Notice: the decree transposes the evolutions of Decree No. 67-290 of 28 March 1967 setting out the modalities for calculating emoluments of State personnel and public institutions of the administrative state in service abroad to military personnel involved in this capacity. It takes into account the modification of the method of calculating the sums of the family increases, introduces a 10% reduction in the residence allowance of each of the two married soldiers, partners bound by a civil pact of solidarity or living in stable concubinage and who have a common residence abroad and suppresses the loss of residence allowance abroad in the event of sick leave.

The Prime Minister,
On the report of the Minister of Foreign Affairs and International Development, the Minister of Finance and Public Accounts and the Minister of Defence,
Vu le Defence codeincluding article L. 4123-1;
Vu le Decree No. 48-1108 of 10 July 1948 amended by placing hierarchical classification of the ranks and jobs of civil and military personnel of the State under the general pension system;
Vu le Decree No. 67-290 of 28 March 1967 Amending the procedure for calculating the emoluments of State officials and public institutions of the State with an administrative character in service abroad;
Vu le Decree No. 97-900 of 1 October 1997 Amending the procedure for calculating the remuneration of foreign military personnel,
Decrete:
Sections 5, 7, 18 and 19 of the decree of 1 October 1997 referred to above, after the words "residential allowance" are added the words "foreign".
Article 2 of the above-mentioned decree of 1 October 1997 is amended as follows:
At 1°, after the words: "residential allowance" are inserted the words: "foreign, in the sense of theArticle L. 4123-1 of the Defence Code.
In 2°, after the words: "for dependent children", the words are inserted: "that take place of supplements for family expenses within the meaning of theArticle L. 4123-1 of the Defence Code "
The first two paragraphs of Article 8 of the above-mentioned Decree of 1 October 1997 are replaced by the following:
"The member who has at least one dependent child may apply to family increases that also take into account the tuition fees of the French primary and secondary primary education institutions within the country or area of duty of the officers.
The amount of family increases is obtained by applying a coefficient to the amount of the gross pensionable salary subject to gross index 585. Family increases are set in three age groups per country or locality. »
After Article 14 of the above-mentioned Decree of 1 October 1997, an article 14 bis is inserted as follows:
"Art. 14 bis. - When two members are married or partners bound by a civil pact of solidarity or live in stable and continuous concubinage and have a common residence abroad, their residence allowance abroad is reduced by 10%, respectively. »
In the third paragraph of Article 20 of the above-mentioned Decree of October 1, 1997, the words: "-50% of the residence allowance" are replaced by the words: "- the residence allowance abroad".
The Minister for Foreign Affairs and International Development, the Minister of Finance and Public Accounts, the Minister of Defence, the Minister of Decentralization and the Public Service and the Secretary of State responsible for the budget are responsible, each with respect to it, for the execution of this decree, to be published in the Official Journal of the French Republic.
