Notice: This decree specifies the nature of the missions carried out by officials under this body. Technicians performing operational tasks related to safety in the technical services of the operational air navigation centres, particularly in the areas of energy and air conditioning, will now be required to hold a licence for maintenance and technical monitoring personnel of air navigation systems. Only licensees of a monitoring licence will be able to carry out monitoring and surveillance missions. In addition, the modalities for organizing the TSEEAC training are modified. This includes the implementation of a third year of initial training. Finally, the grade of an exceptional class technician will now have seven ladders instead of five.

Vu la Act No. 83-634 of 13 July 1983 amendments to the rights and obligations of civil servants, together with Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State;
Vu le Decree No. 93-622 of 27 March 1993 amended on the specific status of the corps of the superior technicians of the studies and the operation of civil aviation;
Considering the advice of the ministerial technical committee of the Ministry of Ecology, Sustainable Development and Energy of 16 May 2013;
The State Council (Section of Administration) heard,
Decrete:
Article 2 of the above-mentioned Decree of 27 March 1993 is amended as follows:
1° I is replaced by the following:
"I. ― The senior technicians of civil aviation studies and operations have a mandate to perform, under the authority of the chief of service they are responsible for, in the areas of supervision, study, operation, implementation of computer, education and teaching.
"They ensure, in particular, the control of air traffic on certain aerodromes; develop and disseminate aviation information and air traffic procedures and ensure their implementation; they exercise technical control over the operation of public air transport and the monitoring of air carriers.
"They also provide for the control of general aviation, aviation and aeronautical training, the development and deployment of computer means, the maintenance or operation of electrical and electronic equipment, the organization of logistics services, the certification and registration of aerodromes, the control of fire safety services, as well as air navigation service providers and, in part, flight and flight information services
"In addition to the services and facilities of the General Directorate of Civil Aviation, senior technicians of civil aviation studies and operations may perform their duties in the Meteorological-France public establishment or the Office of Investigations and Analysis for Civil Aviation Safety. » ;
2° In II, the words: "Decree of November 8, 1990 referred to above" are replaced by the words: " Decree No. 90-998 of 8 November 1990 bearing the status of the body of the air navigation control engineers";
3° The III is replaced by the following:
"III. ― To carry out operational tasks related to safety in the technical services of the operational centres of air navigation, in particular in the areas of energy and air conditioning, the superior technicians of the studies and operation of civil aviation must be licensed to the maintenance and technical monitoring personnel of the air navigation systems meeting the requirements mentioned in the second paragraph of section R. 135-9 of the Civil Aviation Code and issued in the terms and conditions
"The senior technicians of the studies and operations of civil aviation who hold a licence for maintenance and technical monitoring personnel of the air navigation systems performing functions, the maintenance of which involves the performance of operational tasks related to safety in the technical services of the operational centres of air navigation, are undergoing mandatory continuing training. These functions and the terms and conditions of this training are defined by decree of the Minister for Civil Aviation. » ;
4° In IV, the second, third and fourth paragraphs are replaced by the following two paragraphs:
« 1° From the traffic management service of the Paris-Charles-de-Gaulle airfield;
« 2° From the flight information service of the centres on the way to air navigation. » ;
5° The V is replaced by the following:
"V. ― The senior technicians of civil aviation studies and operations participate in the proper functioning of the integrated management system of air traffic control bodies, the conduct of aviation safety studies and air space, as well as the functions related to the integration of the environment. » ;
6° After the V, a VI is added as follows:
"VI. ― Within the body of the senior technicians of the studies and operation of civil aviation, only holders of a valid monitoring licence, issued under the conditions fixed by a decree of the Minister for Civil Aviation, may carry out monitoring and surveillance missions. »
Article 3 of the same decree is replaced by the following provisions:
"Art. 3.-In addition to the pupil level and the two interns level, the corps of senior technicians of civil aviation studies and operations includes the grades of a standard-class technician with ten ladders, a senior-class technician with eight ladders and an exceptional-class technician with seven ladders. »
Article 4 of the same decree is amended as follows:
1° At the 1st, after the word: "holders", it is inserted the words: ", on October 1 of the year of the contest",
2° 2° is supplemented by a sentence thus written: "This contest is also open to candidates justifying four years of service to an administration, organization or institution mentioned in the third paragraph of 2° of Article 19 of the law of 11 January 1984 referred to above, under the conditions set out in this paragraph. »
In Article 5 of the same decree, the word "impaired" is replaced by the word "open".
In the first paragraph of Article 7 of the Decree, the word "five" is replaced by the word "seven".
Article 8 of the same decree is amended as follows:
1° At the beginning of section 8, the following paragraph shall be inserted:
"The training and internship conditions are as follows:"
2° The 1° is replaced by the following:
« 1° Applicants received at one of the competitions scheduled for 1° and 2° of section 4 are appointed senior technical students of civil aviation studies and operations by order of the Minister for Civil Aviation and receive the treatment for the student level.
"They are called upon to undergo an initial three-year training at the National Civil Aviation School and in the Civil Aviation Branch, the terms of which are set by joint order of the Minister for Civil Aviation and the Minister for Public Service.
"By derogation from the preceding paragraph, candidates admitted to one of the competitions provided for in 1° and 2° of section 4, which warrant the validation of a year of higher education in the scientific and technical fields and who have obtained a minimum rating of the aeronautical knowledge test under the conditions defined by joint decree of the Minister for Civil Aviation and the Minister for Public Service Studies, are appointed senior technicians of the trainee
"Students admitted in the second year of training are appointed senior technicians trainees in civil aviation studies and operations and receive the treatment for the first step of trainee.
"The senior trainees admitted in the third year of training receive the treatment for the second step of trainee.
"On an exceptional basis, they may be allowed to complete an additional tuition or internship for up to one year. This additional year is sanctioned under the same conditions as a normal year of training and is not taken into account in calculating the seniority to be retained for advancement.
"During the duration of additional schooling or internship, senior technicians in the studies and civil aviation operations maintain the quality of a student or trainee and receive the treatment for the level corresponding to their situation.
"At the end of their initial training, senior technicians trainees are either registered under the conditions set out in section 9 below, either terminated or reintegrated into their bodies, employment framework or original employment for those who already had the quality of public servants. » ;
3° The 2° is replaced by the following:
« 2° The senior technicians of civil aviation studies and operations recruited through reserved jobs as well as those recruited under Article L. 4139-2 of the Defence Code are undergoing training during the year of their training for part in the National Civil Aviation School and for part in civil aviation services. The terms of the course are determined by joint order of the Minister for Civil Aviation and the Minister for Public Service;
"The contracting officers recruited under section 27 of the above-mentioned Act of 11 January 1984 are trained three years at the National Civil Aviation School. The terms and conditions of the training are determined by joint order of the Minister for Civil Aviation and the Minister for Public Service. » ;
4° The 3° is amended as follows:
(a) The first paragraph is supplemented by a sentence as follows: "They receive the treatment for the second step of trainee. » ;
(b) In the second paragraph, the words "by order of the Minister for Civil Aviation" are replaced by the words "by joint order of the Minister for Civil Aviation and the Minister for Public Service";
5° In the second paragraph of the 5th, the words "by order of the Minister for Civil Aviation" are replaced by the words "by joint order of the Minister for Civil Aviation and the Minister for Public Service".
The table in section 9 of the same decree is replaced by the following table:

