Electronic Communications and Postal Regulatory Authority,
Seen directive 1998 /34/EC of the European Parliament and of the Council of 22 June 1998 providing for an information procedure in the The field of technical standards and regulations and rules on the services of the information society;
In view of the decision of the European Commission 2011 /829/EU of 8 December 2011 amending Decision 2006 /771/EC on The harmonisation of the radio spectrum for short-range devices;
Given the postal code and electronic communications, and in particular Articles L. 32-1, L. 33-3 (1 °), L. 36-6 (3 ° and 4 °), L. 41-1 and L. 42;
Seen Order No. 2002-775 Of 3 May 2002 taken pursuant to 12 ° of Article L. 32 of the Code of Posts and Telecommunications and relating to the limit values for exposure of the public to electromagnetic fields emitted by equipment used in networks of Telecommunication or radio installations;
In light of the Prime Minister's decision of 3 April 2012 to amend the national distribution of frequency bands;
In view of Decision No. 2007-0681 of the Regulation of electronic communications and posts as of 24 July 2007 fixing Conditions for the use of radio frequencies for low-range installations in the band 2 400-2 483.5 MHz;
In light of Decision No. 2010-0913 of the Electronic Communications Regulatory Authority and of the September 2, 2010 assigning radio frequencies to users of low-power and low-power radio installations in the band 868-870 MHz;
In light of Decision No. 2010-0914 of the Regulatory Authority Electronic communications and positions setting conditions as of September 2 2010 to use radio frequencies for low-power and low-power radio installations in the band 868-870 MHz;
The Advisory Committee on Electronic Communications was consulted on 27 April 2012;
After deliberation on May 15, 2012,
For these reasons:
This Decision sets out the conditions for the use of non-specific short-range devices in the 122-123 GHz and 244-246 GHz bands in accordance with the Requirements established at European level. The Authority thus implements the decision of the European Commission 2011 /829/EU of 8 December 2011 on the harmonisation of radio spectrum for short-range devices.
In this context, Article L. 33-3 (1 °) of the Posts and electronic communications puts in place a system of freedom of establishment for radio installations not using frequencies specifically assigned to their users.
In accordance with the Commission's decision European 2011 /829/EU, the use of short-range devices Requires no individual frequency allocation and falls within the scope of the regime laid down in Article L. 33-3 (1 °). For this reason, the Authority, in accordance with its powers established in this field by Article L. 36-6 (3 ° and 4 °), specifies the rules concerning the conditions of use of the frequencies identified for these devices.
In a Perspective In order to simplify the regulatory framework relating to the conditions for the use of frequencies for non-specific short-range devices, this Decision incorporates all the conditions for the use of frequencies for these Devices in accordance with the requirements established at the level The implementation of the amended Decision 2006 /771/EC on the harmonisation of the radio spectrum for short-range devices.
These conditions of use replace, in the same way, those fixed by the Decisions on the regulation of electronic communications and the following posts:
No. 2002-0934 of the Telecommunications Regulatory Authority dated 22 October 2002 setting out the conditions for the use of low-power and low-power radio installations in the band 26.957-27.283 MHz ;
-Decision No. 2002-0936 of the Telecommunications Regulatory Authority dated 22 October 2002 establishing the conditions for the use of low-power and low-power radio installations in the band 5 725-5 875 MHz ;
-Telecom Regulatory Authority Decision No. 2002-0938 in October 22, 2002, assigning frequencies to low-power and low-power radio facilities in the band 26.957-27.283 MHz;
-Telecom Regulatory Authority Decision No. 2002-0940 dated 22 October 2002. October 2002 allocating frequencies to low-power and low-power radio installations in the band 5 725-5 875 MHz;
-Decision No. 2007-0681 of the Electronic Communications Regulatory Authority and posts in Date of 24 July 2007 laying down conditions for the use of frequencies Radio for low-range installations in the band 2 400-2 483.5 MHz;
-Decision No. 2010-0910 of the Electronic Communications Regulatory Authority and of posts dated 2 September 2010 amending Decision No. 2007-0682 designating frequency bands for non-specific short-range devices and setting the conditions for the use of radio frequencies in these bands;
-Decision No. 2010-0911 of 2 September 2010 of the Authority of Regulation of electronic communications and radio frequency assignments Radio to users of non-specific short-range devices in the frequency band 863-868 MHz;
-Decision No. 2010-0912 of 2 September 2010 of the Electronic Communications and Fixing Authority Conditions for the use of radio frequencies for non-specific short-range devices in the frequency band 863-868 MHz;
-Decision No. 2010-0913 of 2 September 2010 of the Communications Regulatory Authority Electronic and radio frequency assignments to the Users of low-power and low-power radio installations in the band 868-870 MHz;
-Decision No. 2010-0914 of 2 September 2010 of the Electronic Communications Regulatory Authority and postal services Conditions for the use of radio frequencies for low-power and low-power radio installations in the band 868-870 MHz;
-Decision No. 2010-0915 of 2 September 2010 of the Regulatory Authority Electronic communications and stations assigning radio frequencies to the Users of non-specific short-range devices in the bands 24-24.25 GHz and 61-61.5 GHz;
-decision n ° 2010-0916 of 2 September 2010 of the Electronic Communications Regulatory Authority and of posts fixing the The use of radio frequencies for non-specific short-range devices in the 24-24.25 GHz and 61-61.5 GHz bands;
As a result:
Article 1 of Decision 2010-0913 dated 2 September 2010 assigning users of non-specific short-range devices the radio frequencies of the bands 868.00-868.60 MHz, 868.70-869.20 MHz, 869.30-869.40 MHz, 869.40-869.65 MHz and 869.70-870.00 MHz is deleted.
The Annex to Decision 2010-0914 dated 2 September 2010 on the technical specifications for the radio interface is replaced by the Annex to this Decision.
Article 4 of Decision No. 2007-0681 of 24 July 2007 laying down technical conditions The use of the different types of low power plants is modified by deleting the reference to the use of the band 2 400-2 483.5 MHz by the non-specific, short-range devices.
Decisions No. 2002-0934, No. 2002-0936, No. 2002-0938 and No. 2002-0940, of the Telecommunications Regulatory Authority and No. 2007-0682, No. 2010-0910, No. 2010-0911, No. 2010-0912, No. 2010-0915 and No. 2010-0916 of the Electronic Communications and Postal Regulatory Authority Are repealed.

Article 3


Non-specific short range devices shall not cause harmful interference to Stations of a service receiving a primary or secondary allocation in the national frequency band allocation table. They cannot claim protection against harmful interference caused by these stations.

Article 4


Article 1 of the Decision n ° 2010-0913 of 2 September 2010 referred to above is deleted.

Article 5


The annex to Decision No 2010-0914 dated 2 September 2010 is Replaced by the Annex to this Decision.

Article 6


Article 4 of Decision 2007-0681 of 24 July 2007 is replaced by the following:

Article 7

The Director General of the Authority Regulation of electronic communications and posts is responsible for the implementation of this Decision, which will be published in the Official Journal of the French Republic, after approval by the Minister responsible for communications Electronics.
