Order dated 4 February 2014 extending d ' an agreement entered into under the National Collective Agreement for Footwear Retailers (point 733)

The Minister of Labour, Employment, Vocational Training and Social dialogue,
Seen job code, including its article L. 2261-15;
In view of the order of 16 July 1981 and the successive orders extending the collective agreement National Footwear Retailers of 27 June 1973 and the texts which have been completed or amended;
Having regard to the agreement of 10 June 2013 on vocational training, concluded in the framework of the aforementioned national collective agreement;
Vu Request for extension submitted by the organizations Signatories;
In view of the opinion published in the Official Journal of 5 December 2013;
In view of the opinions gathered during the investigation;
In view of the reasoned opinion of the National Commission for Collective Bargaining (Sub-Committee on Conventions and Agreements), delivered at the session on January 28, 2014,

Are made mandatory for all employers and employees included in the scope of the national collective agreement of retailers in Shoes of 27 June 1973, the provisions of the agreement of 10 June 2013 on vocational training concluded in the framework of the aforementioned national collective agreement.
Section 3.2 is extended subject to the application of the provisions of R. 6332-7 of the Labour Code. The
paragraph of Article 4.1 shall be extended subject to the application of the provisions of R. 6332-16 of the Whichthe terms of reference of the Board of Directors of the OPCA and the conditions for the establishment and operation of the professional joint sections.
The terms: " The designated OPCA ", in the first indent of the second subparagraph of the third paragraph of Article 4.2, shall be excluded from the extension in the light of 5 ° of article L. 6332-7 of the labor code and the approval order of November 29, 2012, of AGEFOS PME.
The third paragraph of Article 4.3 is extended subject to the decree of 11 December 2012 fixing the percentage of repayment to the Joint Trust Fund for professional courses, taken in accordance with the Href=" /viewCodeArticle.do?cidTexte=LEGITEXT000006072050&idArticle=LEGIARTI000006904361&dateTexte= &categorieLien=cid"> 1 ° and 2 ° of article L. 6332-19 of the job code.
The fourth paragraph of Article 6 is extended subject to the application of the provisions of L. 6323-2 of the
second paragraph of Article 15 is extended subject to the combined application of the provisions of Articles L. 2261-7 and L. 2232-16 of the Labour Code as interpreted by the case-law of the Court of Cassation (Cass. Soc, 26 March 2002, No. 00-17.231).

Article 2


The extension of the effects and sanctions of the above agreement shall take effect from the date of publication of this Order for the remainder of the term and the conditions laid down by the said Agreement.

The Director General of Labour is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
