The Electronic Communications and Postal Regulatory Authority,
In view of the Radio Communications of the International Telecommunication Union;
Due to the postal code and electronic communications, including articles L. 32-1, L. 36-5, L. 39-1 (3 °), L. 42-4, L. 43 (I), R. 20-44-11 (14 °) and D. 406-7 (3 °);
Vu Decision No 2010-0537 of the Electronic Communications Regulatory Authority and of the posts dated 4 May 2010 amended specifying the technical conditions for the use of frequency bands at the radio installations of the services Amateur;
Seen the request for an opinion from the Minister responsible for industry Energy and the digital economy as of January 25, 2012;
After deliberation on March 13, 2012;
In accordance with Article L. 36-5 of the Electronic Communications and Position Code (CPCE), the Minister responsible for Industry, Energy and the digital economy seeks the opinion of the Electronic Communications and Postal Regulatory Authority (ARCEP) on a draft order amending the amended Order of 21 September 2000 laying down the conditions for obtaining the Certificate of operator, allocation and withdrawal of call signs from Amateur services. This draft decree is taken in accordance with Article L. 42-4 of the CPCE.
The ARCEP notes that this draft decree aims to remove the distinction in three classes of operator certificates for amateur services and notes that the provisions relating to In obtaining the operator certificate provided for in this draft decree correspond to the existing provisions for obtaining the class 2 operator's certificate. In particular, the new scheme envisaged provides for the elimination of the Auditory reception of Morse code signals, included in application of Existing provisions in the examination for the obtaining of the operator's certificate for the amateur services of Class 1.
The ARCEP welcomes the device submitted in its opinion in the sense that it makes it possible to simplify the procedures relating to The organisation of examinations giving access to the certificates of operator of the amateur services, while ensuring the holders of the various operator certificates issued prior to the publication of the proposed order the retention of profits Of their class. Article 6 of the draft decree (future Article 7 of the Consolidated Order) provides that call signs are, on the one hand, allocated on a personal basis on the basis of the address of the tax domicile Principal of the applicant and, on the other hand, attributed to repeater stations or Radio-clubs. The ARCEP notes in this respect that Article 25.9 of the Radio Regulations of the International Telecommunication Union associates the call sign with a station since it provides that during their broadcasts " Amateur stations must transmit their call sign at short intervals ".
