Given the Code Of the work, in particular Article L. 2261-15;
Having regard to the order of 8 February 1991 and the successive orders, in particular the order of 20 July 2009, extending the national collective agreement of 8 October 1990 concerning workers Employees of the building companies not covered by the decree of the 1st March 1962 amended (i.e. occupying more than ten employees) and texts that have completed or amended;
In view of the order of 12 February 1991 and the successive orders, in particular the Order of 20 July 2009, extending the Convention National collective of 8 October 1990 concerning the workers employed by the undertakings in the building covered by the amended decree of 1 March 1962 (i.e. occupying up to ten employees) and of the texts which supplemented or amended it;
Vu The regional agreement (Alsace) of 16 January 2012 on minimum wages, concluded in the Framework of the above-mentioned national collective agreements;
Given the request for extension by the signatory organisations;
In view of the opinion published in the Official Journal of 11 April 2012;
In view of the opinions gathered during the survey;
Vu The reasoned opinion of the National Commission for Collective Bargaining (Sub-Committee on Conventions and Agreements), obtained in accordance with the procedure laid down in article R. 2261-5 of the Job code,
Stop:
Are made mandatory for all employers and employees included in the professional scope of the national collective agreement of 8 October 1990 concerning the workers employed by the undertakings in the building referred to in the decree of 1 March 1962 as amended (i.e. occupying up to ten employees) as supplemented by the amendment No. 1 of 17 March 1992, and in that of the Convention National collective of 8 October 1990 concerning workers employed by undertakings in the building not covered by the decree of 1 March 1962 as amended (i.e. occupying more than ten employees) as extended by order of 8 February 1991, and in its Specific territorial scope, the provisions of the regional agreement (Alsace) of 16 January 2012 on minimum wages, concluded in the framework of the aforementioned national collective agreements.
The extension of the effects and sanctions of the above agreement shall take effect from the date of publication of this Order for the remainder of the term and the conditions laid down by the said Agreement.
The Director General of Labour at the Ministry of Labour, Employment, Vocational Training and Social Dialogue and the Director of Financial, Social and Logistics Affairs in the Ministry of Agriculture, Agri-Food and Forestry Shall be responsible for the execution of this Order, each of which shall be published in the Official Journal of the French Republic.
