Order of 21 March 2012 delegating the powers of the Minister of Defence with regard to enabling decisions to know information and materials covered by the secret of national defence

The following authorities receive delegation of the powers of the Minister of Defence for enabling decisions to know information and materials subject to a secret-defense or confidential-defence classification, concerning personnel under their authority:
I. ― Authorities under the central administration of the department and authorities directly attached to the Minister:
1° The Chief of Staff of the Armed Forces;
2° The General Delegate for Arms;
3° The Secretary General for Administration;
4° The Chief of Staff of the Army of Land;
5° The Chief of the Navy Staff;
6° The Chief of Staff of the Air Force;
7° The Director General of External Security;
8° The Director General of Information and Communications Systems;
9° The Chief of General Control of the Armed Forces;
10° The General Inspectors of the Armed Forces and the Inspector General of the Health Service;
11° Directors and heads of service of the central administration, including delegates;
12° The Director of the Joint Post Service;
13° The High Representative for Defence and Security in the Ministry of Defence;
14° The delegate for nuclear safety and radiation protection for defence activities and facilities;
15° The delegate for the consolidation of the headquarters, branches and central services of the Ministry of Defence.
II. ― Other authorities, not belonging to the central administration of the department:
1° In the army of land:
territorial organic commanders;
- the commander of the earthly forces;
the commander of the centre of doctrine and use of forces;
the commander of the fire brigade of Paris;
2° Within the National Navy:
- the maritime force commanders;
- the maritime borough commanders;
the commander of the navy in Paris;
– the commander of the battalion of the marine- Pompey of Marseille;
3° In the Air Force:
- operational and organic commanders;
– the commander of the military air experience centre;
- the commander of the schools of the air force officers;
- the commander of the schools of the non-commissioned officers and soldiers of the Air Force;
4° Relevant from the military headquarters:
– superior commanders in overseas departments and communities;
– commanders of forces or forces stationed abroad;
- General Defence Area Officers;
- the authorities commanding the following bodies:
(a) Joint Force and Training Staff;
(b) the joint centre of concepts, doctrines and experimentation;
(c) Special Operations Command;
(d) direction of higher military education.

The following authorities shall receive delegation of the powers of the Minister of Defence to sign the enabling decisions to know information and materials subject to a confidential-defence classification for personnel under their authority:
1° Directors or heads of agencies that do not belong to the department's central administration;
2° The commanders of the administrative formations or bodies administered as such from the military and three armies headquarters;
3° Commanders or directors of schools and training agencies of the three armies other than those mentioned in Article 1 II.

In addition to the delegation granted under section 1 of this Order, receive delegation of the powers of the Minister of Defence to sign the enabling decisions of the candidate legal persons or holders of a contract requiring detention or access to classified information or materials, as well as for the personnel of such legal persons:
1° The Director General of External Security, for legal persons and their staff involved in the general direction of external security;
2° The delegate for the consolidation of the core staff, branches and services of the Ministry of Defence, for legal persons and their personnel involved in the Balard project;
3° The General Delegate for Arming, for legal persons and their personnel other than those mentioned in 1° and 2°.

Within the limits of the exercise of their military missions, the following national gendarmerie authorities receive delegation of the powers of the Minister of Defence to sign the enabling decisions to know information and materials subject to a secret-defence or confidential-defence classification concerning military personnel under their authority:
1° The Director General of the National Gendarmerie;
2° Directors and chiefs of service of the general management of the national gendarmerie;
3° Commanders of the gendarmerie region;
4° The commanders of the specialized formations;
5° The commander of the gendarmerie schools;
6° The commander of the overseas gendarmerie.

The authorities mentioned in articles 1 to 4 may delegate their signature to their subordinates.
