Decree of 7 January 2014 on the Central Council of Social Action

The mission of the Central Council of Social Action is to involve representatives of military and civilian personnel as the main authorities of the Ministry of Defence in the development of the Ministry's social policy.

The Central Council of Social Action is deliberating the policy of social action of the Ministry of Defence.
It is associated with the development of the annual budget of the Ministry's social action programs and the draft texts on social action.
He gives his opinion on:
- the annual budget of the department's social action programs;
- the draft texts on social action;
- the multi-year draft convention on the objectives of the social management institution of the armies concluded with the Ministry of Defence;
- the performance reports of these multi-year conventions;
- the reporting of the forecasting statements of the revenues and expenses of the social management institution of the armies.
He is informed of the assessment of the actions and studies carried out by the administration on issues related to the field of social action.
He proposes themes under consideration by social committees.
It designates within it the representative of the military personnel and his deputy, as well as the representative of the civilian staff and his deputy from the trade union organization having obtained the largest number of votes in the last elections to the social committees to sit on the board of the social management institution of the armies.

The Central Council of Social Action is composed as follows:
The minister or his representative, president, who does not vote.
Members with a deliberate vote:
23 representatives of the military personnel of the Ministry of Defence;
9 representatives of the military personnel of the gendarmerie;
8 civilian personnel from the Ministry of Defence.
The opinion of the legislative members is collected by a majority of votes.
Members with an advisory vote including:
(a) The following authorities or their representatives:
the Chief of Staff of the Armed Forces;
the General Delegate for Arming;
- the Chief of Staff of the Army of Land;
the Chief of the Navy Staff;
- the Chief of Staff of the Air Force;
the Director General of the National Gendarmerie;
the Director of Human Resources of the Ministry of Defence;
the Central Director of the Armed Health Service;
- the civil defence inspector involved in the social action of the armies;
the director of the National Military Social Security Fund;
the Director General of the Social Management Institution of the Armed Forces;
– the Deputy Director of Social Action of the Human Resources Directorate of the Ministry of Defence.
(b) A representative of retired military personnel appointed by the Permanent Council of Military Retirees, a representative of retired civilians appointed by the trade union organization having obtained the largest number of votes in the last elections to the social committees and a representative of the defence mutuals designated by the Mutualité Défense association among its directors. These three representatives are designated for a renewable four-year period.
In addition, the President may be assisted, depending on the nature of the issues on the agenda, by qualified personalities or experts.
The general control of the armies can be represented at the meetings of the Central Council of Social Action.

The agenda of the sessions is set by the President of the Central Council of Social Action.
Issues that have been requested by a majority of the members who have a deliberate vote are on the agenda.
A summary of the deliberations of the Central Council of Social Action is provided to the members of the Council, to the Secretary General of the Higher Council of the Military Service, to the heads of the ministerial social action centres, to the chiefs of the joint social levels and to the local directors of the gendarmerie's social action.
A statement is issued after each session of the Central Council for Social Action.

Military personnel representatives are elected, for a renewable four-year period, from the military members who hold the metropolis social committees and the French forces and the civilian elements stationed in Germany, as follows:
6 officers, elected by the officers of the Social Committees;
16 non-commissioned representatives, elected by the non-commissioned members of the social committees;
10 military representatives of the rank, elected by members of the ranks of the social committees.
They are divided as follows:
- for the army of land: 2 officers, 4 non-commissioned representatives, 7 military representatives of the rank;
- for the navy: 1 officer representative, 2 non-commissioned representatives, 1 military representative of the rank;
- for the Air Force: 1 officer representative, 2 non-commissioned representatives, 1 military representative of the rank;
― for branches and services: 1 officer representative, 1 non-commissioned representative;
- for the gendarmerie: 1 officer representative, 7 non-commissioned representatives, 1 military representative of the rank.
As part of the discussions conducted in working groups, members of the Central Council of Social Action may invite and consult with any competent person on the subjects treated.

The eight representatives of civilian personnel must be mandatory members of the social committees.
They are designated, for a period of four years renewable, by the trade union organizations of the Ministry of Defence prorated their vote in the elections of the social committees and according to the rules of proportional representation and the highest average. For the purposes of this provision, as for the counting of votes, the grouping of federations is permitted.

At the same time as representatives of military personnel and representatives of civilian personnel, are elected or appointed from the same categories of personnel and under the conditions provided for in Articles 5 and 6, alternate members who sit on the Central Council of Social Action in the event of absence or incapacity of the incumbent members.
If a member ceases to report to the Ministry of Defence, resigns his or her term of office or no longer belongs to the category of staff for which he or she has been elected or appointed, an alternate shall succeed him or her in full right for the remainder of his or her term.
Members of the Central Council of Social Action, holders and alternates, receive specific training at the beginning of their term for the performance of their duties.

The Central Council of Social Action meets at least once a semester and can only validly deliberate if at least half of all its members with a deliberate vote are present.
He may be convened in a special meeting at the initiative of his president.
Restricted technical meetings can be held at the initiative of the Human Resources Directorate of the Ministry of Defence (professional support and pension services, sub-direction of social action) for the preparation of the Central Council of Social Action.

The authorities of which the members of the Central Council of Social Action are responsible are obliged to grant them all facilities to carry out their mission.
Freedom of expression is guaranteed within the board. Participants are held at a discretionary obligation with respect to the views expressed at the meeting.

Members of the Central Council of Social Action may, if they consider that a decision of any kind concerning them has been inspired by their behaviour on the occasion of their duties, refer directly to the Minister of Defence within one month of notification of that decision.
The exercise of this remedy shall be maintained for the benefit of the persons concerned for a period of two years from the termination of the said functions.
No assessment of the behaviour of active personnel as a member of the Central Council of Social Action shall be included in the notes and records of the persons concerned.

The procedures for the application of the provisions relating to the representation of military personnel and civilian personnel shall be determined by ministerial instruction.

The decision on the Central Council for Social Action of 15 January 2002 is repealed.

The Chief of Staff of the Armed Forces, the Delegate General for Arming, the Secretary General for Administration, the Chief of Staff of the Army, the Chief of Staff of the Navy, the Chief of Staff of the Air Force, the Director General of the National Gendarmerie and the Director of Human Resources of the Ministry of Defence are responsible, each with regard to the Journal, for the execution of the official execution of the National Gendarmerie.
