Decision n ° 2013-698 of 25 September 2013 authorizing the SAS France Multiplex to use a radio resource for the multiplexing of the programmes of radio services publishers by terrestrial terrestrial radio in digital mode at Nice

Decides:

Item 1


France Multiplex is authorized as a multiplex operator responsible for ensuring operations Techniques necessary for the transmission and distribution to the public, by terrestrial terrestrial in digital mode, of the radio programs called Clin d' oeil FM 106.1, Frequency K, RCF Nice Côte d' Azur, Radio Chalom Nitsan, Nice Radio, Alta Frequenza, Radio Soleil, AYP FM and LCF La Chine en français dans la zone de Nice.
The company France Multiplex is authorized to use the resource referred to in Annex I.
It will be assigned to the company by subsequent decisions of the board, taken after approval of the emission sites and technical characteristics Relating to the altitude of the transmitting antennas, the apparent maximum radiated powers (PAR) and the antenna diagrams in the conditions set out in Annex II to this authorisation.
France Multiplexest Provide this information within three months of the start date of the Which shall be fixed by the Council pursuant to Article 2 of this Decision.

Article 2


The duration of the authorisation shall be ten Years from the date of commencement of the publishers' programs, which will be determined by the Board at least six months in advance. If, within a period of three months from that date, the company has not provided the technical operations referred to in Article 1, the Council may declare the authorisation lapsed.
As from the effective start date of the programmes, the company shall France Multiplex shall carry out the technical operations referred to in the first subparagraph of Article 1 of this Decision in accordance with the timetable set out in Annex II. The company shall ensure that the broadcasting of the authorised services referred to in Article 1 allows for a good reception by the public on the coverage area of the emission sites.

Article 3


The radio resource is shared by several audiovisual communication services. The amount of useful radio resource allocated to each authorized service on the multiplex is set in the Board's deliberation of January 15, 2013. It is intended to transmit the necessary binary flows to the sound components of each program, the associated data, the service information (electronic program guide) and the download or update flows of the Reception terminals, excluding any other use.

Article 4


The use of the radio resource is subject to compliance with the Technical conditions defined by the Board. It must comply with the rules for the use of the resource set out in Annex III.
The characteristics of the signals issued by the France Multiplex company are in accordance with the regulations in force as well as the Services and signal profile for the broadcasting of digital terrestrial radio ".
The broadcasting standard referred to in Article 2 of the amended Order of 3 January 2008 shall be implemented with the technical characteristics of dissemination defined in Annex III.
The company France Multiplex informs the board of the technical conditions of transport and multiplexing retained and of the measures taken to ensure the interoperability of reception systems.
Use of the resource Radioelectric by service editors is performed under conditions Fair, reasonable and non-discriminatory, including in the case of changes to the services authorized on channel 9D in the Nice area.
For this purpose, the France Multiplex company shall provide the Council, on or before the start date of the Emissions referred to in Article 2 of this Decision, the means envisaged to ensure fair, reasonable and non-discriminatory use of the radio resource between the service publishers.

Item 5


The company France Multiplex is required to provide the Board with the following information, which it will certify:
Information communicated within one month after the commissioning:
-a comprehensive report of Completion of isofrequency plate synchronization parameters.
Information provided without delay if available:
-measured radiation diagram;
-frequency offset in place;
-the modulation parameters used.
This information is due upon express request from the board.

Article 6


In the event that the following information is subsequently modified, the Recipient shall provide the Board with an updated version within three months of the date of the Requested change date:
-installation technical description (type and rated power of the transmitter, antenna system ...);
-theoretical radiation diagram in horizontal and vertical planes;
-frequency offset;
-parameters of Modulation;
-isofrequency plate synchronization settings.

The France Multiplex company informs the board of all An amendment to its capital on more than 10 % of the shares or Voting rights.

The authorisation may be withdrawn in the event of a substantial change in the conditions under which it was issued, in particular to the Joint application by authorized service publishers on channel 9D in the Nice area. In the event of withdrawal, the holder shall ensure the operations referred to in Article 1 up to its effective replacement by a new multiplex operator, in accordance with the procedure laid down in section 30-2 of Law No. 86-1067 of September 30, 1986 modified.

