Key Benefits:
Publics concerned: beneficiaries of the temporary waiting allowance (ATA), the specific solidarity allowance (ASS), the equivalent retirement allowance (AER) and the transitional solidarity allocation (ATS).
Purpose: Revalue the daily amount of the ATA, ASS, AER and ATS.
Entry into force: the text comes into force on January 1, 2013.
Notice: this decree sets the daily amount:
― from temporary waiting allowance to €11.20;
― of the solidarity allocation specific to 15,90 € and its increase to 6,92 €;
― the equivalent retirement allowance and the transitional solidarity allowance to €34.33.

Vu la Act No. 2007-1822 of 24 December 2007 of finance for 2008, in particular Article 132 II;
Vu le Decree No. 2003-1315 of 30 December 2003 relating to the specific solidarity allocation and amending the Labour codein particular the 1st of its article 8;
Vu le Decree No. 2009-608 of 29 May 2009 Exceptionally establishing an equivalent pension allowance for certain job seekers;
Vu le Decree No. 2010-458 of 6 May 2010 Exceptionally establishing an equivalent pension allowance for certain job seekers;
Vu le Decree No. 2011-1421 of 2 November 2011 Exceptionally establishing a transitional solidarity allowance for certain job seekers;
Considering the opinion of the National Employment Council dated 12 December 2012,
Decrete:
The daily amount of the temporary waiting allowance is set at 11.20 euros from 1 January 2013.
The daily amount of the specific solidarity allowance is set at 15,90 euros from 1 January 2013.
The amount of the increase granted to allocatories aged fifty-five years or older and justified by twenty years of employee activity, to allocatories aged fifty-seven years and a half or more justifying ten years of employee activity and to allocatories justifying at least 160 trimesters validated in the mandatory basic old-age insurance plans or recognized equivalent periods is set at 6,92 January 2013.
Daily amount of the equivalent pension allowance provided by the II of section 132 of the above-mentioned Act of 24 December 2007 and the decrees of 29 May 2009 and 6 May 2010 is set at 34.33 euros from 1 January 2013.
The daily amount of the transitional solidarity allowance provided by the decree of 2 November 2011 referred to above is set at 34.33 euros from 1 January 2013.
The Minister of Economy and Finance, the Minister of the Interior, the Minister of Labour, Employment, Vocational Training and Social Dialogue, and the Minister Delegate to the Minister of Economy and Finance, responsible for the budget, are responsible, each with respect to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
