The Minister of Social Affairs and Health, the Minister of Labour, Employment, Vocational Training and Social Dialogue, the Minister of Women ' s Rights, spokesperson for the Government, and the Minister of Sports, Youth, Popular Education and Associative Life are responsible, each with regard to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.

    RULES OF INLAND AUDIT COMMITTEE
    DES MINISTÈS CHARGÉS DES AFFAIRES SOCIAL
    Introduction


    An internal audit committee is established within the ministries responsible for social affairs by the Decree No. 2011-497 of 5 May 2011, below "the committee" or "the internal audit committee". These rules of procedure of the committee shall follow the terms of the decree and specify the tasks and rules of operation of the internal audit committee of the ministries responsible for social affairs.


    1. Missions and scope of operations


    According to Article 1 of the above-mentioned decree the ministries responsible for social affairs are the ministries responsible for labour, employment, health, social security, solidarity, social cohesion, youth, social life and sports.
    According to the provisions of Article 7 of the above-mentioned decree, the committee has the following tasks:
    to ensure the competence of listeners;
    – to ensure the independence of the internal audit mission and auditors in the performance of their missions and to ensure that they have sufficient means;
    to approve the internal audit charter and the code of ethics;
    - to approve the internal audit plan;
    - to ensure the implementation and monitoring of the actions decided upon after the audits;
    - to validate the methods and tools implemented by the auditors;
    - to ensure the dissemination of good risk management practices related to the management of public policies within the ministries responsible for social affairs and their operators;
    - to ensure the quality of the internal control and risk control system implemented within these departments and their operators;
    – to establish any useful relationship with the external auditors of these departments.


    2. Composition


    According to the provisions of Article 8 of the above-mentioned decree, the committee is composed as follows:
    1° Ministers responsible for social affairs;
    2° Heads of departmental budgetary and accounting services of ministries responsible for social affairs;
    3° Not more than seven personalities chosen because of their skills or experience in the field of internal audit or in the management of public policies led by the ministries responsible for social affairs and not having operational responsibility within them.
    The Internal Audit Committee is chaired by Ministers. A Vice-President shall be appointed by the Ministers among the personalities mentioned in the preceding paragraph.
    The members mentioned in the 3rd are appointed by decree of ministers responsible for social affairs for a renewable period of three years.
    This function does not result in payment of compensation.
    The Secretary General of the Ministries responsible for Social Affairs attends the Internal Audit Committee meetings without a deliberate vote.
    The secretariat of the Internal Audit Committee is provided by the general inspection of social affairs.
    Upon a decision of the sitting chair, other persons may attend the meetings of the committee without a deliberate vote, including the head of the General Social Inspection Service, the head of the General Youth and Sports Inspection Service and the head of the internal audit mission of the social affairs departments.


    3. Organization of meetings


    According to the provisions of Article 8 of the above-mentioned Decree, the Internal Audit Committee shall meet at least once a year on the convocation of a Minister for Social Affairs or the Vice-President. The committee may meet validly if at least five members are present.
    If a committee member considers it necessary to hold a meeting of the committee, he or she shall notify one of the Ministers responsible for Social Affairs or the Vice-Chair or the secretariat of the Internal Audit Committee, who shall inform the Ministers concerned and the Vice-Chair.
    Committee meetings are held in the physical presence of its members. However, if special circumstances make it necessary and with the prior agreement of the sitting chair, members may attend teleconference or videoconference sessions, as data security and confidentiality of exchanges are ensured.
    The committee secretariat is responsible for organizing the sessions.
    The convocation shall be sent at least fifteen days before each meeting. The agenda is sent at the same time as the convocation.
    The documents submitted to the committee are sent at least three days before the meeting.
    The sessions of the audit committee are held preferably in the premises of the general social affairs inspection.


    4. Decisions


    The members of the committee report any situation that could affect their independence and objectivity. They do not participate in the debates or the votes associated in the event of conflicts of interest.
    The decisions of the committee shall be taken by a majority of the votes of its members participating in the session, each member with one vote. In the event of a vote-sharing, the Speaker's voice is preponderant.
    An electronic vote may be held on any items previously debated in the meeting. The committee secretariat is responsible for organizing the vote. He must ensure that all members of the committee received the request for a vote and were able, if they so wish, to vote. A minimum period of fifteen days must be left to the members for the expression of their vote. The vote is valid if at least five members have voted. In the event of a vote-sharing, the voices of ministers or vice-president shall prevail.
    The conclusions of the meetings are prepared by the secretariat of the committee who transmits them to the chair of the meeting for validation. They are then submitted electronically to the members present at the sessions before being broadcast to all members and to the secretary general of the ministries responsible for social affairs via the extranet site made available to members.
    In addition to the statement of conclusions, the chair of the meeting may send to the ministers, at the end of each session, a note outlining the opinion and decisions of the committee.


    5. Committee Activity Record


    The committee shall prepare every three years an account of its activity for ministers responsible for social affairs.
    In this report of activity, the committee presents the synthesis of its work with respect to the missions conferred upon it.
    If the committee considers it appropriate, the committee shall make recommendations in its report of activity.


    6. Evaluation of the functioning and action of the committee


    The committee conducts at least every three years the evaluation of its operation. It examines its own effectiveness and proposes to ministers responsible for social affairs any necessary change.


    7. Data access


    The Internal Audit Committee has access to all the work produced by the departments responsible for social affairs to carry out its mission, including those conducted in the areas of internal audit, internal control and risk mapping.
    He may audition and, if he wishes so without the presence of the Secretary General, any person, whether internal or external, that he considers appropriate to hear for the formation of his opinion.
    To facilitate the functioning of the committee and access to data for its members, a dedicated collaborative site is open to committee members, the secretary general of the ministries responsible for social affairs and the internal audit mission. It is powered by the secretariat of the Internal Audit Committee. It is available at https://cai.sante.gouv.fr/.


    8. Protection of information


    The members of the Internal Audit Committee ensure respect for the confidentiality of the information they have access to because of their participation in the work of the Internal Audit Committee.
    Other members of the committee are subject to the same confidentiality rules.


    9. Entry into force


    These rules of procedure are established by the Internal Audit Committee which validated it at the end of its 2nd meeting, held on February 21, 2013. It is submitted for approval by decree of ministers responsible for social affairs.


    10. Modalities for the review of the present text


    The committee reviews and reviews annually the adequacy of these rules of procedure and will recommend to ministers responsible for social affairs any proposed amendments for approval.
