Judgment of 10 May 2013 setting out the modalities for organizing the election to the National Council for Higher Education and Research of Students Representatives of Public Institutions of a Scientific, Cultural and Professional character

Having regard to the amended decision of 13 April 1994 on the national commission for the elections of representatives of the National Council of Higher Education and Research;
In view of the decision of 10 May 2013 pursuant to Article D. 232-4 of the Education Code for the designation of student representatives to the National Council for Higher Education and Research,

The ballot for the election of student representatives to the National Council of Higher Education and Research is held from Monday, 10 June 2013, the date of the election, on Friday, 21 June 2013, at midnight, the date of the closing of the ballot.

  • Chapter I: From the list of electors Article 2 Learn more about this article...


    Each scientific, cultural and professional public institution displays on Monday, May 13, 2013 the provisional list of its large electors, designated in accordance with Article D. 232-4 of the Education Code and the order made for its application. The national list is available at the address mentioned in section 3.
    Requests for rectification must be received by Friday, 17 May 2013. The provisional list of electors is corrected as required and the final list of electors is posted on Tuesday, May 21, 2013. The final national list is available at that date at the address mentioned in Article 3.
    Major electors are informed by their establishment of the dates and terms and conditions of the ballot and the withdrawal of voting material in the establishment, as set out in chapters III and IV of this Order.

    The lists of candidates, the associated professions of faith and the individual declarations of application and their supporting documents are filed no later than Tuesday, May 21, 2013, at 12:00, at the Ministry of Higher Education and Research, General Directorate for Higher Education and Professional Inclusion (secretariat of the National Council for Higher Education and Research), 1, rue Descartes, 75231 Paris Cedex 05.

    Lists and professions of faith must be printed in black ink on white paper, in a format 21 × 29.7 cm, on a single page for lists of candidates and on a single sheet for professions of faith.
    Each list of candidates has as many names of incumbent candidates and alternate candidates as there are seats to be filled, eleven incumbents and eleven alternates.
    The names of the incumbent and alternate candidates are indicated in the preferential election order, each alternate appearing in number bis after each holder.
    Only the following shall be included in all letters on each list:
    - the title of the list, if any, with its representative acronym;
    the name and name of the candidates;
    the public institution of a scientific, cultural and professional character in which they are regularly registered;
    ― the degree prepared and the current year of study;
    – where applicable, the name of student organizations that present the list or provide support to it.
    The individual application statement completed by each incumbent candidate and each alternate candidate must be accompanied by the proof of his or her identity, the institution in which he or she is registered and the degree he or she prepares.
    A receipt is issued upon filing a list of candidates.

    The lists of candidates received are verified under the conditions set out in the third paragraph of article D. 232-10 of the above-mentioned education code. Where applicable, they shall be corrected within one straight day of notification of the ministerial request for rectification.
    Each public institution with a scientific, cultural and professional character advertises these lists and associated faith professions by posting.

    The Ministry of Higher Education and Research provides public institutions of a scientific, cultural and professional nature with envelopes No. 1, No. 2 and No. 3 which must be used for the election.
    The n° 2 envelope bears an alphanumeric index generated randomly and authenticating the voting material specific to the elector. It also includes various mentions to be made by the elector.
    The lists of candidates, whose impression is assured at the institution level, are used as ballots to be introduced in envelope No. 1.

    The voting material must be withdrawn in the establishment personally by the elector or his agent, and by justifying his identity, at the opening hours of the service established by the chief of establishment from Monday, 3, to Friday, 7 June 2013.

    I. ― A large elector who cannot be present in his or her establishment during the period set out in the preceding article for the withdrawal of the voting material may, on his or her request, have the elector removed by an agent to transmit it to him or her after having withdrawn it.
    The proxy is given to an agent who is a student regularly enrolled in the same institution. No one can carry more than one proxy.
    II. - The power of attorney is established, in the presence of the principal, by the establishment in which he is an elector.
    This power of attorney may be established at a distance when the principal justifies, for reasons related to the conduct of his or her studies or for health reasons, the impossibility of moving to establish the power of attorney under the conditions set out in the preceding paragraph. In this case, a proxy print is sent to him by the institution electronically with a request for an acknowledgement of receipt.
    The principal justifies his identity by producing his student card and an authentic identity document. The names and names of the principal and the agent he designate are displayed on the proxy.
    The power of attorney, signed by the principal and covered by the establishment's stamp, is retained by the establishment, which is responsible for its confidentiality.
    III. - The possibility to issue a warrant for the withdrawal of the voting material to which it is intended is open to any elector until Thursday, 23 May 2013.
    Until that date, the principal may present himself in the institution to denounce a previously established warrant. When the power of attorney has been established remotely, the denunciation of the mandate may be carried out remotely in the same forms. In the event of denunciation of the pre-established mandate, the elector may not designate another agent.
    After 23 May 2013, a duly established mandate, not denounced in accordance with the procedure described above, is irrevocable and presumed to be fully implemented.

    Each elector must pass his or her vote, from the date of the opening of the election specified in section 1 above, using exclusively the voting material provided by the administration.
    It inserts its ballot in envelope No. 1 of blue colour bearing no distinctive sign; it introduces this envelope into envelope No. 2 on which it applies its signature and informs the intended mentions; it puts envelope 2 previously closed in envelope No. 3, which it addresses to the presidency of the national commission, exclusively by post.

    Folds containing the votes are retained by the national commission until the counting day on Friday, June 28, 2013.

    On the day of the counting, only the folds sent between Monday, June 10, 2013, the date of the commencement of the poll, and Friday, June 21, 2013, the date of the closing of the ballot (the stamp of the position being authentic), and received no later than the opening of the counting operations, i.e. Friday, June 28, 2013, at 10:00.
    The opening of envelope 2 takes place after its authentication with regard to the list of electors.

    The decision of 28 February 2012 setting out the terms and conditions of election to the National Council for Higher Education and Research of Students Representatives of Public Institutions of a Scientific, Cultural and Professional character is repealed.
