The Authority Regulation of electronic communications and posts,
In view of Parliament Directive 1998 /34/EC European and Council of 22 June 1998 laying down an information procedure in the field of technical standards and regulations and rules on the services of the information society;
Having regard to Parliament's Directive 1999 /5/EC And the Council of 9 March 1999 on radio equipment and telecommunications terminal equipment and the mutual recognition of their conformity, and in particular Articles 3.2, 4.1 and 6;
In view of Directive 2002 /20/EC Amended by the European Parliament and the Council of 7 March 2002 on the authorisation of Electronic communications networks and services;
In view of Directive 2002/21/EC as amended by the European Parliament and the Council of 7 March 2002 on a common regulatory framework for electronic communications networks and services ;
In view of Recommendation ERC/REC/25-10 of the European Conference of Postal and Telecommunications Administrations (CEPT) on frequency bands for the use of audio and video links by auxiliary design equipment Programs and broadcasting;
Seen the recommendation ERC/REC/70-03 of the European Conference of Postal and Telecommunications Administrations on the use of low-range devices, and in particular its Annex 10;
Given the postal code and electronic communications, and Articles L. 32-1, L. 33-3, L. 36-6, L. 41-1 and L. 42;
In the light of Decree No. 2002-775 of 3 May 2002 taken pursuant to 12 ° of Article L. 32 of the Postal Code And telecommunications and limit values for public exposure to Electromagnetic fields emitted by equipment used in telecommunications networks or by radio installations;
In view of the decree of 3 April 2012 amending the national distribution table of the Frequencies;
In view of Opinion n ° 2008-2 of 4 March 2008 of the Conseil supérieur de l' audiovisuel;
In view of notification n ° 2010 /0740/E to the European Commission of the draft decision;
The Advisory Committee on Electronic Communications having Been consulted on December 10, 2010;
After deliberation on May 15, 2012;
For these reasons:
The purpose of this Decision is to determine the conditions for the use of radio frequencies by audio auxiliary equipment for program design and broadcasting in the frequency band 1 785-1 800 MHz.
In order to ensure compliance with the technical requirements of the French regulatory framework with the harmonized framework defined by the CEPT, this decision is based on the following recommendations:
-ECPT Recommendation ERC/REC/25-10 on frequency bands for the use of audio and video links by ancillary program design and broadcasting equipment identifies the band 1 785-1 800 MHz for The use of ancillary sound equipment for program design and broadcasting;
-CEPT Recommendation ERC/REC/70-03 on the use of low-range devices, and in particular its Annex 10, which sets out the Conditions of use attached to wireless microphone applications in the Frequency band 1 785-1 800 MHz.



On the legal framework


The national distribution table Frequency bands (TNRBF) states that in regions 1 and 2 within the meaning of the ITU, the ARCEP benefits under Annex 7 of the TNRBF from the possibility of authorizing the use of the band 1 785-1 800 MHz by wireless microphones without warranty of Protection and subject to non-interference with other services.
At the national level, the I Article L. 42 of the Postal Code and Electronic Communications (CPCE) provides that " For each of the frequencies or bands of radio frequency assigned to it pursuant to Article L. 41 outside the uses for experimental purposes, the Authority shall [...] fix, under the conditions laid down in Article L. 36-6: 1 ° The technical conditions for the use of the frequency or frequency band; 2 ° The cases in which the authorisation of use is subject to the declaration provided for in Article L. 33-1; 3 ° Cases in which the use of the Frequency is subject to administrative authorisation ".
In addition, the II of Article L. 42 of the CPCE provides: ' The Electronic Communications and Postal Regulatory Authority may also, under the conditions laid down in Article L. 36-6, provide for restrictions on the types of equipment, networks and technologies used in the bands of Frequencies allocated to electronic communications services in the national frequency band allocation table and assigned to it if necessary for: (a) Avoid harmful interference; (b) Protect public health; (c) Ensure the technical quality of the service; (d) Optimize the sharing of radio frequencies; (e) Preserve the efficiency of the use of the spectrum; or (f) Carry out a Objective under Article L. 32-1. These restrictions shall be proportionate and non-discriminatory ".
In addition, pursuant to the provisions of Article L. 33-3 of the CPCE, radio installations not using frequencies specifically assigned to them Users shall be established freely and the conditions for the use of such installations shall be determined in accordance with the conditions laid down in Article L. 36-6 of the CPCE.
Finally, Article L. 36-6 of the CPCE provides that " Electronic communications and posts shall specify the rules concerning: [...]
3 ° The conditions of use of the frequencies and frequency bands referred to in Article L. 42;
4 ° The conditions [...] for the use of the networks referred to in Article L. 33-3; [...]
Decisions taken pursuant to This Article is, after approval by the Minister responsible for electronic communications, published in the Official Journal ".
It follows from the foregoing that the Authority is competent, on the basis of Articles L. 33-3 (1 °), L. 36-6 (3 ° and 4 °) and L. 42 of the CPCE, to fix:
-the technical conditions for the use of frequencies;
-the conditions necessary to avoid harmful interference;
-the type of equipment, network or service to which the use of frequency or tape Frequency shall be reserved, where appropriate, to the extent that such restrictions are necessary in particular to avoid harmful interference and ensure the technical quality of the service;
-the cases in which the use of the frequencies is Subject to individual administrative authorization.


On the Conditions of use in the frequency band 1 785-1 800 MHz


This Decision provides for the use of audio auxiliary equipment in the design of programs and broadcasting in the frequency band 1 785-1 800 MHz by Professional users (including live performance entrepreneurs within the meaning ofArticle L. 7122-2 of the Labour Code) So as to limit the number of equipment using the To restrict the risk of harmful interference and preserve the technical quality of the service. This use by professional users is not subject to individual administrative authorisation.
In addition, the use of the spectrum must comply with the essential requirements as defined by the provisions of 12 ° Article L. 32 of the CPCE. For example, it must comply with the applicable standards for exposure to radio frequencies resulting from Decree No. 2002-775 of 3 May 2002,
Decides:

Item 1 article L. 7122-2 of the job code.

Article 2


Design auxiliary sound equipment Programming and broadcasting in the frequency band 1 785-1 800 MHz shall comply with the radio interface technical requirements specified in the annex to this Decision.

Article 3


The use of frequencies by audio auxiliary equipment in program design and broadcasting shall not cause any harmful interference to the Primary radio communications services and cannot claim any Protection against harmful interference due to primary radiocommunication services.

Article 4


The Director General of the Authority Regulation of electronic communications and posts is responsible for the implementation of this Decision, which will be published in the Official Journal of the French Republic, after approval by the Minister responsible for communications Electronic.
