Judgment of 17 October 2012 on the general organization of schooling of career cadets of the Military Special School and the Inter- Weapons Military School

Vu le Decree No. 95-590 of 6 May 1995 concerning the Inter-Military Military School, including Article 2;
Vu le Decree No. 95-729 of 10 May 1995 relating to the Special Military School of Saint-Cyr, including its article 2;
Vu le Decree No. 2008-940 of 12 September 2008 amended to include the special status of the armed officers, including article 14. ;
Vu le Decree No. 2008-947 of 12 September 2008 Amending certain provisions applicable to military students in military schools of career cadets;
Vu le Decree No. 2010-386 of 15 April 2010 assigning the degree of licence to officers graduated from the Inter-Military Military School;
In view of the decision of 31 August 2009 establishing certain provisions relating to career cadets of the Land Army,

The Special Military School of Saint-Cyr and the Inter-Military Military School are under the authority of the human resources of the army of land. They are placed under the command of a general officer of the army who bears the title of general commanding the schools of Saint-Cyr Coëtquidan.

An instruction by the general commanding the schools of Saint-Cyr Coëtquidan sets out the general content, the course and objectives of the schooling of the officers of the Special Military School of Saint-Cyr and the Military Inter- Weapons School. It also defines the conditions for the organization of the reviews and the factors assigned to them.

Each of the schools has a development council that can be consulted by the Minister of Defence and the Chief of Staff of the Army on matters related to the general organization of schools, admission and schooling of the students. Their operating procedures are specified by instruction.

The Military Special School Development Board includes:
1° State officials, appointed by order of the Minister of Defence, on the proposal of the Chief of Staff of the Army:
– a personality chosen according to its competence, president;
– two general or senior officers in military special school graduates;
- five civil figures chosen because of their competence;
two teachers of the special military school;
a preparatory class teacher at the special military school.
The duration of their term is two years, renewable twice.
2° Members of the law:
– Assistant to the Human Resources Director of the Army of Land, commander of the schools and high schools of defence under the Army of Land, vice president;
– the director of the human resources of the army, or his representative;
the inspector of the army of land, or his representative;
– the commander of the schools of Saint-Cyr Coëtquidan;
– the general manager of the military training of the schools of Saint-Cyr Coëtquidan;
― the general director of the teaching and research of the schools of Saint-Cyr Coëtquidan.
3° A third-year pupil and a second-year pupil of the Saint-Cyr Military Special School, appointed by the school commander.
4° Volunteer members:
―the president of the friendly association of students and former students of the Special Military School of Saint-Cyr (La Saint-Cyrienne) ;
– two personalities chosen according to their expertise.

The Inter-Military Military School Development Board includes:
1° State officials, appointed by order of the Minister of Defence, on the proposal of the Chief of Staff of the Army:
– a personality chosen according to its competence, president;
- two general or senior officers active in semi-direct recruitment;
two civil figures chosen because of their competence;
a personality of the Ministry of National Education;
– a teacher of the schools of Saint-Cyr Coëtquidan;
two members of higher education.
The duration of their term is two years, renewable twice.
2° Members of the law:
– Assistant to the Human Resources Director of the Army of Land, commander of the schools and high schools of defence under the Army of Land, vice president;
– the director of the human resources of the army, or his representative;
the inspector of the army of land, or his representative;
– the commander of the schools of Saint-Cyr Coëtquidan;
– the general manager of the military training of the schools of Saint-Cyr Coëtquidan;
― the general director of the teaching and research of the schools of Saint-Cyr Coëtquidan.
3° A student of the inter-armed military school appointed by the school commander.
4° Volunteer members:
– the president of the Episel;
– a personality chosen according to his expertise.

      During each semester of training, the results of the student officers are appreciated as part of a continuous monitoring of knowledge through written and oral tests, military, academic and sporting examinations, and, where applicable, the evaluation of internships or projects.
      In the event of insufficient results of the student officer, lessons may be validated, if applicable after remedial tests.
      At the end of the schooling, the student officers, with the exception of the student officers recruited under the 4th of Article 4 of Decree No. 2008-940 of 12 September 2008 referred to above, present a specific oral examination covering all the subjects taught under their schooling and the work that has been conducted.

