Order of December 20, 2013 on Decision V.1.2013 concluded as part of the Inter-Professional Committee of Champagne Wine on the reserve of part of the harvest 2013 and on the exit of the reserve during the 2013-2014 campaign

Having regard to Article 113 quater of Regulation (EC) No 1234/2007 (amended) of the Council of 22 October 2007 concerning the joint organization of markets in the agricultural sector and specific provisions concerning certain products of that sector;
Considering the law of 12 April 1941 validated establishing an interprofessional committee of Champagne wine;
Vu le Decree No. 2007-103 of 25 January 2007 concerning the organization and operation of the interprofessional committee of Champagne wine;
Vu le Decree No. 2010-1441 of 22 November 2010 relative to the controlled label of origin “Champagne” modified;
In view of the deliberation of the executive office of the Inter-Professional Committee on Champagne Wine of 22 July 2013,
Stop:

Article 1


The provisions of Decision V.1.2013, annexed to this Order, taken by the Inter-Professional Committee of Champagne Wine on July 22, 2013, relating to the reserving of part of the 2013 harvest and the exit of the reserve during the 2013–14 campaign, are approved and made mandatory for harvesters, cooperatives and traders installed in delimited wine Champagne.

Article 2


The Director General of Competition, Consumption and Suppression of Frauds, the Director General of Agricultural, Agri-Food and Territories Policy, and the Director General of Customs and Indirect Rights are responsible, each with respect to it, for the execution of this Order, to be published in the Official Journal of the French Republic.

    DECISION V.1.2013 RELATING TO THE IMPLEMENTATION FROM A PART OF THE 2013 RECOLATE AND THE SORTIA OF THE BOOK ON THE CAMPAGNE COURS 2013-14
    The Interprofessional Committee of Champagne Wine,
    Having regard to the amended Act of 12 April 1941 establishing the Interprofessional Committee of Champagne Wine;
    Vu le Decree No. 2007-103 of 25 January 2007 concerning the organization and operation of the interprofessional committee of Champagne wine;
    Having regard to Article 113 quater of Council Regulation (EC) No. 1234/2007 of 22 October 2007 as amended, establishing common market arrangements in the agricultural sector and specific provisions concerning certain products of that sector;
    Vu le Decree No. 2010-1441 of 22 November 2010 modified relative to the controlled label of origin « Champagne » ;
    Considering decision n° 169 of 13 June 2007 modified relative to the individual reserve of wines claimed in controlled label of origin “Champagne”;
    In light of the amended decision No. 172 of 20 May 2008 on improving market operations (from the 2008-2009 campaign to the 2013-2014 campaign);
    Considering decision n° 179 of 7 July 2011 relating to the reserve of basic wines intended for the elaboration of the wines likely to benefit from the controlled label of origin " Champagne";
    Considering decision No. 180 of 7 July 2011 amended relative to the operation during the transitional period of the reserve of basic wines intended for the elaboration of the wines likely to benefit from the controlled label of origin “Champagne”;
    In view of the decisions V.2.2000 of 4 September 2000 relating to the placing in the qualitative reserve of a part of the harvest 2000, V.5.2002 of 3 September 2002 relating to the placing in the qualitative reserve of a part of the harvest 2002 claimed in the appellation of origin controlled " Champagne", V.2.
    In view of the deliberation of the Executive Office of 22 July 2013,
    Decides:


    Article 1
    Reserved


    The marketable volume of the 2013 harvest is set at 10,000 kilograms of grapes per hectare of surface in production.
    The quantities harvested beyond this volume are subject to the limit, on the one hand, of the authorized maximum annual yield and, on the other, of the reserve ceiling.


    Article 2
    Exit of reserve


    A portion of the quantities on reserve after harvesting 2000, 2002, 2004, 2005, 2007, 2008, 2009, 2010, 2011, 2012 and 2013, pursuant to decisions V.2.2000, V.5.2002, V.2.2004, V.2.2005, V.2.2007, V.2.2008, V.1.2009, V.1.2010, V.1.2012 referred to above and this decision, has been released under the following conditions.
    1. The output applies to a quantity of 500 kilograms of grapes per hectare of surface in production, during the harvest 2013, of each harvester concerned.
    2. If the reserves from harvests 2000, 2002, 2004, 2005, 2007, 2008, 2009 and 2010 as at 1 July 2013 are more than 6,000 kilograms of grapes per hectare, the output covers 8.5 per cent of the quantities concerned.
    3. The output applies, as appropriate and successively, to the quantities from harvest 2000, and to harvests 2002, 2004, 2005, 2008, 2010, 2011, 2012 and 2013.
    4. The output shall apply, in a proportional manner, and in any place of storage (in the recolant, cooperative and/or collectively among one or more merchant-manipulants), both to the quantities subject to a contractual obligation of sale and to other quantities.


    Article 3
    Recipients of the exit


    All natural or legal persons who have quantities in reserve at the date of effect of the release are subject to the release.


    Article 4
    Output effect date


    The effective date of the release is 1 February 2014.


    Article 5
    Output consequences


    1. The quantities referred to in Article 2 above that are subject to a contractual obligation to sell and purchase must be subject, from the date set out in Article 4 above, to transactions, in accordance with and in accordance with contracts entered into between sellers and buyers.
    2. The quantities covered by the output provided for in Article 2 above that are not subject to a contractual obligation of sale may result in transactions on the market of the clear wines of the 2013-2014 campaign.
    3. The quantities that have been released from the reserve may be drawn in bottles from the date set out in section 4 above.


    Article 6
    Application methods


    The terms and conditions of application of this decision are defined in one or more circulars.


    Article 7
    Penalties for failure


    In the event of a breach of the mandatory provisions of this decision, and without prejudice to the other sanctions provided for in the existing legislative and regulatory provisions, the penalties provided for by the law of 12 April 1941 referred to above may be applied to any offender.
