Order dated August 6, 2012 extending d 'an endorsement to an agreement entered into under the national collective agreement of the#039industry (No. 176)

The Minister of Labour, Employment, Training Professional and social dialogue,
Seen job code, including its article L. 2261-15;
In view of the Order of November 15, 1956 and the successive orders extending the collective agreement Of the pharmaceutical industry of 6 April 1956 and of the texts which have supplemented or amended it;
Having regard to the amendment of 24 March 2011 to the agreement of 19 April 2006 on social dialogue in undertakings without trade union representatives, concluded Within the framework of the aforementioned national collective agreement;
In view of the request for extension by the signatory organisations;
In view of the opinion published in the Official Journal of 8 November 2011;
In view of the opinions gathered during the investigation;
In view of the reasoned opinion of the National Commission for the Negotiation Collective (Sub-Committee on Conventions and Agreements), delivered at the June 4, 2012 meeting,
Stop:

Article 1


All employers and employees included in the scope of the National collective agreement of the pharmaceutical industry of 6 April 1956, the provisions of the amendment of 24 March 2011 to the agreement of 19 April 2006 on social dialogue in undertakings without trade union representatives concluded in the framework Of the aforementioned national collective agreement, excluding the words " At the national level " As contrary to the principle of equality as interpreted by the Court of Cassation (Cass. Soc. 29 May 2001, Cegelec).

Article 2


The extension of the effects and sanctions of the aforementioned amendment shall take effect from the date of publication of the This Order for the remainder of the term and the conditions laid down by the said rider.

Article 3


The Director General of Labour shall be responsible for The execution of this Order, which shall be published in the Official Journal of the French Republic.