      Each training year is validated when the student officer obtained an average of 10 out of 20 in each of the three training courses defined in section 7 of this Order.
      Subject to the provisions set out in the first paragraph, all tuition is validated:
      - if the student officer recruited under the 1°, 2° and 3° of Article 4 of Decree No. 2008-940 of 12 September 2008 obtains the general average score of 10 out of 20;
      if the student officer recruited under the 4th of Article 4 of Decree No. 2008-940 of 12 September 2008 referred to above graduated from school abroad.

      At the end of the schooling, a jury of nine members proposes the award of the Diploma of the Military Special School of Saint-Cyr to the Minister of Defence (Head of the Army Staff).
      Members of the Diploma Jury shall be appointed annually by order of the Minister of Defence (Head of the Army Staff).
      The Jury of Diploma is presided over by a general officer who is a general officer of an army corps, assisted by a vice-president selected from university professors.
      The other seven members of the Diploma Jury are:
      the general commanding the school or its representative;
      two university professors;
      two senior officers in charge of training at school;
      – two teaching officers at school, including at least one university teacher.
      The jury's proposals are issued by a majority vote.

      The degree is marked.
      The graduation mentions are four: passable, good enough, well and very well.
      The averages entitled to the attribution of these references are:
      16 out of 20 for "very good" mention;
      14 out of 20 for "good" mention;
      12 out of 20 for the mention "good enough";
      ―10 out of 20 for the "passable" mention.

      Successful schooling leads to the issuance of the Diploma of the Special Military School of Saint-Cyr which confers:
      1° The university degree of master;
      2° The title of engineer graduated from the École spéciale militaire de Saint-Cyr, to the student officers who followed the course "Engineering Science".

      The situation of the student officer who:
      ― or did not get the average of ten out of twenty in one or more of the three formations defined in Article 7 of this Order;
      ― or did not get the general average of 10 out of 20 for all schooling;
      ― or did not follow, in particular for health reasons, the totality of schooling or participate in all the trials;
      or for which a change of direction is envisaged,
      is submitted to the board of inquiry.

      The Board of Instruction shall meet at the end of each semester or in special session, in private, on the convocation of the commander of the schools of Saint-Cyr Coëtquidan.

      The student officer concerned is, in all cases, summoned by the instruction board. He may ask to be assisted by a member or a teacher of his choice.
      The instruction board proposes:
      either admit the student officer to pursue or validate his or her education;
      ―to extend the duration of his education for one year;
      - or to change its orientation towards the formation followed by the students of the technical and administrative corps;
      or to exclude it from school and to terminate the student's contract.
      The duration of schooling can only be extended for one year.
      In the event of a proposal for the validation of all schooling, repetition, reorientation or exclusion and termination of contract, the commander of the schools of Saint-Cyr Coëtquidan shall transmit the advice of the council for decision to the Minister of Defence (Head of the Army Staff).

      The commander of the schools of Saint-Cyr Coëtquidan sets out the final rankings of the student officers in order of merit and type of recruitment, based on the results obtained throughout the school.

      The list of graduates of the Special Military School of Saint-Cyr is established in alphabetical order by decree of the Minister of Defence ( Chief of Staff of the Army of Land) published in the Official Journal of the French Republic.

      The duration of schooling at the Inter-Armed Military School is two years.
      It includes four semesters, including two to dominant military and two to dominant academic.

      The schooling of the student officers includes:
      – military training to prepare cadets at their level and middle of employment and command;
      ― an academic training whose dominant is the function of the course followed;
      – a human training that prepares student officers for the exercise of the authority, ethics and ethics of the arms trade.

      The commander of the schools of Saint-Cyr Coëtquidan decides on the orientation of the cadets of the inter-arms military school in one of the following three training courses:
      – Defence science and technology;
      geopolitical, international relations and strategy;
      - economy and public/defense management.

      On an exceptional basis, student officers may be appointed by the commander of the schools of Saint-Cyr Coëtquidan, according to the diplomas held during their admission to school and their special skills, to follow part of their academic or military education in French or foreign higher education institutions.

    The decision of 28 July 1982 concerning the Council for Development of the Military Special School of Saint-Cyr, the decision of 16 February 1984 on the Council for Development of the Inter- Weapons Military School, the decision of 6 June 1995 on the Inter- Weapons Military School and the decision of 18 February 2003 on the Military Special School of Saint-Cyr are repealed.
