Decree No. 2013-50 of 15 January 2013 on the employment of the future Professor

Publics concerned: scholarship students enrolled in the second year of licence or, where applicable, in the third year of licence or in the first year of master's degree, who are at least twenty-five years of age and destined for the teaching professions. The age limit is extended to 30 years for students with disabilities.
Subject: conditions for the implementation of future employment Professor.
Entry into force: the text comes into force on the day after its publication.
Notice: to benefit from a future teacher job, the student in the second or third year of a degree or in the first year of a master must be a fellow. The distribution of future jobs between disciplines and academies is stopped by the ministers responsible for national education and agricultural education
The selection of candidates is entrusted to a commission chaired by the rector.
The decree finally states:
― the procedures for determining the rate of financial assistance allocated to employers' institutions;
- the terms of pay;
the content of the contract with the establishment; and
– the missions that can be entrusted to the beneficiary of a future job teacher.

The Prime Minister,
On the report of the Minister of National Education and the Minister of Agriculture, Agri-Food and Forestry,
Considering the education code;
Vu le Labour codeincluding articles L. 5134-120 to L. 5134-129;
Considering the Labour Code applicable to Mayotte, including articles L. 322-55 to L. 322-64;
Considering the rural code and the maritime fisheries;
Vu la Act No. 2012-1189 of 26 October 2012 creating future jobs;
Having regard to the opinion of the Higher Education Council of 24 October 2012;
Considering the opinion of the National Council for Agricultural Education of 24 October 2012;
Considering the opinion of the National Council for Higher Education and Research of 19 November 2012;
Considering the advice of the ministerial technical committee of the Ministry of Agriculture, Agri-Food and Forestry of 19 December 2012;
Considering the advice of the Departmental Technical Committee of the Ministry of National Education dated 20 December 2012;
Having regard to the letter of referral from the Mayotte General Council dated 28 November 2012;

In the regulatory part of the Labour Code, chapter IV of Book I title III of Part 5 is supplemented by section 8 as follows:


“Section 8



"Employment of the Future Professor


"Art. R. 5134-169. - The student who is a beneficiary of a future teacher job must have the quality of a higher education fellow for the academic year in which he is recruited.
"His stock market quality is verified at each contract renewal.
"Art. R. 5134-170. - The list of academies and the list of disciplines with special needs justifying the priority of recruitment under section III L. 5134-120 are set by joint order of the Minister for National Education and the Minister for Agricultural Education.
"Art. R. 5134-171. - In each academy concerned, a commission presided by the rector or his representative checks whether candidates for a future teacher fulfill the conditions enabling them to benefit from it.
"The rector shall designate the members of the commission who shall include:
« 1° At least two and a maximum of six professor-researchers, including at least one university president or research and higher education centre or a director of a major institution, or their representative;
« 2° At least one academic director of national education services;
« 3° At least four and a maximum of six members of the inspection bodies and heads of establishment, including at least one chief of private educational institution having contracted with the State.
"The Commission also includes the Regional Director of Food, Agriculture and Forestry or its representative.
"Art. R. 5134-172. - On the basis of an application file whose content is fixed by order of the Minister for National Education, the commission gives an opinion on the suitability of candidates for a future job as a teacher.
"The Board's notice takes into account, in particular, the student's professional project and academic results.
"From the list of candidates established by the commission, the rector proposes to local public educational institutions and to private educational institutions having entered into a contract with the State the name of one or more candidates for recruitment for a future job teacher in the first or second degree.
"In terms of agricultural education, the Regional Director of Food, Agriculture and Forestry proposes to local public institutions of agricultural education and vocational training and to private agricultural educational institutions having contracted with the State the name of one or more candidates for recruitment for a future job teacher.
"Art. R. 5134-173. - A joint order of the Minister responsible for employment, the Minister responsible for the budget, the Minister responsible for national education or the Minister responsible for agricultural education sets the rates of care that determine the amount of financial assistance in relation to the employment of future professor.
"Art. R. 5134-174. - The monthly salary of the beneficiary of a future job teacher is equal to the product of the amount of the interprofessional minimum wage of growth by the average monthly number of hours of work.
"Art. R. 5134-175. - I. The contract for the recruitment of a student on a future job teacher specifies the institution or school in which the student performs his or her duties, the duration of the contract, the average weekly working duration and the modalities of variation of the student during the school year.
"The contract also involves the student's commitment to follow the university training in which he is enrolled and to present himself to one of the competitive examinations for teachers of the first or second degree organized by the State.
“II. ― The average working hours are fixed by a joint order of the Minister for National Education and the Minister for Agricultural Education within half of the time limit set out in section L. 3121-10.
"The same order determines the criteria for changes in the weekly working period to take into account, among other things, the calendar of university training and the time required for the preparation and testing of the contest as well as the organization of the working time of the school or school in which the student exercises.
"Art. R. 5134-176. - Students recruited on future jobs professor perform educational support functions in educational institutions and in schools under the leadership of the authorities responsible for the organization of the service.
"In support of teachers, they can participate in the teaching sequences, in the school support activities and in any educational activity organized in the school or school.
"Students recruited on future teacher jobs can also attend some school or school boards. »

