Key Benefits:
Publics concerned: motorway concession companies.
Purpose: Modify the terms and conditions for calculating the occupancy royalty of the public domain due by the concessionary highway companies.
Entry into force: the text comes into force on the day after its publication.
Notice: Motorway dealers have been paying a royalty for public domain occupation since 1997. Its calculation methods are here modified and adjusted to best reflect the benefit from public domain occupation. The share on the company's turnover is ranged from 0.015 to 0.055.

The Prime Minister,
On the report of the Minister of Ecology, Sustainable Development and Energy,
Vu le road traffic codeincluding articles L. 121-2, L. 122-4 and R. 122-27;
Considering the general code of public ownership, including articles L. 2125-1, L. 2125-3 and R. 2125-3;
The State Council (section of public works) heard,
Decrete:
Section R. 122-27 of the Highway Traffic Code is amended as follows:
In the fifth paragraph, the formula: "R 2 = 0.015 × CA;" is replaced by the following provisions: "R 2 = 0.055 × CA; "
The Minister of Economy and Finance, the Minister of Ecology, Sustainable Development and Energy, the Minister Delegate to the Minister of Economy and Finance, responsible for the budget, and the Minister Delegate to the Minister of Ecology, Sustainable Development and Energy, responsible for transport, the sea and fisheries, are responsible, each with respect to it, for the execution of this Official Gazette, which will be published in the French Republic.
