Decision No. 2012-1353 of 6 November 2012 fixing the features of#039; multi-year framework for universal postal service rates

NOR: ARTR1241071S ELI: Not available

Electronic Communications and Postal Control Authority,
Because of the Posts and electronic communications (hereinafter CPCE), in particular Articles L. 5-2 (3 °) and R. 1-1-10;
In view of Decision 2006-0576 of 1 June 2006 on the multiannual framework for the provision of universal postal services;
In view of Decision No 2008-1286 of 18 November 2008 on framing characteristics Multiannual postal services tariffs;
In view of Decision No. 2011-1451 of 20 December 2011 on the multiannual framework for the provision of universal postal services;
In view of the proposal for a La Poste concerning the multiannual framework for universal service tariffs Post as of October 26, 2012;
After deliberation on November 6, 2012,

I. -Background

Under Article L. 5-2 of the Postal and Electronic Communications Code, " The Electronic Communications and Postal Regulatory Authority: [...] 3 ° Decides, after examination of the proposal of La Poste or, failing a proposal, ex officio after it has informed it, of the multiannual framework characteristics of the rates of the universal service, which may, if necessary, distinguish Shipments in the number of consignments [...] ".
In 2012, the ARCEP examined jointly with La Poste the economic prospects of the universal postal service, in the light of the projected trajectory of trafficking and Charges.
As regards the evolution of trafficking, the ARCEP retained, on the basis of La Poste's proposal, an annual average change of -4.1 % of the economic volumes (1) between 2012 and 2015. This proposal, which is based on the projection of La Poste according to the different ranges of universal service shipments, is comparable with the trend observed over the period (2009-2011), which stands at an average of 4.7 % per year.
La Poste a Presented an evolution of its expenses over the period (2012-2015) which corresponds to an effort to adapt to the evolution of volumes comparable to that observed over the period (2009-2011). This adaptation incorporates the effect of the development of the green letter, whose rise in charge reflects the forecasts of La Poste to date.
With a price factor of 1 percentage point above inflation, these assumptions lead to Provide for the maintenance of the margin rate on the universal service offerings.

II. -The framing device

The framework is set for a period of three years, which is the period from 1 January 2013 to 31 December 2015.

II-1. The global constraint

The price limit for the price of the universal service offerings basket is set at a level equal to that of the consumer price index minus a factor of efficiency X. Efficiency factor X, of-1 %, is fixed on the basis of the inflation assumptions of 1.8 % (in accordance with the draft financial law for 2013) and the annual change in volumes of-4.1 %.

II-2. Incitment to improve quality of service

ARCEP deems it desirable for La Poste to improve its quality of service, in particular concerning the priority letter and the green letter. To this end, a specific device is set up to encourage La Poste to improve its quality of service.
This device, which takes the form of an additional tariff margin, will be specified at the beginning of 2013 and will be based on the objectives of Quality of service of the universal postal service defined in the contract of enterprise between the State and La Poste and fixed by order of the Minister responsible for posts.
It will be implemented in mid-2014 in the light of the Position of La Poste in relation to these quality of service objectives, to take effect in 2015, In order to have the results of quality of service measured during the period of supervision while allowing La Poste to use the additional tariff manoeuvring margins obtained.

II-3. Cases of consignments for use by enterprises referred to " Outside of TP "

Since 2008, this product line has been the subject of a specific framework in the form of a sub-basket whose price changes are strictly limited to inflation. The objective pursued by the ARCEP was to obtain a disconnect between the prices of the ginned offers for individuals and businesses.
This goal of disconnection began to materialize. For example, the price differential for the first weight range of the priority letter increased from-1.0 % to-3.3 % between 2009 and 2012.
This range of products continuing to present high margin rates, this objective of Disconnection is continued but according to a device adapted to the current context of high volumes.
As a result, the average tariff change on products produced outside of TP (priority letter, green letter, and ecopli) accumulated on the Period of tariff framework will be 1 point lower than average tariff change Matching TP products (priority letter, green letter, and ecopli). Each of these developments will be measured on the same basket, that of non-TP offerings. This constraint will be confirmed with respect to the balance sheet on the financial equilibrium of the universal service performed at half time.

