Key Benefits:
Public concerned: regional health agencies and health institutions.
Purpose: Modify the duration of the extension to which multi-year contracts of objectives and means between regional health agencies and health institutions can be extended.
Entry into force: the text comes into force on the day after its publication.
Notice: following the Constitutional Council decision of 22 November 2012 declaring the regulatory nature of terms "of six months" of the first paragraph of Article 35 of Act No. 2011-940 of 10 August 2011, this decree sets the maximum duration of the extension of multi-year contracts of objectives and means to one year from the publication of regional health projects.

Considering the Constitution, in particular the second paragraph of article 37;
Vu le Administrative Justice Codeincluding its article R. 123-20;
Vu le Public Health Code ;
Vu la Act No. 2011-940 of 10 August 2011 amending certain provisions of Act No. 2009-879 of 21 July 2009 reforming the hospital and relating to patients, health and territories, including Article 35, II;
Having regard to Constitutional Council decision No. 2012-235 L of 22 November 2012;
The State Council (Social Section) heard,
Decrete:
In the first paragraph of Article 35 of the above-mentioned Act of 10 August 2011, the words "of six months" are replaced by the words "fixed by decree".
Multi-year contracts of objectives and means mentioned in II of Article 35 of the above-mentioned Act of 10 August 2011 valid on the date of publication of this Order may be extended by way of an amendment for up to one year after the publication of the regional health project referred to in theArticle L. 1434-1 of the Public Health Code.
The period mentioned in the first paragraph may be amended by decree.
The Minister of Social Affairs and Health is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
