Entry into force: The new institution will replace the three pre-existing universities as of January 1, 2014. The necessary transitional provisions, including the establishment of the governance bodies of the new institution, come into force on the day after the publication of this decree.
Notice: This decree provides that the University of Bordeaux ensures all the activities carried out by the Bordeaux-I, Bordeaux-II and Bordeaux-IV universities that it brings together. The transitional provisions of the decree provide for the adoption of the statutes and budget of the University of Bordeaux and the governance of the institution. The property, rights and obligations and contracts of the staff of the three Bordeaux universities are transferred to the University of Bordeaux. Similarly, officials previously assigned to these institutions are assigned to the University of Bordeaux. Finally, students enrolled in these three universities are enrolled at the University of Bordeaux.
The denomination and statutes of the community of universities and institutions of Bordeaux, erected as EPSCP by the Act No. 2013-660 of 22 July 2013 relating to higher education and research (arts. 62 and 117), are amended accordingly to reflect the merger of the three universities. This establishment is named Community of Universities and Institutions in Aquitaine. The Campus operation, the porting of future investment programs, the coordination of the services offered to students and the documentary policy will now be provided by the University of Bordeaux.

Having regard to the decree of 23 December 1970, erecting educational and research units in scientific and cultural public institutions;
Vu le Decree No. 99-272 of 6 April 1999 amended on joint commissions for the establishment of public higher education institutions;
Vu le Decree No. 2007-383 of 21 March 2007 amended to establish the public scientific cooperation institution "University of Bordeaux";
Vu le Decree No. 2011-184 of 15 February 2011 relating to technical committees in government departments and public institutions of the State;
Considering the advice of the technical committee of the public scientific cooperation institution "University of Bordeaux";
Considering the deliberation of the board of directors of the public scientific cooperation institution "University of Bordeaux";
In the opinion of the technical committees of Bordeaux-I, Bordeaux-II and Bordeaux-IV universities;
Considering the deliberations of the boards of the Bordeaux-I, Bordeaux-II and Bordeaux-IV universities;
Considering the opinion of the National Council for Higher Education and Research of 15 July 2013,
Decrete:
The University of Bordeaux is a scientific, cultural and professional public institution formed in the form of a university within the meaning of Article L. 711-2 of the Code of Education. It is subject to the provisions of the Education Code and the texts taken for its application.
The University of Bordeaux ensures all the activities carried out by the Bordeaux-I, Bordeaux-II and Bordeaux-IV universities it brings together.
Assets, rights and obligations, including staff contracts, Bordeaux-I, Bordeaux-II and Bordeaux-IV universities, are transferred to the University of Bordeaux.
Public servants previously assigned to these institutions are assigned to the University of Bordeaux.
Students enrolled at Bordeaux-I, Bordeaux-II and Bordeaux-IV universities are enrolled at the University of Bordeaux.
It is established within the University of Bordeaux a provisional constitutive assembly consisting of members of the respective boards of directors of the Bordeaux-I, Bordeaux-II and Bordeaux-IV universities. The current presidents of the Bordeaux-I, Bordeaux-II and Bordeaux-IV universities are members of the provisional constitutive assembly.
This Assembly shall, until the establishment of the governing bodies provided for in Article L. 712-1 of the Education Code, exercise the competence of these bodies.
It adopts, under the conditions set out in Article L. 711-7 of the Education Code, the statutes of the institution, which are transmitted to the Minister responsible for higher education, within three months of the publication of this Order.
If the statutes of the University of Bordeaux are not adopted within this period, they are arrested by the minister responsible for higher education.
Until the election of the president of the University of Bordeaux under the conditions provided for in Article L. 712-2 of the Code of Education, the president of the institution is assured by a provisional administrator appointed by the rector of the Bordeaux Academy, chancellor of the universities. The provisional administrator exercises the skills assigned to the university president by the same article.
He summons and chairs the Provisional Constitutive Assembly and organizes before December 31, 2013 the elections to the various councils of the establishment. Eligible voters, under the conditions established by articles D. 719-2 to D. 719-40 of the Code of Education, staff and users of Bordeaux-I, Bordeaux-II and Bordeaux-IV universities.
The councils and directors of the joint components and services of the Bordeaux-I, Bordeaux-II and Bordeaux-IV universities remain in office and continue to exercise their skills until the new councils are established and the appointment or election of the new directors of the common components and services created at the University of Bordeaux.
The financial accounts of the Bordeaux-I, Bordeaux-II and Bordeaux-IV universities for the 2013 fiscal year are prepared by the accounting officers in office at the time of the abolition of each university. They are approved by the Board of Directors of the University of Bordeaux.
The provisional constitutive assembly adopts, for the year 2014, the budget of the University of Bordeaux prepared by the provisional administrator.
For the constitution of the technical committee and the joint commission of establishment of the University of Bordeaux, are electors and eligible staff of the Bordeaux-I, Bordeaux-II and Bordeaux-IV universities.
Until the installation of the technical committee and the joint commission of establishment constituted in accordance with the decrees of the 15 February 2011 and 6 April 1999 These bodies include representatives of the establishment and staff of the technical committees and the respective joint establishment commissions of the Bordeaux-I, Bordeaux-II and Bordeaux-IV universities. The provisional administrator summons and chairs these proceedings.
Article D. 711-1 of the Education Code is amended as follows:
1° The words: "8° Bordeaux-I ;", "9° Bordeaux-II ;" and "11° Bordeaux-IV ;" are deleted ;
2° After the words: « 7° Besançon ; », are added the words: « 8° Bordeaux ; "
I. ― Are repealed:
― Decree No. 70-605 of 3 July 1970 relating to elections to the Provisional Constitutive Assembly of the University of Bordeaux-I;
― Decree No. 95-675 of 9 May 1995 creating universities in the academy of Bordeaux.
II. ― In the appendix to the decree of December 23, 1970, erecting educational and research units in scientific and cultural public institutions, the following words are deleted:

I. ― In title and titleArticle 1 of the Decree of 21 March 2007the words: "the public institution of scientific cooperation" University of Bordeaux” are replaced by the words: "The Community of Universities and Institutions of Aquitaine".
II. ― Changes toAnnex to the above-mentioned Decree of 21 March 2007 as set out in the Appendix to this Order is approved.
Sections 2, 8 and 9 come into force on January 1, 2014.
The Minister of Economy and Finance, the Minister of Higher Education and Research and the Minister Delegate to the Minister of Economy and Finance, responsible for the budget, are responsible, each with respect to him, for the execution of this Order, which will be published in the Official Journal of the French Republic.
A N N E X E
I. ― The statutes of the University of Bordeaux are amended as follows:
1° In the title of the appendix, the words: "the public institution of scientific cooperation "University of Bordeaux" are replaced by the words: "the Community of Universities and Institutions of Aquitaine";
2° In articles 1 and 3, the words: "University of Bordeaux" are replaced by the words: "Community of Universities and Institutions of Aquitaine";
3° In Article 2, the second, third and fifth preambular paragraphs shall be deleted and, after the first preambular paragraph, it shall read:
" – the University of Bordeaux; » ;
4° In the last paragraph of Article 2, the words "the University of Bordeaux" are replaced by the words: "the Community of Universities and Institutions of Aquitaine";
5° In Article 3, the words "from the University of Bordeaux" are replaced by the words "from the Community of Universities and Institutions of Aquitaine";
6° In Article 3, the third, fifth, sixth, twentieth and thirty-first paragraphs are deleted;
7° In the third paragraph of Article 7, the word "four" is replaced by the word "two".
II. ∙ Amendments to the 3°, 6° and 7° of I shall take effect on 1 January 2014.
