Order of 17 December 2012 with the approval of Bureau Veritas for tanks, multi-element gas containers (CGEM) and hoses for the transport of dangerous goods by land and sea

Minister of Ecology, Sustainable Development and Energy,
Considering the 1974 International Convention for the Protection of Human Life at Sea (SOLAS 74) as amended, including the International Maritime Code for Dangerous Goods (IMDG Code);
In view of the agreement reached on 3 June 1999 on international rail transport, known as the "COTIF Convention", in particular its Appendix C on the Regulations concerning the International Carriage of Dangerous Goods by Rail, "RID";
Considering the European Agreement concerning the International Carriage of Dangerous Goods by Road made in Geneva on 30 September 1957, says "ADR";
Considering the transport code, including articles L. 1252-1, L. 5241-4-2, L. 5241-10-1 and L. 5241-10-2;
Vu le Decree No. 84-810 of 30 August 1984 amended to safeguard human life at sea, habitability on board ships and to prevent pollution;
Having regard to the amended Order of 23 November 1987 concerning the safety of ships, in particular Division 411 of its annexed Regulations relating to the carriage by sea of dangerous goods in packages and its Articles 411-6.02, 411-6.05, 411-6.08 and 411-6.09;
Having regard to the amended decision of 29 May 2009 on the transport of dangerous goods by land, said "TDG Order", in particular Articles 15, 19 and 20;
Considering the request of Bureau Veritas, domiciled 67-71, boulevard du Château, 92571 Neuilly-sur-Seine, dated 26 March 2012;
In the light of the opinion of the Interdepartmental Commission on the Transport of Dangerous Goods dated 10 October 2012,
Stop it!

Article 1


The subsidiaries, institutions, agencies and branches of Bureau Veritas that may justify the accreditation referred to in 1.6 of section 20 of the above-mentioned TDG Order shall be granted the approvals set out in sections 2 to 9 of this Order.

Article 2


Bureau Veritas is a registered body to issue the type certificates of portable tanks provided for in 6.7.2.18.1, 6.7.3.14.1 and 6.7.4.13.1 of the ADR, RID and the above-mentioned IMDG code. In this context, Bureau Veritas is empowered to act and decide in place of the competent authority under the conditions set out in section 411-6.02 of Division 411 referred to above.

Article 3


Bureau Veritas is a registered body to issue the type approval certificates of multi-element gas containers (MCGs) as provided for in 6.7.5.11.1 of the ADR, RID and the above-mentioned IMDG Code. In this context, Bureau Veritas is empowered to act and decide in place of the competent authority under the conditions set out in section 411-6.08 of Division 411 referred to above.

Article 4


Bureau Veritas is a registered body for the issuance of IMO 4, 6 and 8 Road Tank Vehicle Certificates as provided for in 6.8.3.1.3.2, 6.8.3.2.3.2 and 6.8.3.3.3.2 of the above-mentioned IMDG Code. In this context, Bureau Veritas is empowered to act and decide in place of the competent authority under the conditions set out in section 411-6.05 of Division 411 referred to above.

Article 5


Bureau Veritas is a registered body to issue the initial, periodic or exceptional inspection certificates for IMO and UN portable tanks as well as MEGCs following the planned inspections and tests for tanks, 6.7.2.19, 6.7.3.15 and 6.7.4.14 and, for MEGCs, 6.7.5.12 of ADR, RID and the above-mentioned IMDG Code. These inspections and tests are carried out under the conditions set out in section 411-6.09 of Division 411 referred to above.

Article 6


Bureau Veritas is an authorized body to perform the inspections, tests and verifications under the ADR and RID 6.8.2.4.5 and 6.8.3.4.16 referred to above, on fixed tanks, demountable tanks, battery-vehicles, tank-vehicles, removable tanks and battery-vehicles.

Article 7


Bureau Veritas is a registered body to issue certificates of compliance of fixing devices linking fixed LPG storage tanks to the transport unit under 3.5 (3) of Schedule I to the above-mentioned TDG Order.

Article 8


Bureau Veritas is a registered body to perform the tests and markings on the hoses under 3.1 (4), 4 and 5.2 of Appendix IV.1 of the aforementioned TDG Order.

Article 9


Bureau Veritas is an accredited body to perform the test on the lids under Appendix IV.8 2.6 of the above-mentioned TDG Order.

Article 10


Pursuant to section 19 of the above-mentioned TDG Order, the Regional Directorates for Vehicle Safety Controls, as defined in the TDG Order, control the activity of Bureau Veritas in relation to sections 6 to 9 of this Order.

Article 11


To carry out the operations resulting from this approval, Bureau Veritas shall adhere to the procedures established in this regard by its care and forwarded to the Minister for Land and Maritime Transport of Dangerous Goods.

Article 12


Bureau Veritas is required to observe procedures for the application of regulatory provisions that are published in the Official Bulletin or notified to it by the Minister for Land and Maritime Transport of Dangerous Goods.

Article 13


The provisions of this Order come into force on 1 January 2013.
This approval is valid until December 31, 2017.
However, it may be restricted, suspended or withdrawn in the event of a serious breach of the obligations set out in this Order or the above-mentioned TMD Order or the above-mentioned Order of November 23, 1987.

Article 14


The Director General of Risk Prevention is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
