Decree No. 2014-285 of 3 March 2014 amending the nomenclature of facilities classified for environmental protection

Publics concerned: operators of facilities classified for environmental protection (ICPE).
Subject: modification of the ICPE nomenclature.
Entry into force: the text comes into force on June 1, 2015.
Notice: the nomenclature of CEPAs likely to create major accidents involving hazardous substances is amended to reflect the provisions of Directive No. 2012/18/EU of 4 July 2012, known as Seveso 3, and Regulation (EC) No. 1272/2008 of 31 December 2008 on the classification, packaging and labelling of substances and mixtures. The new names of the classes, categories and hazard statements created by these Regulations are introduced into the environmental code. As a result, the quantities ("Seveso thresholds") of hazardous substances or mixtures that may be caused by major accidents or are particularly important to the safety and health of populations or the environment are reviewed.

Considering the advice of the Local Finance Committee (the Standards Assessment Advisory Board) dated 25 July 2013;

The schedule to section R. 511-9 of the Environmental Code is amended to read:
I. ― The table is amended in accordance with the schedule to this Order.
II. ― At the beginning of this annex, the following words are deleted: "Nota. ― Where a non-explicitly targeted substance is likely to be classified in several entries, it must be classified in the section with the lowest thresholds. »
III. ― At note 1, the words: "S: public utility servitude" are deleted and, in the header of the table, the characters: "S," are deleted.

Section R. 511-10 of the Environmental Code is replaced by the following:
"Art. R. 511-10.-I. ― Hazardous substances and mixtures referred to in I of Article L. 515-32 are hazardous and assimilated substances and mixtures as defined in section 4000 of the nomenclature annexed to section R. 511-9, which are covered by the entries between 4100 and 4799, and those numbered 2760-3 and 2792.
"It is defined, within these headings, quantities called high threshold quantities and, for some of them, low threshold quantities.
“II. – The facilities referred to in Article L. 515-32 are the low-end facilities and the high-end facilities defined in III.
"The facilities referred to in Article L. 515-36 are the only high threshold facilities.
"III. ― High threshold facilities are those that meet the upper threshold direct exceedance rule or the high threshold cumulative rule defined in R. 511-11.
"The low threshold facilities are those, other than the high threshold facilities, that meet the low threshold direct exceedance rule or the low threshold cumulative rule defined in R. 511-11. »

After the article R. 511-10 of the environmental code, it is inserted two articles R. 511-11 and R. 511-12 as follows:
"Art. R. 511-11. - I. A facility shall meet, respectively, the "low threshold direct overtaking rule" or the "high threshold direct overtaking rule" where, for at least one of the entries referred to in the first paragraph of Article R. 511-10, the hazardous substances or mixtures that it is intended are likely to be present in the facility in a quantity greater than or equal to the low threshold quantity or to the high threshold quantity that this section refers to.
"For a section between 4100 and 4699, all hazardous substances or mixtures of the class, category or hazard statement referred to by the class, including wastes under headings 2700 to 2799 and substances under headings 4800 to 4899, but excluding hazardous substances or mixtures designated under headings 4700 to 4799, 2760-3 and 2792 are recorded.
"For the application of the low threshold direct exceedance rule, entries not mentioning a low threshold quantity are not considered.
“II. ― The facilities of the same establishment under the same operator on the same site within the meaning of section R. 512-13 shall, respectively, meet the "low threshold cumulative rule" or the "high threshold cumulative rule" where at least one of the amounts Sa, Sb or Sc defined below is greater than or equal to:
“(a) Health hazards: the sum Sa is calculated, for all hazardous substances or mixtures with classes, categories and hazard statements referred to in sections 4100 to 4199 (including, where applicable, hazardous substances or mixtures named in sections 4700 to 4899 and wastes referred to in sections 2700 to 2799), as follows:

"Art. R. 511-12. - A hazardous substance or mixture participates in the classification of a facility vis-à-vis the nomenclature referred to in article R. 511-9, by order of priority, in one of the headings 2700 to 2799, 4700 to 4799, 4800 to 4899, if the substance or mixture is covered by one of these headings or, if not, in the section with the lowest threshold quantity of the substance 46100
"In the event of an equal amount of the numbered sections of 4100 to 4699 for the hazardous substance or mixture, the installation is classified in those entries, which, in the event of equality, shall be in the order of priority:
“– the lowest low threshold quantity;
"– the lowest permit threshold;
"– the lowest registration threshold;
“– the lowest reporting threshold. »

    Definitions:

    The terms substances and mixtures are defined in section 2 of Regulation (EC) No 1272/2008 on the classification, labelling and packaging of substances and mixtures.
    In the case of products that are not covered by Regulation (EC) No 1272/2008, including wastes, and that are nevertheless present or likely to be present in an establishment and that present or are likely to present, under the conditions prevailing in the establishment, equivalent properties in respect of their major accident potential, such products shall be assigned to the classes, categories and hazard statements closest to or the substance or substance or substance closest They are considered hazardous substances or mixtures within the meaning of this section.

    Explosive substances, mixtures or substances with an explosion hazard determined by method A. 14 of Regulation (EC) No. 440/2008, which do not fall within the class of organic peroxides or self-reactive substances and mixtures, as well as articles containing such substances, mixtures or substances under section 2.1 of Schedule I to Regulation (EC) No. 1272/2008.     Classification:
    (a) Substances:
    Classes and hazard categories are defined in Appendix I, Parts 2,3 and 4, of Regulation (EC) No 1272/2008 relating to the classification, labelling and packaging of substances and mixtures.

    Substances with these hazards, but not yet listed in Schedule VI to Regulation (EC) No. 1272/2008, referred to above, are classified and labelled by their manufacturers, distributors or importers based on information on their existing physico-chemical or toxicological properties.

    (b) Mixtures:
    The classification of hazardous mixtures results from:
    - the classification of the hazardous substances they contain and the concentration of them;
    - the type of mixture.

    Hazardous mixtures are classified according to Regulation (EC) No 440/2008 establishing test methods, as specified in Article 13, paragraph 3, of Regulation (EC) No 1907/2006 concerning the registration, evaluation and authorization of chemical substances and the restrictions applicable to such substances.

    Mixtures are assimilated to pure substances provided that the concentration limits fixed according to their properties in Regulation (EC) No 1272/2008, or its last adaptation to technical progress, unless a composition of the percentage or other description is specifically given