II-4. "Green letter product for use by individuals" TP "

The tariff difference between the priority letter and the green letter is 3 cents for the first weight range since the first weight range was created.
The ARCEP reiterates its comments set out in Decision No. 2011-1451 Extending the tariff framework set out in Decision No 2008-1286 for the year 2012, according to which it considered that: In view of its intrinsically higher costs, the prices of the offer in J + 1 should deviate more significantly from those of the offer in J + 2. This differentiation of offers must of course be accompanied by provisions, in terms of
is intended that the tariff of the green letter TP be at least 5 centimes less than that of the priority letter TP for the first weight range. The possibility of increasing the tariff gap beyond that level will be the subject of a mid-term review of the financial balance of the universal service.
This movement aims to ensure better differentiation of the Offers. Furthermore, the ARCEP points out that it will remain vigilant to ensure that all offers of the universal service are effectively available in the points of contact at La Poste, both in machines and in machines.
In addition, this differentiation Should be accompanied by quality of service objectives that help to clearly characterise the offers. In this respect, it is expected that the green letter will rapidly reach the service quality objective of 95 % in J + 2 which La Poste itself has imposed, which appears to be satisfactory for an offer with a normal distribution period of two Days.

III. -The
III-1 technical provisions. Change in the scope of shipments in number of the universal service

La Poste has a great deal of latitude to change the scope of the universal service in respect of bulk shipments, pursuant to Article R. 1-1-10 of the COPC. It thus made use of this possibility by withdrawing the catalogue of the Universal Service of Advertising Mail offers Destineo Integral and Destineo Catalogue Integral as of October 1, 2011.
However, an amendment Substantially the scope of the universal service affects the tariff framework. For this reason, the information provided by the ARCEP, in the event of a change in the scope of the consignments in the universal service provided for in Article R. 1-1-10 of the CECP, must take place at least three months before the date of implementation of this Modification. The fixed framing constraint shall remain applicable on the whole basket remaining from the date of implementation of the modification.
Nevertheless, in the event of a change relating to more than 10 % of the value of the basket, the terms and conditions of The tariff framework may be reviewed.
In addition, in the event of a substantial change in the universal service, La Poste has undertaken to maintain the information of the Authority on products no longer covered by the universal service, at a level Equivalent to the one before the Authority.

III-2. The difference between the assumptions of inflation and trends in traffic and the observed values

The framework parameters are defined on the basis of forecast inflation trajectories of 1.8 % and the evolution of volumes Economic of-4.1 %.
In the case of a deviation between the observed and forecast trajectories, it is necessary to allow an adjustment of the framing parameters. In this way, the constraint on the tariff framework could be either tightened in the case of inflation as measured by the lower INSEE or in the event of a lower reduction in traffic, either released in the case of higher measured inflation or in the case of
The implementation of these adjustment clauses is not automatic. It is triggered either at the initiative of the Authority or at the request of La Poste.

III-3. Measurement of Volumes

In order to better reflect the evolution of traffic in the measurement of price developments, the tariff framework for the year (n) will be based on the traffic of the year (n-1).
This solution has the consequence The use of forecast volumes for the assessment of tariff developments which would take place before the final volumes are known. In this case, the analyses will be prepared on these provisional volume data and the price developments will be definitively measured at the annual balance sheet mentioned below.

III-4. Annual Review

The ARCEP will annually conduct an annual review of the tariff framework, once the final traffic data for the year (n-1) is known.

