PUBLIC FONCIER MOBILISATION ACT FOR HOUSING AND AT STRENGTHENING THE OBLIGATIONS FOR THE PRODUCTION OF SOCIAL HOUSING
The Constitutional Council has been seized, under the conditions laid down in the second paragraph of Article 61 of the Constitution, of the Law on the Mobilization of Public Land in favour Of housing and the strengthening of social housing production obligations, on 10 October 2012, by MM. The Constitutional Council,
Given the Constitution;
Seen Order n ° 58-1067 of 7 November 1958 as amended by the Organic Law on the Constitutional Council;
In view of the observations of the President of the Senate, registered on 18 October 2012;
Seen the Government's observations, recorded on October 19, 2012;
Le Rapporteur having been heard;
1. Considering that the petitioners and members of the House of Commons defected to the Constitutional Council the Law on the Mobilization of Public Land for Housing and the Strengthening of Obligations for the Production of Social Housing; Causes the conditions for the examination of the draft law by the first seised assembly, which would not comply with Articles 29, 39, 42, 44, 45 and 51-1 of the Constitution, rather than the constitutional requirement of clarity and sincerity of the debates Members of Parliament; and that the applicants also challenge compliance with the Constitution of Articles 3, 10, 15 and 16;
2. Considering that under the first paragraph of Article 42 of the Constitution: The discussion of the draft and draft laws shall, in session, include the text adopted by the committee referred to in accordance with Article 43 or, failing that, the text before the Assembly " ; that it is clear from the terms of that article that the grantor has heard that, after being placed on the agenda under the conditions laid down in Article 48 of the Constitution, the discussion of a draft or draft law shall be held in session on the A text adopted by the committee referred to in accordance with Article 43; that it is otherwise only in the case where the committee seised pursuant to Article 43 has rejected the text submitted to it and the one in which the committee did not Delivered on all articles of the text before the start of the examination in session;
3. Considering that the Standing Committee of the Senate, seized pursuant to Article 43 of the Constitution, appointed a Rapporteur and met to rule on the draft law during the morning of Monday, 11 September; Minutes of the meeting, after having adopted various amendments and considered all the articles of the text, this committee concluded its work in the morning even by adopting " The bill so amended " ; that, notwithstanding the adoption of this draft by the competent Standing Committee, the examination of the text in a public meeting which began on 11 September at night dealt with the text of the bill before the Senate; that the law relating to the Mobilisation of public land for housing and the strengthening of social housing production obligations has not been discussed in accordance with the first paragraph of Article 42 of the Constitution; that it has subsequently been adopted in accordance with a Procedure contrary to the Constitution;
4. Considering that, without the need to examine the other grievances, it is appropriate for the Constitutional Council to declare unconstitutional the whole of the Law on the Mobilization of Public Land in favour of Housing and Strengthening social housing obligations,
Decides:

Article 1


The Law on the Mobilization of Public Land for Housing and the Strengthening of Housing Production Obligations Social is contrary to the Constitution.

Article 2


This decision shall be published in the Official Journal of the French
