Decree of 23 August 2013 on accessibility conditions for persons with reduced mobility of land-based motor vehicles of categories M1 and N1

Publics concerned: industrial or commercial enterprises, public or private, associations, local authorities, individuals.
Subject: equipment necessary for the accessibility of road vehicles of up to 9 places.
This order is taken under the application of theArticle 45 of Law No. 2005-102 of 11 February 2005 for equal rights and opportunities, participation and citizenship of persons with disabilities, codified in articles L. 1112-1 to L. 1112-8 of the Transport Code, and Directive 2007/46/EC on the reception of motor vehicles.
Commencement: This Order applies effective January 1, 2014, with the exception of the provisions of section 3 that apply to new vehicles registered as of July 1, 2014.
Notice: The purpose of this Order is to specify the accessibility rules of vehicles to wheelchair users (UFR) and other persons with reduced mobility (PMR). These rules vary according to the category and use of the vehicle. For public transport services, accessibility of vehicles is an obligation. The technical requirements are set out in item I of Article 3. For vehicles that provide carriage of persons not in the public service, there is no requirement for accessibility, however, where vehicles are accessible to wheelchair users, they must comply with the requirements set out in paragraph II or III, as the case may be, of Article 3.

Scope of application.
This Order concerns vehicles of categories M1 and N1 defined by theR. 311-1 road codeequipped to be accessible to persons with reduced mobility. The applicable technical requirements are defined in Article 3 of this Order according to the use and category of the vehicle within the meaning of road code.
Vehicles equipped to carry a wheelchair user are received in the category "specialized self-propelled vehicle" (VASP) and "HANDICAP" bodywork. The notice of receipt and the certificate of conformity of the vehicle mention the use(s) to which the vehicle is intended.

Definitions.
For the purpose of this Order, the following means:
Access to the reserved wheelchair location: the space between the wheelchair access door and the location reserved for it.
Rolling path: the device consisting of two separate and parallel inclined planes on which the wheelchair moves.
Boarding device: the device, such as an elevator or ramp, to facilitate wheelchair users' access to a vehicle.
Lift: any device or system equipped with a platform that can be raised or lowered to allow wheelchair users to access the passenger compartment from the ground and vice versa.
Ordered retractable walk: a walk that only energy other than muscle energy can operate and whose opening and closing, if not automatic, are controlled remotely by the driver or by the service door of type ordered.
Access passage: the free door opening space allowing the wheelchair user to enter and exit the vehicle.
Persons with reduced mobility: all persons with difficulties in using public transport, such as, for example, persons with disabilities (including persons with sensory and intellectual disabilities and wheelchairs), persons with disabilities of members, small persons, persons carrying heavy baggage, the elderly, pregnant women, persons with a trolley and persons with children (including children with a stroller).
Roll: the device consisting of an inclined plan to move from the floor of the passenger compartment to the ground and vice versa.
Public service for the carriage of persons: the public service for regular or transport at the request of persons within the meaning of sections L. 1221-1 to L. 1221-3 and L. 1241-1 to L. 1241-5 of the Transport Code, articles 25 to 31 of Decree No. 85-891 of 16 August 1985 and ofArticle 1 of Decree No. 59-157 of 7 January 1959 referred to above.
Aging system: the system that allows the vehicle to be fully or partially lowered and lifted relative to its normal position of operation.
Personal use: the use of a vehicle by a person for their own account.
Wheelchair User: The person who, because of a disability or disability, travels in a wheelchair.

Technical requirements.
I. - Requirements for vehicles providing a public service for the carriage of persons as defined in Article 2:
Category M1 vehicles conform to the provisions set out in Appendix 3 to Appendix XI to the above-mentioned Directive 2007/46/EC and to items 1 to 2-6 and 2-9 of the schedule to this Order.
Category N1 vehicles comply with the provisions of items 1, 2-1 to 2-10 of the schedule to this Order.
II. - Prescriptions for vehicles ensuring the carriage of persons not in the public service as defined in Article 2:
When accessible to wheelchair users, category M1 vehicles comply with the provisions set out in Appendix 3 to Schedule XI of the above-mentioned Directive 2007/46/EC and with items 2-1 to 2-6 and 2-9 of the schedule to this Order.
When accessible to wheelchair users, category N1 vehicles comply with the provisions of item 2 of the schedule to this Order.
III. - Requirements for personal use vehicles:
When accessible to wheelchair users, category M1 vehicles comply with the provisions set out in Appendix 3 to Appendix XI to the above-mentioned Directive 2007/46/EC.
When accessible to wheelchair users, category N1 vehicles comply with the provisions of 2.1, 2.7, 2.8 and 2.10 of the schedule to this Order.

Operating rules.
I. - General operating rules:
The driver shall operate the vehicle distress signal when the rise or descent of a wheelchair user takes place on the carriageway. The driver alone and in a wheelchair is exempt from this obligation.
II. - Specific rules for vehicles providing public service for the carriage of persons:
If the vehicle is not equipped with an audible warning device, the driver shall inform the passengers of the destination, stops and, where applicable, any event that may affect the course of the trip.
If the vehicle is not equipped with a visual warning device perceptible by all passengers, especially by persons with reduced mobility, the driver shall make available to passengers a document indicating the destination, stops and any information necessary for the proper conduct of the journey.