IV. -Summary

The rates for universal service benefits are subject to a multi-year framework laid down by the ARCEP after consideration of La Poste's proposal. This Decision constitutes the third framework, after those covering the periods [2006-2008] and [2009-2012] set by the decisions of Authority No. 2006-0576, on the one hand, and No. 2008-1286 and No. 2011-1451, on the other, of which it adopts the
It is planned to limit the average price of the universal service over the period (2013-2015) to inflation + 1 %, under the assumptions of a change in traffic of 4.1 % and inflation of + 1.8 %.
This upper limit That the two previous tariff frameworks, set for inflation + 0.3 %, are Consistent with the outlook for lower volumes while incorporating an adaptation of La Poste's charges to its changes in volumes comparable to that observed in recent years.
In these cases, this ceiling must Allow La Poste to ensure the financing of the universal service, by ensuring a stable margin rate for universal service provision over the period of supervision. This corresponds to the objective assigned to the ARCEP by the 3 ° of Article L. 5-2 of the Postal Code and electronic communications.
Three measures complement this overall framework:
-a device, which gives La Poste an additional margin of increase in its tariffs, is intended to encourage it to improve the quality of the universal service; it will be specified in early 2013 and will be based on the quality objectives of Service of the universal postal service specified in the contract of enterprise between the State and La Poste and fixed by order of the minister responsible for posts; it will be implemented in the middle of 2014, in view of the situation of La Poste In relation to these quality of service objectives, to take effect in 2015;
-to hold Taking into account the prospects of a more marked decrease in traffic, the rate of change over the period of supervision, the business-use items will be less than 1 percentage point lower than that of individual shipments, subject to a Mid-period review;
-last, it seemed desirable that the price of the green letter offer, which will allow La Poste to achieve cost savings in transport and optimization of sorting functions, better reflect this Cost savings; furthermore, as the ARCEP indicated in its Decision No. 2011-1451, this Product should benefit from a sufficient tariff gap with the priority letter to encourage consumers to move towards the most suitable offer; therefore, the tariff gap between the priority letter and the green letter will be increased to 5 Cents at least on the first weight range; the opportunity to operate a higher rate gauge will be examined at mid-range.
Decides:

Article 1

The multiannual framework for the tariffs of the universal postal service shall be carried out in accordance with the procedure set out in the document annexed to the Decision.

Article 2

The Director General of the Authority shall be responsible for notifying La Poste of this Decision and of ensuring its Execution. It will be made public, subject to the secrets protected by the law, and published on the website of the Authority and in the Official Gazette of the French Republic.

    A N N E X E
    ARRANGEMENTS OF THE PLURIANNUAL RATE TARIFFS
    DU SERVICE UNIVERSEL POSTAL
    I. -Feature

    The period and the reference year.
    The feature covers the period (2013, 2015), which is three years. The year 2012 is the reference year.
    The overall tariff framework.
    The tariff framework covers a global basket, covering all universal service products, with the exception of incoming cross-border products.
    The average annual price evolution of the universal postal service over the period (2) is at most equal to:
    dp/p ≤ i-X + B
    where:
    i is the annual reference inflation for the period;
    X is the efficiency factor;
    B > 0 is the rate increase factor available on a conditional basis, given the position of La Poste in relation to its objectives. Quality of service.
    The value of factor B and the conditions of its award will be specified in early 2013 and will be based on the quality of service objectives of the universal postal service specified in the contract of business Concluded between the State and La Poste and fixed by order of the minister responsible for
    . Company-use shipments.
    Mesluded on the business-use basket (priority letter, green letter and ecopli), the average price for business-used shipments is less than 1 point, on average. The whole period of supervision, to that of the average price of consignments for personal use.
    In the course of 2014, the ARCEP verifies jointly with La Poste that the conditions for the implementation of this provision are met in the The balance of the universal service accounts.
    Case of the green letter product to
    The tariff difference between the priority letter and the green letter on the first weight range [0-20 g] is increased to at least 5 centimes during the period of supervision.
    In the course of 2014, the ARCEP and La Position examine the possibility of increasing this difference in relation to the objective of the financial equilibrium of the universal service.

    (2) The average annual price of the universal postal service over the period is defined as the average Geometric of annual trends in the price of the universal postal service of the years 2013, 2014 and 2015.