Article 9-4 of the same decree is amended as follows:
After the words: "Article L. 63 of the National Service Code", the words are inserted: "as well as the actual time spent on civic service or international volunteering, pursuant to articles L. 120-33 or L. 122-16 of the same code".
It is added to article 11 of the same decree a paragraph as follows:
"For the superior technicians of the studies and operation of civil aviation recruited under section 27 of the above-mentioned Act of 11 January 1984, the service seniority required in the first paragraph of this section is five years from the date of their registration in the body. »

For the purposes of the provisions of the second paragraph of section R. 135-9 of the Civil Aviation Code, the senior technicians of the Civil Aviation Studies and Operations who hold, at the date of entry into force of this Order, the certificate of suitability for technical maintenance shall, from that date, be deemed holders of the licence of maintenance and technical monitoring personnel of the air navigation systems referred to in the above-mentioned Air Navigationarticle 2 of the decree of 27 March 1993 referred to above in its writing from Article 1 of this Decree. This license is issued to them by law.
On the date of entry into force of this decree, the senior technicians of the studies and operation of civil aviation are reclassified in accordance with the following correspondence table:

On the date of entry into force of this decree, students and interns recruited by means of one of the competitions provided for in the 1st and 1st 2° of Article 4 of the decree of 27 March 1993 referred to above as well as the contracting officers recruited under section 27 of the above-mentioned Act of 11 January 1984 are trained at the National Civil Aviation School for a period of three years.
Students and senior technical trainees of studies and the operation of civil aviation recruited through one of the competitions referred to in the previous paragraph and being trained at the National Civil Aviation School at the date of entry into force of this Order are classified in accordance with the table in section 14 above. They are titularized during their third year of training, scheduled for 1° of Article 8 of the decree of 27 March 1993 referred to above in its writing from this decree, provided that the total duration of their pre-registration training does not exceed three years. If not, they are either terminated or reintegrated into their body, employment or employment of origin.
In their third year of training, they are paid on the basis of the index for the 2nd step of trainee for one year, and are classified at the 1st step of the rank of senior technician in the studies and operation of normal-class civil aviation, subject to the provisions of thearticle 9 of the decree of 27 March 1993 referred to above, for agents who already had the status of public servant or agent.