Application dates.
This Order applies effective January 1, 2014, with the exception of the provisions of section 3 that apply to new vehicles newly registered as of July 1, 2014.
Vehicles whose first registration date is prior to July 1, 2014 and whose registration certificate refers to the HANDICAP bodywork are deemed to meet the technical requirements of item 2 of the annex to this Order.

The Director General of Infrastructure, Transport and the Sea and the Director General of Energy and Climate are responsible, each with regard to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.

    A N N E X E
    TECHNICAL REQUIREMENTS


    Technical requirements apply to vehicles equipped to be accessible to persons with reduced mobility and wheelchair users.


    1. Vehicle equipped to be accessible to people
    reduced mobility other than wheelchair users


    1-1. The vehicle has at least one seating position with ease of access such as:
    (a) Seat, front or rear, rotating and/or rotating centre; or
    (b) Translation and/or rotation of seats; or
    (c) Vertical and/or horizontal translation possibly associated with rotation; or
    (d) Part of mobile bodywork.
    Accessibility devices return to the initial traffic position when the person is installed in the vehicle or when the person has left the vehicle.
    This return to the initial position can be automatic, semi-automatic or manual. The blocking in the outside position is ensured to avoid any movement of the accessibility aid device during the installation and exit of the person.
    The points have to d concern the side squares placed on the right of a door and for which access is made directly from the outside of the vehicle.
    1-2. Handles are installed close to the position referred to in point 1-1 to assist in the establishment and exit of the person. These devices do not have a prominent part and are in contrast colour.
    1-3. Door opening facilitates access or transfer of the passenger.
    1-4. The height of the door threshold relative to the ground is less than 320 mm. If not, a fixed or retractable step is installed. In the event of a technical impossibility to install such equipment (e.g. a reduction in the ground clearance of the vehicle beyond the limits allowed by the vehicle manufacturer), a removable step is planned. During its use, this march is in solidarity with the vehicle.
    1-4.1. When the door is closed, no part of a sidewalk exceeds the adjacent exterior profile of the bodywork by more than 10 mm.
    1-4.2. The horizontal surface of the steps is non-slip and the walking nose is contrasting.
    1-4.3. The front and rear corners of the steps have a rounding of at least 5 mm radius. The edges are rounded at least 2.5 mm radius.
    1-5. Retractable steps meet the following requirements:
    1-5.1. The operation of the retractable steps can be synchronized with that of the door.
    1-5.2. The depth of the retractable step is at least 200 mm and the width of at least 400 mm.
    1-5.3. When the vehicle is started and in circulation, a sound and visual signal alerts the driver when the retractable step is not completely retracted.
    1-5.4. The movement of a retractable walk ordered is not likely to hurt passengers, or persons placed near the vehicle. This requirement does not apply to the driver's visible march from his seat without the use of indirect vision devices.
    1-5.5. When the door corresponding to a retractable step is opened, the retractable step is blocked in extension. When a mass of 136 kg is placed in the centre of a simple step, the vertical deformation does not exceed 10 mm at any point of the walk from the bodywork.


    2. Vehicle equipped to be accessible
    wheelchair users


    2-1. Access to the compartment.
    The number of doors and the useful dimensions of access to the wheelchair user compartment are as follows:

    Useful dimensions of access are not applicable to vehicles of category N1 intended for personal use and carrying only a wheelchair.
    2-2. Opening doors.
    The doors have an internal and external opening control.
    A device allows the door to be kept open regardless of the type of door used to ensure the dimensions defined in point 2.1 during access to the vehicle by the wheelchair user. The inner opening control is placed at a height between 300 mm and 1300 mm from the floor of the vehicle compartment. When a boarding device is placed in front of an access door, it must allow the wheelchair passenger or a third party to directly or indirectly access the inner opening control.
    2-3. Constructed on the ground of a wheelchair.
    A position of 700 mm per 1200 mm, the longitudinal plane of which is parallel to the longitudinal plane of the vehicle, is intended to position a wheelchair. In circulation, the wheelchair location provides a 50 mm clearance at the footrest level.
    This location can be reduced to wheel passages within the 20 mm width limit and the boarding device within the 70 mm length limit.
    A location occupied by a wheelchair user is considered a seating space.
    In category N1 vehicles, all configurations have a free wheelchair space.
    2-4. Internal height.
    The minimum interior height of the vehicle measured at the right of the wheelchair seat surface is not less than 1,350 mm.
    2-5. Access to reserved wheelchair spaces.
    To access the reserved location, the wheelchair user has a free space of 700 mm wide.
    2-6. Boarding device.
    In the normal use of the vehicle, the rolling paths are prohibited.
    At least one of the doors is equipped with a means of access for wheelchair users. The boarding device, such as the access ramp, the lift platform or any equivalent device, is operated from outside by a third party.
    If one of the doors is equipped with a lift platform, and unless the vehicle is fitted to carry a maximum of two wheelchair users, another door is equipped with an access ramp or a rolling path.
    2-6.1. Rampe.
    The ramp has a locking system in normal traffic position.
    2-6.1.1. Composition of the access ramp.
    The access ramp includes:
    - an anti-slip surface;
    – a secure maintenance system in wheelchair access manoeuvres;
    – a device preventing the wheelchair from switching on the sides when the ramp exceeds 1200 mm in length in the position of use;
    – a maximum slope not exceeding 25% from the ground when the ramp is placed at the rear of the vehicle and compared to a border of 150 mm high for a lateral exit. To satisfy this requirement, an aging system can be used;
    • a useful width of at least 730 mm;
    – a resssaut and/or a maximum 15 mm gap;
    – an outer edge of the surface of the ramp clearly marked by a colour strip of a minimum width of 10 mm that slices on the rest of the surface of the ramp. This colour strip is displayed on the extreme edge and on both sides parallel to the direction of wheelchair movement.
    The access ramp supports 300 kg (e.g., electric wheelchair with accompanying person) without permanent deformation.
    2-6.1.2. Operating modes.
    The deployment and removal of the ramp can be either assisted or manually controlled.
    Assisted control ramp:
    The deployment and removal of a ramp is indicated by flashing yellow lights and a sound signal; any ramp has distinctive red and white retro-reflective marks on the outer edges.
    The deployment and storage of the ramp that may result in injury is protected by one or more safety devices.
    The horizontal movement of a ramp is interrupted when loaded with a mass of 15 kg.
    If the driver sees the ramp well enough to monitor its deployment and use in order to ensure the safety of passengers, he can control it from his seat. This requirement may be met by means of one or more appropriate optical devices.
    In any other case, the controls are located next to the ramp.
    Manually controlled ramp:
    The ramp is designed to be actuated without requiring a muscle effort greater than 250 N.
    2-6.2. Lift system.
    The lift system, in accordance with the above-mentioned directive 2006/42/EC, has a minimum width of 730 mm and a minimum length of 1,200 mm. In addition, its lifting capacity is at least 300 kg.
    These devices are equipped with a threshold of at least 100 mm high or a bridge to avoid the fall of the wheelchair in a high position.
    The control of the manoeuvre can be operated by a person sitting in a wheelchair using the platform.
    The manoeuvre may be interrupted by a third party in the event of an emergency, at any time of climb or descent. These orders are placed close to the lift.
    The operating instructions for the lift system are available in the vehicle, located in an identified location. Additional technical requirements apply to electric-control elevators:
    ― the command is designed to automatically return to the stop position in case of a drop of the command. The movement of the platform stops immediately and it is possible to order a movement in one direction and in the other;
    – a safety device (e.g. a walking reversal mechanism) protects non-visible areas to the operator where the movement of the platform would risk cutting or crushing objects.
    If the driver sees the platform well enough to monitor its use in order to ensure the safety of passengers, he can control it from his seat. This requirement may be met by means of one or more appropriate optical devices.
    2-7. Stability of wheelchairs.
    2-7.1. Each wheelchair space is equipped with an integrated restraint system that combines a wheelchair restraint system and a restraint system for its user.
    The anchorages of the restraint systems are resistant to the forces specified in the above-mentioned directive 76/115/EEC and ISO 10542-1/2001.
    The wheelchair fastening system (ancing mechanism) complies with the requirements of the above-mentioned directive 77/541/EEC and the relevant parts of ISO 10542.
    The tests shall be carried out by the Technical Service, as defined in the above-mentioned amended Directive 2007/46/EC, to test and verify compliance with the above-mentioned guidelines. The criteria identified are those identified in these guidelines. The tests are performed with the type wheelchair described in ISO 10542.
    2-7.2. The control of the wheelchair restraint system is designed to reduce the risk of incorrect use.
    2-7.3. A technical notice of use of anchor systems is available in the vehicle at an identified location.
    2-8. Interior facilities for people with reduced mobility.
    2-8.1. The interior walls, the pavilion and the floor have a coating.
    2-8.2. The vehicle is equipped with ventilation and heating devices for the part where persons are transported.
    2-8.3. The vehicle is equipped with sufficient lateral glazing.
    2-8.4. The suspension provides normal comfort to passengers transported.
    2-8.5. The interior designs do not contain any projections that may worsen the consequences of a traffic accident.
    2-8.6. The space for people with reduced mobility is not separated from the driving station by a total partition.
    2-9. Lighting and signalling.
    The vehicle is equipped with sufficient lighting to allow passengers to board and disembark conveniently and safely; All measures must be taken to ensure that no obstacles to the visibility of the road are made by the driver or other road users.
    2-10. Cost distribution calculations.
    Each design configuration is the subject of a load distribution calculation that takes into account the provisions of Note W8 as set out in Appendix XI to Amended Directive 2007/46/EC.