This decision will be notified to SAS France Multiplex and to Authorized publishers on channel 9D in the Nice area and published in the Official Journal of the French Republic.

    COVERAGE COMMITMENTS AND AGREMENTS OF THE SITES
    1. Allotment Coverage Commitment

    The multiplex operator agrees to respect the effective coverage rates of the allotment referred to in Annex I within the following time limits:
    -at the start of the emissions: at least 20 % of the population included in the allotment;
    -after three years: at least 40 % of the population included in the allotment;
    -after five years: at least 80 % of the allotment population.

    2. Site Approval

    The Multiplex Operator provides the Board with the technical description of the proposed site network to cover the selected allotment as well as the percentages of coverage within buildings and an estimate Mobility coverage. It also provides for each transmitter the technical information sheets and COMSIS including a transmitter positioning card, as well as the diagram and the antenna height and the maximum PAR.
    The multiplex operator must submit to The agreement of the council a list of sites to ensure the objective of coverage of the area concerned. With the exception of allotments subject to specific site locational constraints as described in Annex I, these emission sites shall not be located more than 10 km from the contour of the allotment. These locations must be within the boundaries of the French territory, with the exception of the foreign administrations concerned.
    The network of transmitters proposed by the multiplex operator should not generate a field beyond the scope of the Defined beyond the envelope associated with the allotment. The method of calculating the radio field is defined in the explanatory note.
    Multiplex operator ensures compatibility of the proposed network of transmitters with the existing international agreements for the use of band III (agreements Of Geneva 2006 and bilateral agreements). In the event of any incompatibility or discomfort at any time of the operation, the Board may either refuse the approval of the site or impose on the multiplex operator any technical modification necessary to remove or comply with International agreements. These changes can affect antenna height, radiation patterns, PAR, or emission sites.

    RESOURCE RULES
    1.
    1.1 technical parameters. Allotment

    An allotment is a geographic area bounded by a closed contour, associated with a channel (frequency) in band III and providing a defined level of service (see paragraph 1.2). It should be noted that the effective coverage of the allotment depends on the choice of sites proposed by the multiplex operator. The allotment contour represents the area of service for which the council guarantees protection against interference (subject to border coordination) for at least 90 % of the allotment population. A service can be received beyond this contour, but the board does not guarantee the protection of its reception by the auditors. Beyond the sixth year following the issuance of the multiplex operator's authorization, the Board shall protect against interference only in respect of areas in theory covered by the emission sites it has approved.
    In addition, Each allotment is associated with an envelope defining the RF field limit not to exceed: 54 dB µ V/m to 1.5 metres relative to the ground outside the buildings. The allotments and envelopes are available on the APF website ( www.csa.fr).

    1.2. Reference field levels and type of reception

    The level of service for digital radio is defined for a reception inside the buildings. This level also ensures a mobility reception within the allotment.
    The Board retains the following reference values to define the minimum median field levels for multiplex operators:

    The values in the table above correspond to levels within 1.5 metres of the floor outside buildings.

    1.3. Calculation Method

    Field levels are predicted by recommendation ITU-R P. 526-10 or ITU-R P. 1546-3, if applicable (e.g., land-sea motion).

    1.4. Allotment constraints

    The use of adjacent channels within a single allotment is subject to the implementation of a specific engineering that results in the submission of a report to the Board in order to avoid interference with Proximity to transmitters. As with any site authorizations, in the event that genes appear at any point in the operation, the board may impose any necessary technical modifications on the multiplex operators to remove them. These changes may relate to antenna height, radiation patterns, apparent radiated power (PAR) or emission sites.

    1.5. Release Signals

This document is approved by the Board at its January 15, 2013 plenary meeting and published on the same day on its website.
    The amendments to this document are subject to approval by the Board, after review by the Board Digital experts, then published.

    2. Notes

    The receipt threshold values will be periodically reviewed by the Board to take into account, in particular, the progress of the sensitivity terminals. These level measures may also be supplemented or replaced by parameter measures to account for the quality of the signal. As well, the recommendations will be reviewed to reflect the latest releases and developments