    II. -Initialization

    For the period (2013, 2015), factor X is equal to-1.0 % under the following assumptions:
    -inflation = 1.8 % per year;
    -trends in trafficking = - 4.1 % per year.
    The ceiling for multi-year changes in the rates of the universal postal service is therefore equal to 2.8 % on an annual average.
    The effect on 2013 of increases The measure of the annual evolution of the price of a universal service basket.

    For a specific year (n) the evolution of the price of a basket of universal service. The annual price of a universal service basket is calculated as the evolution from The year (n-1) of the average price in year (n) of the basket of the year (n-1), the sum agreeing on the basic components of the basket:
    (dP/P) n = ∑ [(Pn-Pn -1). Qn -1]/∑ [Pn -1. Qn -1]
    If the information on the basket of the year (n-1) is not available, La Poste will provide an estimate. As soon as the final information on the basket of the year (n-1) is known, the final price developments will be calculated.
    The average price corresponds to the average of the prices applied during the year, weighted by the number of Days.
    Reference inflation.
    Inflation developments are taken into account annually by taking as a new reference value the inflation rate assumed by the finance law (in).
    The measure of inflation The evolution of the traffic.
    The volume concerned is the volume handled by La Poste on the Scope of the basket determined for the tariff framework. Its evolution is measured by a Paasche index weighting the traffic (physical quantities of objects) by the prices,
    (dQ/Q) n = [Pn. (Qn-Qn -1)]/[Pn. Qn -1]
    which is equivalent to constant-price turnover (dR/R):
    (dQ/Q) n = (1 + (dR/R) n)/(1 + (dP/P) n) - 1
    This is the last formula that will be used for the calculation, based on the evolution of the revenue in the basket of the Universal service established in regulatory renditions.

    III. -Adjustment mechanisms

    Inflation-adjustment mechanism.
    An additional fix is applied in year (n) when the actual inflation rate (nn -1) has dropped to an absolute value of more than 0.45 point As a percentage of the inflation rate assumed by the previous year's financial law (in -1).
    The adjustment is made according to the following formula:
    n = 1: i1 * = i1
    n = 2 or 3: In * = in si | Δin-1 | < 0.45 %
    in * = in + Δin-1/2 si | Δin-1 | ≥ 0.45 %
    with Δin-1 = în-1-in-1
    where Δin-1 refers to the difference between the actual rate of inflation (în-1) for the year (n-1) and the inflation rate retained as Financial law hypothesis (in-1) in year (n-1).
    The implementation of this mechanism is not automatic. It is triggered either at the initiative of the Authority or at the request of La Poste.
    Adjustment mechanism for the evolution of economic volumes.
    The volume adjustment mechanism is implemented to take into account the differences noted Between the observed values and the values selected at initialization.
    The adjustment for the forecast variance on the volume is based on the following formula:
    p1 = i1 * - X;
    p2 = (i2 * - X) - b. Δ1;
    p3 = (i3 * - X) - b. Δ2;
    with b = 0.7.
    Δn is the observed difference between evolution (dQ/Q) measured on average over three years, that is, the period [n-2, n], on the one hand, and the initialization hypothesis, on the other hand. Thus, the first adjustment will be made in 2014 (year 2), with the measure for 2013 (year 1) of the difference (Δ1) between the average over the period [2011, 2013] of the change in volume and-4.1 %.
    The implementation of this mechanism is not Automatic. It is triggered either at the initiative of the Authority or at the request of La Poste

    IV. -Reporting

    La Poste will communicate no later than 31 May of the year (n + 1) for the year (n):
    -the detailed annual statistics of the number of objects or products and the rates by weight range corresponding to each of the Universal service provision or benefits since 2011 of the universal service scope;

This information shall be communicated at least three months before the date of implementation of the amendment. The fixed framing constraint shall remain applicable on the whole basket as from the date of modification. If the change relates to more than 10 % of the value of the basket, the terms and conditions of the tariff framework are subject to review.
    In addition, in the event of a substantial change in the universal service, La Poste is committed to maintaining The information of the Authority on products no longer covered by the universal service, at a level equivalent to that which the Authority had.
