It is created, in accordance witharticle 20 of the decree of 29 March 2012 referred to above, a committee of hygiene, safety and local working conditions called CHSCT L216.
This committee is competent, within the framework of thearticle 16 of the decree of 29 March 2012 referred to above, to know of all matters concerning organisms or antennas mentioned in Article 3 of this Order.
The Committee on Hygiene, Safety and Working Conditions established pursuant to Article 1 of this Order shall assist the Technical Committee of the Ile-de-France Defence Base with competence under Title III of the Decree of 15 February 2011 referred to above to all matters concerning all organisms or branches mentioned in Article 3 of this Order.
Organizational bodies or branches within the scope of the hygiene, safety and working conditions committee established pursuant to section 1 of this Order are:
Military high school in Saint-Cyr;
Support group of the Versailles defence base, Saint-Cyr antenna;
Echelon social de Saint-Cyr-l'Ecole ;
Support unit of the defence infrastructure of Versailles, Saint-Cyr antenna.
The composition of this committee shall be as follows:
(a) Administration representatives:
– the head of organization of the military high school in Saint-Cyr or its representative, who chairs it;
- the heads of organizations that have authority over the personnel of the entities listed in Article 3 of this Order or their representative;
(b) Staff representatives: 4 incumbent members and 4 alternate members:
1 head office and 1 alternate seat for the trade union federation Work force of defence, arms industries and similar sectors (FO defense);
3 incumbent seats and 3 alternate seats for the Federation of State Institutions and Arsaries (FEAE-CFDT);
(c) The entity prevention physician(s) listed in Article 3 of this Order;
(d) The professional risk prevention officers of the entities listed in Article 3 of this Order.
In addition, the Labour Inspector in the competent armed forces for the organizations or branches of the body listed in section 3 of this Order is informed of the meetings of this Committee and may attend.
The union federations or representatives designated for this purpose shall have a period of one month, from the date of notification of this order, to designate in writing to the President of the CHSCT referred to in Article 4 of this Order their incumbent and alternate representatives from the electoral body that allowed the formation of the CHSCT and send a copy of this designation to the Human Resources Directorate of the Ministry of Defence and to the general control of the armies, inspection of the work.
As necessary and in accordance witharticle 27 of the decree of 29 March 2012 referred to above, the presidents of the CHSCT concerned coordinate in order to develop the lists of organisms or antennas that fall under the CHSCT, which they chair. To this end, they develop decisions that set up lists of organisms or branches that enter the jurisdiction of CHSCT. These decisions are presented to the prior notice of the CHSCT concerned and then brought to the attention of all officers. A copy of these decisions is sent to the Human Resources Directorate of the Ministry of Defence and to the general control of the armies, inspection of the work in the armies, which ensure, a posteriori, their regularity.
Decisions taken under Article 6 of this Order shall not affect the number and distribution of the seats of the members representing the staff in the CHSCT concerned.
The head of the military high school in Saint-Cyr is responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.