“Section 5



"Employment of the Future Professor


"Art. R. 322-60. - The student who is a beneficiary of a future teacher job must have the quality of a higher education fellow for the academic year in which he is recruited.
"His stock market quality is verified at each contract renewal.
"Art. R. 322-61. - A commission presided over by the Vice-President or his representative verifies that candidates for a future job teacher meet the conditions for their benefit.
"The Vice-Chair shall designate the members of the Commission who shall include:
« 1° The Director of the University Training and Research Centre of Mayotte, or his representative;
« 2° From two to four members of the inspection bodies and heads of establishment, including at least one chief of private educational institution having contracted with the State.
"The Commission also includes the Director of Food, Agriculture and Forestry or its representative.
"Art. R. 322-62. - On the basis of an application file whose content is fixed by order of the Minister for National Education, the commission gives an opinion on the suitability of candidates for a future job as a teacher.
"The Board's notice takes into account, in particular, the student's professional project and academic results.
"From the list of candidates established by the commission, the Vice-President proposes to public educational institutions and private educational institutions that have entered into a contract with the State the name of one or more candidates for recruitment under a job of future professor.
"In terms of agricultural education, the director of food, agriculture and the forest proposes to the agricultural education and vocational training institutions of Mayotte and private agricultural education having contracted with the State the name of one or more candidates for recruitment under a job of future professor.
"Art. R. 322-63. - A joint order of the Minister responsible for employment, the Minister responsible for the budget, the Minister responsible for national education or the Minister responsible for agricultural education sets the rates of care that determine the amount of financial assistance in relation to the employment of future professor.
"Art. R. 322-64. - The monthly salary of the beneficiary of a future job teacher is equal to the product of the minimum interprofessional salary guaranteed by the average monthly number of hours of work.
"Art. R. 322-65. - I. The contract for the recruitment of a student on a future job teacher specifies the institution or school in which the student performs his or her duties, the duration of the contract, the average weekly working duration and the modalities of variation of the student during the school year.
"The contract also involves the student's commitment to follow the university training in which he is enrolled and to present himself to one of the competitive examinations for teachers of the first or second degree organized by the State.
“II. ― The average working hours are fixed by a joint order of the Minister for National Education and the Minister for Agricultural Education within half of the time limit set out in section L. 212-1.

The Minister of National Education, the Minister of Economy and Finance, the Minister of Labour, Employment, Vocational Training and Social Dialogue, the Minister of Higher Education and Research, the Minister of Agriculture, Agri-Food and Forestry, the Minister of Overseas and the Minister Delegate to the Minister of Economy and Finance, responsible for the budget, are responsible, each in this case, for the decree issued
