Decree No. 2013-655 of 19 July 2013 on the publication of the agreement as an exchange of notes verbales between the Government of the French Republic and the Government of the Federal Republic of Germany to authorize the construction by the urban community of Strasbourg and by the commune of Kehl of a border bridge on the Rhine pursuant to the Fribourg agreement of 12 June 2011, signed in Berlin on 20 March and 25 April 2012 (1)

President of the Republic,
On the report of the Prime Minister and the Minister for Foreign Affairs,
Considering the Constitution, in particular articles 52 to 55;
Vu le Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments undertaken by France;
Vu le Decree No. 2003-1093 of 14 November 2003 issuing the agreement between the Government of the French Republic and the Government of the Federal Republic of Germany on the construction and maintenance of border bridges on the Rhine whose contracting parties do not undertake the control of the work (as a whole annex), signed in Fribourg-en-Brisgau on 12 June 2001,
Decrete:

Article 1


The agreement in the form of an exchange of notes verbales between the Government of the French Republic and the Government of the Federal Republic of Germany to authorize the construction by the urban community of Strasbourg and by the commune of Kehl of a border bridge on the Rhine pursuant to the Fribourg agreement of 12 June 2011, signed in Berlin on 20 March and 25 April 2012, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign Affairs are responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.

EXCHANGE OF VERBAL NOTES TO THE GOVERNMENT OF THE FRENCH REPUBLIC AND GOVERNMENT OF THE GERMANY REPUBLIC AND THE GOVERNMENT OF THE GERMANY REPUBLIC TEND TO THE TORIST OF CONSTRUCTION BY THE STRASBOURG COMMUNITY AND THE KEHL COMMUNITY OF A FRONTIÈRE SUR LE RHIN EN APPLICATION DE L'ACCORD DE FRIBOURG DU 12 JUIN 2011

NOTE VERBALE


The Embassy of France presents its compliments to the Federal Ministry of Foreign Affairs, and, referring to its note verbale No. E10-9.321.00/60 of 20 March 2012, has the honour to convey to it the agreement of its Government on the provisions contained therein, which are as follows:
"The Federal Ministry of Foreign Affairs of the Federal Republic of Germany presents its compliments to the Embassy of France and, referring to Article 3 of the Agreement of 12 June 2001 between the Government of the Federal Republic of Germany and the Government of the French Republic concerning the construction and maintenance of border bridges on the Rhine whose Contracting Parties do not assure the control of the work, hereafter referred to as "the Agreement of 12 June 2001
(1) The communes of Kehl and Strasbourg (Straßburg) intend to build, in accordance with the provisions of the Agreement of 12 June 2001, a border bridge over the Rhine at the height of kilometre 293,6 of the river.
(2) The Agreement of 12 June 2001 states that the construction of a border bridge between the French Republic and the Federal Republic of Germany linking between public roads outside the network of highways and national roads in France and federal highways of great communication in the Federal Republic of Germany must be authorized by the two Governments expressed through an Agreement between them.
(3) The Government of the French Republic and the Government of the Federal Republic of Germany have no reservations regarding the construction of the border bridge referred to in paragraph 1 above and authorize it. They do so by taking note of the cooperation agreement reached for this purpose on 15 March 2012 between the City of Kehl (Greße Kreisstadt Kehl) and the Urban Community of Strasbourg and concerning the extension of line D of the tramway network of the Strasbourg agglomeration to Kehl, a convention that meets the requirements of Article 4 of the Agreement of 12 June 2001.
4) The Contracting Parties shall promptly inform the municipalities concerned of the entry into force of this Agreement.
5) This Agreement shall be concluded in German and French languages, both texts being equally authentic.
If the Government of the French Republic declares to accept the proposals made by the Government of the Federal Republic of Germany in paragraphs 1 to 5 above, the present note verbale and the note of reply of the French Embassy expressing the agreement of the Government of the French Republic shall constitute an agreement between the Government of the Federal Republic of Germany and the Government of the French Republic.
The Agreement shall enter into force on the date on which the two Governments have mutually informed themselves that the internal procedures necessary for its entry into force have been completed. The date taken into consideration will be the date of receipt of the last notification. »
The note verbale of the Federal Ministry of Foreign Affairs of the Federal Republic of Germany and the present response are therefore an Agreement of our two Governments on the authorization to build a border bridge over the Rhine pursuant to Article 3 of the Agreement of 12 June 2001. /.
The Embassy of France takes this opportunity to renew to the Federal Ministry of Foreign Affairs the assurances of its highest consideration.
