Publics concerned: military of paramedical bodies of the military health service.
Subject: Transposition to the military nurses and military technicians of the measures of the protocol of 2 February 2010 referred to as "Bashelot protocol" and the pay grids of the new paramedical space of the public hospital service.
Entry into force: the text comes into force on the day after its publication.
Notice: the decree amends the special status of the nursing and technicians of the hospitals of the armed forces by creating the military corps of the nurses in general and specialized care, the homologous body of the civil service hospital. They will be admitted to this body, upon their request, to the soldiers of the health service of the armies who hold the state nursing diploma. The current military corps of operating block nurses, nurses, anaesthetic nurses and nurses are being extinguished.
In addition, the decree extinctions the military bodies of orthophonists and orthoptists and creates the body of psychologists.
Finally, the decree transposes to the homologous bodies of those of the hospital public service the new indiciary grids of category B bodies.

Vu le Decree No. 88-1077 of 30 November 1988 amended with the specific statutes of nursing staff in the hospital public service;
Vu le Decree No. 91-129 of 31 January 1991 amended with special status of hospital psychologists;
Vu le Decree No. 2002-1490 of 20 December 2002 Amending the status of nursing and military technicians in military hospitals;
Vu le Decree No. 2008-959 of 12 September 2008 amended on the commissioned military;
Vu le Decree No. 2010-1139 of 29 September 2010 amended with special status of the nursing staff in general and specialized care of the public hospital service;
Vu le Decree No. 2011-660 of 14 June 2011 amended bearing the particular statutes of administrative personnel in category B of the hospital public service;
Vu le Decree No. 2011-744 of 27 June 2011 bearing special status of the corps of the superior hospital technicians;
Vu le Decree No. 2011-746 of 27 June 2011 amended bearing the specific statutes of the reeducation staff of category B of the hospital public service;
Vu le Decree No. 2011-748 of 27 June 2011 amended bearing the specific statutes of the medical-technical personnel of category B of the hospital public service;
Having regard to the advice of the Supreme Council of the Military Service dated 9 December 2011;
The State Council (Section of Administration) heard,

    The second paragraph and the table of correspondence of section 2 shall be replaced by the following:

    Section 6 is replaced by an article 6 as follows:
    "Art. 6.-The members of bodies other than psychologists, care directors and health professionals are recruited to choose from, in accordance with provisions of Article L. 4132-4 of the Defence Code, among the engaged soldiers who meet the conditions required on December 9, 2011 for access to the approved body of the hospital public service. »

    After Article 6, an article 6-1 is inserted as follows:
    "Art. 6-1. - Psychologists are recruited for choice, in accordance with 3° of Article L. 4132-3 of the Defence Code, among the members of the military who meet the conditions required on December 9, 2011 for access to the approved body of the hospital public service. »

    Section 13 is replaced by an article 13 as follows:
    "Art. 13.-The soldiers who meet the conditions to be recruited into the body of psychologists may apply to be admitted; In the event of the approval of this application, the non-commissioned military commanders, corvette captains, lieutenant-colonels and frigate captains are appointed in the rank of normal-class psychologist and commanders, corvette captains, lieutenant-colonels and frigate captains in the rank of off-class psychologist.
    "Careers who meet the conditions to be recruited into the body of health care executives may request integration; in the event of approval of this application, they are incorporated into the grade of health framework.
    "Careers who meet the conditions to be recruited into the General and Specialized Care Nurses may request that they be integrated.
    "In the event of approval of this application:
    " – the non-commissioned officers and marine officers who meet the conditions to be integrated as nurses in general care, other than chief executives, masters and majors, are integrated into the first rank of the body and head assistants, masters and majors in the second grade of the body;
    " – the non-commissioned officers and marine officers who meet the conditions to be integrated as operating block nurses, other than the chief executives, masters and majors, are integrated into the second rank of the body and the head assistants, masters and majors in the third grade of the body;
    " – the non-commissioned officers and marine officers who meet the conditions to be integrated as anaesthetic nurses, other than head-fighters, masters and majors, are integrated into the third grade of the body and head-orders, masters and majors in the fourth grade of the body.
    "The career soldiers who meet the conditions to be recruited into the bodies of the kinesi therapists, dietitians, laboratory technicians, medical electroradiology manipulators or hospital pharmacy preparers may ask to be integrated there; in the event of the approval of this application, non-commissioned officers and marine officers other than Chief Warrant Officers, Principal Masters and Majors are incorporated into the normal grade and Chief Warrant Officers, Principal Masters and Majors in the upper grade.
    "The career soldiers who meet the conditions to be recruited into the body of the superior hospital technicians and technicians may ask to be integrated into it; In the event of the approval of this application, non-commissioned officers and marine officers other than Chief Warrant Officers, Principal Masters and Majors are integrated into the rank of Senior Hospital Technician, Senior Managers and Majors in the rank of Senior Hospital Technician. »

    Section 14 is amended as follows:
    1° In the first paragraph, the words: “career” are deleted;
    2° In the second paragraph, the words "under articles 6 or 7" are replaced by the words "under articles 6,6-1 and 7".

    “Chapter VI



    “Transitional provisions


    "Art. 14-1.-The military nurses and technicians of the military hospitals who are in office on the date of publication of the Decree No. 2014-342 of 14 March 2014 in nursing, operating block nurses, nurses and anesthetist nurses who meet the conditions required for access to the body of general and specialized nurses may apply to be admitted to this body. This application must be submitted within twelve months of the publication of the Decree No. 2014-342 of 14 March 2014. It is exercised expressly by each of the military concerned and is final. Military personnel are admitted and reclassified to the General Care and Specialty Nurses after the date of publication of the Decree No. 2014-342 of 14 March 2014.
    "Art. 14-2.-The military nurses and technicians of the military hospitals who are in office on the date of publication of the Decree No. 2014-342 of 14 March 2014 in nursing, operating block nurses, nurses and anaesthetist nurses and who have not requested, within the time limit set out in section 14-1, to be admitted to the General and Specialized Nurses' Corps, shall remain subject to the rules that apply, on the date of December 9, 2011, to their membership, in accordance with Table 2 of 2.
    "Art. 14-3.-A the effective date of Decree No. 2014-342 of 14 March 2014, recruitment is no longer carried out in the bodies of orthophonists and orthoptists.
    "The military nurses and technicians of the military hospitals who are in office on the date of publication of the Decree No. 2014-342 of 14 March 2014 in orthophonist orthoptist jobs remain subject to the rules that apply, on the date of December 9, 2011, to their belongings, in accordance with the table of the 2nd of Article 2.
    "Art. 14-4.-I. ― The officers of the technical and administrative corps of the military health service who meet the requirements for recruitment or attachment to the psychologists ' body are admitted:
    « 1° On their request;
    « 2° On its own, as of December 1, 2015.
    "The appointments in the body of psychologists scheduled for 1° are made on the first day of the month following the date of application.
    “II. at the date of admission to the body:
    « 1° Subalternal officers are appointed in the rank of normal-class psychologist;
    « 2° Senior officers are appointed to the rank of Senior Psychologist.
    "They are classified in the level with an equal index or, if not, immediately higher than the one they hold, without a seniority.
    "III. ― provisions of Articles R. 4133-1 to R. 4133-9 of the Defence Code shall not apply to such admissions. »

    The Minister of Economy and Finance, the Minister of Defence, the Minister of State Reform, Decentralization and Public Service, and the Minister Delegate to the Minister of Economy and Finance, in charge of the budget, are responsible, each with regard to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
