On the report of the Minister of National Education and the Minister of Sports, Youth, Popular Education and Associative Life,
Having regard to the Constitution, including article 37 (1);
Considering the code of social action and families, including articles R. 227-1, R. 227-16 and R. 227-20;
Considering the education code, including its article L. 551-1;
Considering the advice of the Board of Directors of the National Family Allowance Fund dated 16 July 2013;
Considering the opinion of the Central Board of Directors of the Agricultural Social Mutuality of 18 July 2013;
The State Council (Social Section) heard,
Decrete:
I. ― The territorial educational project in which, pursuant to Article L. 551-1 of the Code of Education, perish-school activities for children enrolled in kindergarten or elementary schools, in the extension of the public service of education and in complementarity with it, is jointly developed by the commune, siege of these schools, or the public institution of intercommunal cooperation when the operating expenses of the schools have been transferred to it
The territorial educational project takes the form of a convention between the mayor or the president of the public institution of intercommunal cooperation, the prefect, the academic director of the services of national education, acting on the delegation of the academy rector, and, if applicable, the other signatory partners, who coordinate their interventions to organize, in the school enclosure or in the premises of the peri-colonial children, of the
II. ―Previously at the conclusion of the territorial educational project, the State's services ensure that the organizational arrangements for the reception of children are appropriate to ensure their safety. They also ensure the educational quality of the proposed peri-school activities, their consistency with the school project and the objectives pursued by the public education service.
I. ― On an experimental basis, for a period of three years, the rates of supervision of peri-curricular leisure receptions organized within the framework of a territorial educational project may be reduced from the rates provided for in article R. 227-16 of the Code of Social Action and Families, without being less than:
1° Animator for fourteen minors under the age of six;
2° Animator for eighteen minors aged six or older.
By derogation from section R. 227-20 of the Code of Social Action and Families, persons who participate in the supervision of peri-curricular activities in a timely manner are included, during the time they actually participate in it and for the application of section R. 227-12 of the same code, in the calculation of these management rates.
By derogation from the 1° of Article R. 227-1 of the same code, the minimum duration for peri-curricular activities per day of operation is reduced to one hour.
II. ― The list of municipalities and public institutions of intercommunal cooperation signatories to a territorial educational project is fixed in each department by decree of the prefect.
III. - Without prejudice to the controls provided for in Article 1 of this Decree, the experimentation may be interrupted at any time by the prefect if the requirements mentioned above are not met, under the conditions provided for in Article I of Article L. 227-11 of the Code of Social Action and Families.
The assessment of the experiment under Article 2 I is, six months before its completion, the subject of a report by the steering committee referred to in Article L. 551-1 of the Education Code bringing together all the partners of the territorial educational project that are signatories to the Agreement referred to in Article 1 I and transmitted to the department prefect and to the academy rector. These authorities address the ministers responsible for national education and youth, no later than four months before the end of the experiment, a synthesis of these evaluation reports. In the light of these reports, the Government decides either to end experimentation or to continue all or part of the measures taken on an experimental basis.
This decree comes into force at the school year 2013.
The Minister of National Education and the Minister of Sports, Youth, Popular Education and Associative Life are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
