix Island Museums);
Renaissance Museum, Ecouen Castle;
Port-Royal-des-Champs Museum;
Clemenceau Museum and Lattre de Tassigny;
Magnin Museum;
Musées nationales du xxe siècle des Alpes-Maritimes :


- Fernand Léger Museum;
- Museum of Biblical Message Marc Chagall;
- museum The war and the peace of Picasso;
- Museum of Prehistory;


2° With the Director of Archives of France, for the following national jurisdiction services:
National Labour World Archives;
National overseas archives;
3° With the deputy head, for the Service with national competence of the National Furniture and National Manufactures of the Gobelins, Beauvais and the Savonnerie;
4° With the Chief Heritage Officer for the following national jurisdiction services:
Department of Subaquatic and Submarine Archaeological Research;
Research laboratory for historical monuments;
Media library of architecture and heritage;
National Museum of Plans and reliefs;
5° With each of the heads of national jurisdiction:
Museums and areas of Compiègne and Blérancourt.

National Museum and Pau Castle Estate.
Musée de l'archéologie nationale et domaine de Saint-Germain-en-Laye.
National Archives.
The technical committees to which the committees of hygiene, safety and working conditions of 1°, 2°, 4° and 5° of this article shall assist are set out in Annex 2 to this Order.

It shall be established with each director general or director concerned a committee of hygiene, security and working conditions of close public establishment competent for the following establishments:

The number of seats allocated to each trade union organization for the establishment of hygiene, security and working conditions committees established by this Order shall be determined:
1° In accordance witharticle 42 of the decree of 28 May 1982 referred to aboveproportionally to the number of votes obtained in the election or designation of staff representatives in the mandatory technical committees, for hygiene, security and working conditions committees at the same level;
2° In accordance with 2° of Article 42 of the Decree of 28 May 1982 referred to above by counting on this level of votes collected for the composition of a mandatory technical committee of a broader scope.

This order applies for the professional elections of 4 December 2014. The Order of December 18, 2009 establishing the Hygiene and Safety Committees in the Department of Culture's Joint Technical Committees is repealed following the mandates in the proceedings.

The Minister for Culture is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
