Having regard to the decision of the European Commission EU-829-2011 from 8 December 2011 amending decision 2006/771/EC on harmonisation of the radio spectrum for short range devices;
Saw the post and electronic communications code, and in particular articles L. 32 - 1, L. 33 - 3 (1st), L. 36-6 (3 ° and 4 °), l 41 - 1 and L. 42;
Mindful of Decree No. 2002-775 3 May 2002 made under 12 ° of article L. 32 of the code of posts and telecommunications and relative to the values the public exposure limits for electromagnetic fields emitted by equipment used in telecommunications networks or radio installations;
Having regard to the order of the Prime Minister dated April 3, 2012, amending the national table of frequency allocations;
Having regard to decision n ° 2007 - 0681 of the electronic communications regulatory authority and posts dated 24 July 2007 laying down the conditions of use of radio frequencies for short-range in band 2 installations 400-2483.5 MHz;
Having regard to decision No. 2010-0913 electronic communications regulatory authority and posts dated September 2, 2010, assigning radio frequencies to users of radio installations of low power and low range in the 868-870 MHz band;
Having regard to decision No. 2010-0914 of the regulatory authority for electronic communications and posts laying down conditions dated September 2, 2010, of use of the radio spectrum for radio installations of low power and low range in the 868-870 MHz band;
The advisory commission on electronic communications has been accessed April 27, 2012;
After having deliberated on May 15, 2012, for these reasons: this decision aims to establish the conditions for the use of short range devices in the 122-123 GHz bands and nonspecific 244-246 GHz in accordance with the requirements laid down at European level. The authority is thus implementing the decision of the European Commission EU-829-2011 on December 8, 2011 on the harmonisation of the radio spectrum for devices short-range.
In this context, article L. 33 - 3 (1st) code of postal and electronic communications is implementing a regime of freedom of establishment of radio installations not using frequencies specifically assigned to their user.
In accordance with the decision of the European Commission EU-829-2011, the use of short-range devices does not individual allocation of frequencies and between many in the scope of the regime established by article L. 33 - 3 (1 °). That is why the authority, in accordance with its competencies established in this field by article L. 36 - 6 (3 ° and 4 °), specifies the rules concerning the conditions for the use of the frequencies identified for these devices.
In a perspective of clarity and in order to simplify the regulatory framework relating to the conditions of use of the spectrum for non-specific short-range devices, this decision incorporates all of the terms of use of the spectrum for these devices in accordance with the requirements laid down at European level through the implementation of decision 2006/771/EC on harmonisation of spectrum for short-range devices modified.
These terms of use shall replace, the identical to those laid down in the decisions of regulation of electronic communications and the following posts: ― decision No. 2002 - 0934 telecommunications regulatory authority dated October 22, 2002, laying down the conditions for the use of radio installations of low power and low range in the 26, 957-27, 283 MHz band;
― decision No. 2002-0936 telecommunications regulatory authority dated 22 October 2002 laying down conditions for the use of radio installations of low power and low range in the 5 725-5 875 MHz band;
― decision No. 2002-0938 telecommunications regulatory authority dated October 22, 2002, assigning frequencies to radio installations of low power and low brought in band 26, 957-27, 283 MHz;
― decision No. 2002-0940 by the telecommunications regulatory authority dated October 22, 2002, assigning frequencies to radio installations of low-power and low range in the 5 725-5 875 MHz band;
― decision n ° 2007 - 0681 of the electronic communications and postal regulation authority dated 24 July 2007 laying down the conditions for use of the radio spectrum for low installations brought in band 2 400-2483.5 MHz;
― decision No. 2010 - 0910 the authority of regulation of electronic communications and the positions of 2 September 2010 amending decision No. 2007 - 0682 designating spectrum for non-specific short-range devices and laying down conditions for the use of radio waves in these bands;
― decision No. 2010 - 0911 September 2, 2010, the authority of regulation of electronic communications and positions assigning radio frequencies to the devices users short-range non-specific in the 863-868 MHz frequency band.
― decision No. 2010 - 0912 September 2, 2010 of the regulatory authority for electronic communications and posts fixing the conditions of use of the radio spectrum for non-specific short-range devices in the frequency 863-868 MHz band;
― decision No. 2010 - 0913 2 September 2010 the authority of regulation of electronic communications and positions assigning radio frequencies to users of radio installations of low power and low range in the 868-870 MHz band;
― decision No. 2010 - 0914 September 2, 2010 of the regulatory authority for electronic communications and posts fixing the conditions of use of the radio spectrum for radio installations of low power and low range in the 868-870 MHz band;
― decision No. 2010 - 0915 September 2, 2010 of the regulatory authority for electronic communications and posts assigning radio frequencies to users of short-range devices in the bands 24-24, 25 GHz and nonspecific 61-61, 5 GHz;
― decision No. 2010 - 0916 September 2, 2010 of the regulatory authority for electronic communications and posts fixing the conditions ' use of radio frequencies for short range devices in the bands 24-24, 25 GHz and nonspecific 61-61, 5 GHz;
Therefore: article 1 of decision No. 2010-0913 2 September 2010 assigning to users of short-range devices non-specific radio frequency bands 868, 00-868, 60 MHz, 868, 70-869, 20 MHz, 869, 30-869, 40 MHz, 869, 40-869, 65 MHz and 869, 70-870, 00 MHz is deleted.
The annex to decision No. 2010-0914 on September 2, 2010 on radio interface technical specifications is replaced by the annex to this decision.
Article 4 of decision No 2007 - 0681 24 July 2007 laying down the technical conditions of use of the different types of low-power facilities is amended by deleting the reference to the use of the band 2 400 - 2483.5 MHz by short-range devices non-specific.
Decisions No. 2002 - 0934, no. 2002-0936, no. 2002-0938 and no. 2002 - 0940, telecommunications regulatory authority and no. 2007-0682, no. 2010-0910, no. 2010-0911, no. 2010-0912, no. 2010-0915 and no. 2010 - 0916 electronic communications and postal regulation authority are repealed.
Decided as follows: Article 1 the use of the bands by non-specific short-range devices is not subject to individual authorisation.


Article 2 the frequencies used by the non-specific short-range devices and their technical conditions of use are specified in the following table.

Article 3 the non-specific short-range devices must not cause harmful interference to stations of a service with a primary or secondary allocation in the national table of frequency allocations. They are not entitled to protection against harmful interference caused by these stations.


Article 4 article 1 of decision No. 2010-0913 2 September 2010 above is deleted.


Article 5 annex of decision No 2010 - September 2, 2010 0914 above is replaced by the annex to this decision.


Article 6 article 4 of decision No 2007 - 0681 of July 24, 2007 referred to above shall be replaced by the following: "the following table fixed the technical conditions of use of the different types of low power installations affected by this decision.
