Notice: This decree sets out the arrangements for the organization of recruitments reserved to contract agents for access to the interdepartmental body of social service assistants of state administrations. The selection of candidates will be carried out by professional examinations, organized by the six recruitment authorities defined within the Decree No. 2012-1098 of 28 September 2012 bearing special status of the interdepartmental body of social service assistants of state administrations (Minister of Social Affairs and Health, Minister of National Education, Minister of Defence, Minister of Interior, Minister of Ecology, Sustainable Development and Energy, Minister of Economy and Finance). The contracting officers concerned will only be able to submit to the professional examinations opened by the recruitment authority for the interdepartmental management of social service assistants, the service in which these officers exercise or have performed their duties. Contractors must hold the required titles and diplomas.

Vu la Act No. 83-634 of 13 July 1983 amendments to the rights and obligations of civil servants, together with Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State;
Vu la Act No. 2012-347 of 12 March 2012 relating to access to full employment and the improvement of the conditions of employment of contractual agents in the public service, the fight against discrimination and various provisions relating to the public service;
Vu le Decree No. 2004-1105 of 19 October 2004 amended on the opening of recruitment procedures in the public service of the State;
Vu le Decree No. 2012-631 of 3 May 2012 amended on the eligibility conditions of candidates for recruitments reserved for access to the bodies of officials of the State of categories A, B and C and setting the general conditions for the organization of these recruitments in accordance with the Act No. 2012-347 of 12 March 2012 relating to access to full employment and the improvement of the conditions of employment of contractual agents in the public service, the fight against discrimination and various provisions relating to the public service;

Having regard to the opinion of the Conseil supérieur de la service publique de l'Etat (commission statutaire) dated 19 April 2013;

Decrete:
The rank of social service assistant of the interdepartmental body of social service assistants of the state administrations is accessible to contractual agents, under the conditions provided by the decree of 3 May 2012 referred to above and by this decree, by means of professionalised examinations organized in accordance with the provisions of Chapter I of Title I of the Act of 12 March 2012 referred to above.
The reserved professional examinations are opened by order of the recruitment authority within the meaning of thearticle 5 of the decree of 28 September 2012 referred to above, each in respect of and after notice of the Minister responsible for the Public Service, under the conditions established to first and third paragraphs of Article 2 of the Decree of 19 October 2004 referred to above.
Contractual agents may, depending on their place of duty, present themselves, under the conditions specified in articles 2 and 3 of the decree of 3 May 2012 referred to above, provided they meet the conditions fixed to Articles 2 and 4 of the Act of 12 March 2012 referred to above and articles L. 411-1 to L. 411-6 of the Code of Social Action and Families, to the professionalized examinations reserved by the recruitment authorities mentioned in thearticle 5 of the decree of 28 September 2012 referred to above :
1° When performing their duties in one of the services referred to in theannex to the decree of 28 September 2012 referred to above, they may present themselves to the professionalised examinations reserved by the authority which ensures, for this service, the recruitment of the agents of the body of the social service assistants of the state administrations;
2° When performing their duties in one of the services not mentioned in theannex to the decree of 28 September 2012 referred to above, they may present themselves to the professional examinations reserved by the Minister for Social Affairs.
