Judgment of 16 December 2013 setting out the nature of the tests and the general organisation rules of the contest reserved for access to the body of technical directors of the prison administration

The Guard of Seals, Minister of Justice, and Minister of State Reform, Decentralization and Public Service,
Vu la Act No. 83-634 of 13 July 1983 amendments to the rights and obligations of civil servants, together with Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State;
Vu la Act No. 2012-347 of 12 March 2012 relating to the access to and improvement of the conditions of employment of contractual agents in the public service, the fight against discrimination and various provisions relating to the public service, including Articles 5 and 7;
Vu le Decree No. 99-669 of 2 August 1999 amended with special status of technical staff of the deconcentrated services of the prison administration;
Vu le Decree No. 2002-766 of 3 May 2002 on the terms and conditions of designation, by the administration, in the public service of the State of the members of the jury and the selection committees and its representatives in the advisory bodies;
Vu le Decree No. 2004-1105 of 19 October 2004 concerning the opening of recruitment procedures in the state public service;
Vu le Decree No. 2012-631 of 3 May 2012 relating to the eligibility conditions of candidates for recruitments reserved for access to the bodies of officials of the State of categories A, B and C and setting the general conditions for the organization of these recruitments in accordance with the Act No. 2012-347 of 12 March 2012 relating to access to full employment and the improvement of the conditions of employment of contractual agents in the public service, the fight against discrimination and various provisions relating to the public service;
Vu le Decree No. 2013-908 of 10 October 2013 relating to the appointment of members of the jury and the selection committees for the recruitment and promotion of public officials in the public service of the State, the territorial public service and the public hospital service;
Vu le Decree No. 2013-966 of 28 October 2013 relating to the opening of the reserved recruitments for access to the bodies of officials of the State of categories A, B and C under the Ministry of Justice;
In view of the Order of 30 May 2008 setting out the list of specialties for which the recruitment of technical director of the prison administration is opened;

In accordance with the table annexed to the above-mentioned Decree of 28 October 2013, the reserved competition of technical directors of the penitentiary administration is organized according to the provisions of this Order.

The reserved competition of technical directors of the penitentiary administration is open in one or more of the specialties provided by the aforementioned Order of 30 May 2008.

When the reserved competition of the technical directors of the prison administration is opened in more than one specialty, the candidate chooses at the time of registration the speciality in which he wishes to present himself.

The reserved competition of the technical directors of the prison administration includes an eligibility test and an oral admission test based on the recognition of the acquired professional experience.

The eligibility test consists of a case study or a technical record (duration: four hours, coefficient 2).
At the end of the eligibility test, the jury sets out, in alphabetical order, the list of candidates authorized to take part in the oral admission test.

For the oral examination of admission, the candidate establishes a record of recognition of the achievements of his or her professional experience that he or she submits to the recruitment office at a date fixed in the opening of the reserved competition.
The record of recognition of the achievements of the professional experience as well as the filling guide are available on the website of the Ministry of Justice, in accordance with the attached schedule.

The oral admission test consists of an interview allowing the recognition of the achievements of the professional experience of a maximum of thirty minutes, of which ten minutes at the most exposed of the coefficient 4.
This interview with the jury aims to assess the candidate's personality, abilities and motivation and abilities to perform the duties normally assigned to a technical director. To conduct this interview, which has as its starting point a candidate's presentation on his career path, the technical achievements and the work done during his career, the jury has the file formed by the candidate for recognition of the achievements of the professional experience.
This presentation is followed by a discussion with the jury to assess professional skills and technical knowledge in the candidate's specialty.
During this interview, the candidate is, if any, interrogated on issues related to the prison institution and its professional environment.

A rating of 0 to 20 is assigned to each test. Any grade less than 7/20 at the oral admission test is eliminated.

At the end of the oral admission test, the jury shall establish, in order of merit, the list of qualified candidates and a supplementary list established in the same order.
Only candidates who have obtained a number of points fixed by the jury for all the tests can be listed on this list, which cannot, after applying the coefficients, be less than 60 points or include no elimatory notes.

The jury, composed of at least four members of category A, is appointed by order of the Seal Guard, Minister of Justice. Its members are:
– the director of the prison administration or his representative, president;
- three category A officials from the prison administration.

The guard of the seals, the Minister of Justice, and the Minister of State Reform, Decentralization and Public Service are responsible, each with regard to it, for the execution of this order, which will be published in the Official Journal of the French Republic.

    CONSTITUTION OF RECOGNIZATION
    (*)

    The model of the record of recognition of the achievements of the professional experience is that set out in Circular B10 No. 2135 of 30 March 2007 concerning the implementation of the system of recognition of the achievements of the professional experience.
    For the preparation of the file under Article 6 of this Order, candidates may use the following human resources management tools:
    1. The interdepartmental repertoire of State trades (RIME), on the Internet: http://www.fonction-publique.gouv.fr
    2. The job repository of the department concerned, on the internet.
