Order of December 16, 2013 organizing the training of supervisors of the supervisory and enforcement body of the interns prison administration from the reserved professional examination

Vu la Act No. 83-634 of 13 July 1983 amendments to the rights and obligations of civil servants, together with Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State;
Vu la Act No. 2012-347 of 12 March 2012 relating to access to full employment and the improvement of the conditions of employment of contractual agents in the public service, the fight against discrimination and various provisions relating to the public service;
Vu le Decree No. 66-874 of 21 November 1966 a regulation of public administration relating to the special status of officials of the decented services of the prison administration;
Vu le Decree No. 94-874 of 7 October 1994 Amending the common provisions applicable to trainees of the State and its public institutions;
Vu le Decree No. 2000-1328 of 26 December 2000 the National School of Prison Administration;
Vu le Decree No. 2006-441 of 14 April 2006 having a special status of the bodies of the surveillance staff of the prison administration;
Vu le Decree No. 2007-1470 of 15 October 2007 modified on vocational training throughout the life of state officials;
Vu le Decree No. 2012-631 of 3 May 2012 amended on the eligibility conditions of candidates for recruitments reserved for access to the bodies of officials of the State of categories A, B and C and setting the general conditions for the organization of these recruitments in accordance with the Act No. 2012-347 of 12 March 2012 relating to access to full employment and the improvement of the conditions of employment of contractual agents in the public service, the fight against discrimination and various provisions relating to the public service;
Vu le Decree No. 2013-966 of 28 October 2013 relating to the opening of the reserved recruitments for access to the bodies of officials of the State of categories A, B and C under the Ministry of Justice;
In view of the decree of December 16, 2013, setting out the nature of the trial and the rules of organisation of the professionalized examination reserved for access to the rank of supervisors of the body of supervision and application of the prison administration;

This training is intended to prepare trainees for the performance of their duties in relation to their assignment position. It must enable them to develop the skills necessary for the execution of missions as specified in thearticle 3 of the decree of 14 April 2006 referred to above.
The content, the general organization and the terms and conditions for the evaluation of this training are set out in a detailed notebook validated by the director of the prison administration.

Vocational training, for a period of twelve months, referred to inarticle 2 of the decree of 28 October 2013 referred to aboveconsists of two periods:
– a first period of training in alternating two months of theoretical teachings and practical internships;
– a second ten-month period on the post.
The determination of the different places of practical internships of the first period is determined by the director of the National School of Prison Administration.

The professional fitness of trainees supervisors is appreciated by a professional fitness committee whose members are appointed by Seal Guard Order, Minister of Justice. It is composed as follows:
– the Deputy Director of Human Resources and Social Relations or his representative, President;
– the director of the National School of Prison Administration or his representative;
a member of the body of the directors of the prison services;
- a member of the command body;
– a member of the frame and application body with at least the rank of first monitor.
In the event of a vote-sharing, the president's vote is preponderant.

Consideration is given to the evaluation of the trainee's professional fitness:
– the notes obtained in the multi-choice questionnaire test, during the first training period on theoretical lessons;
― the assessment of the practical internship(s) of the first period as provided in the specifications above;
―the appreciation made by the head of the intern's reception service on the future post.

The Fitness to Practise Commission sets out the list of trainees capable of being titularized. Following the advice of the competent administrative commission, the director of the prison administration shall decide on the titularization, possibly on the extension of the internship which may not exceed one year, or, if any, on the termination of the intern supervisor.

The guard of the seals, the Minister of Justice, and the Minister of State Reform, Decentralization and Public Service are responsible, each with regard to it, for the execution of this order, which will be published in the Official Journal of the French Republic.
